In 2021, the procedure for returning rights after deprivation depends on the article of punishment. Obtaining rights after deprivation is regulated by the Code of Administrative Offenses (Article 32.6, Part 4). It is most difficult to return a document if the reason for deprivation was alcohol, drugs or refusal to undergo a medical examination. It is permissible to initiate a return after the expiration of the sentence determined by the court.
Traffic police inspectors no longer have the right to independently confiscate rights . The driver surrenders them himself according to a court order. Until the final decision is made, the right to drive the vehicle is retained.
A detailed description of the procedure for obtaining rights after their deprivation
The classic return scheme looks like this (any sequence of actions is allowed):
- filing an application with the traffic police (strictly at the place of deprivation);
- passing a theoretical exam to test knowledge of traffic rules (everyone can pass it, regardless of the reason for deprivation);
- payment of fines (even if the statute of limitations has expired);
- obtaining rights.
Obtaining a license after being disqualified for drunkenness in 2021 is more difficult. Additionally, a medical certificate is required if the driver is punished under the following articles of the Code of Administrative Offenses:
- driving a vehicle while under the influence of drugs or alcohol (12.8 part 1);
- use of drugs or alcoholic beverages after an accident before the arrival of traffic police inspectors (12.27, part 3);
- refusal to undergo a medical examination (12.26 part 1).
The certificate is valid for one year after receipt. A medical examination with a visit to a therapist, ophthalmologist, ENT specialist, psychiatrist, neurologist and narcologist is allowed to take place in any city, and not just at the place of registration.
How to get your license back after expiration?
A similar question interests quite a few drivers who have been deprived of their driving license.
The rights are returned if the following conditions are met:
- Successful passing of the theory exam.
- Payment of state duty.
- Passing a medical examination and obtaining a medical certificate.
Now the driver can get his driving license back, but since the document has expired, he is obliged to exchange his license for a new one.
Attention! You won't be able to get a new car license right away. The procedure is as follows: first you need to return your old license after deprivation, and then replace your driver’s license.
Required documents for returning rights
The list of required documents is as follows:
- statement;
- passport;
- confirmation of successful completion of the theoretical exam;
- receipts for payment of fines (in case of difficulties in obtaining data from automated information systems);
- a certificate of acceptance of a driver’s license for storage at the traffic police department or a court order with a corresponding note;
- medical certificate in form 003 v/u.
How is the traffic rules test carried out?
Everything is done quite quickly and with a minimum of formalities, in flow mode.
- you come on the appointed day with your passport,
- the examining inspector checks your identity,
- You sit down at the computer and a random traffic ticket opens in front of you with 20 questions that you need to answer correctly.
Among the questions, everything is the same as if you were taking the exam for the first time. The questions are aimed at testing knowledge of the traffic rules itself, as well as the basic provisions for admission (vehicle malfunctions), the Code of Administrative Offenses and fines.
How many mistakes can you make?
As of May 29, 2021 (we monitor changes daily), the allowed number of errors is two. At the same time, for each mistake in the main 20 questions, 5 additional questions are given, the answer to which is no longer possible.
We strongly recommend that, in addition to traffic rules, you learn the tickets themselves and the answers to them, since sometimes the correct answers, to put it mildly, do not clearly correlate with the points of the Rules.
What if you don't pass the first time?
In this case, you will have to re-register for the traffic rules exam after deprivation according to the instructions above - through the terminal with a visit to the traffic police department. You can do this immediately after leaving the exam retake office, but they will register you no earlier than 7 days later, this is stipulated by law.
Unfortunately, the maximum period is not regulated by anything, but according to the very principle of the legislation of the Russian Federation, it should be reasonable.
The number of attempts to pass, however, is not limited - you can retake the exam an infinite number of times until you pass it successfully.
What category of rights will the tickets be for?
According to the (“oldest” of all the ones you have) that you passed when you received your license. If you have several categories, this does not mean that you will take each one separately.
The retake occurs as follows:
- if you have category “B”, then you will take the traffic rules exam in this category,
- for “BC” categories, delivery is made using tickets of “CD” categories (a single set of tickets for this category),
- for the “CE” categories, you retake the exam with “CE” tickets, respectively,
- motorcyclists with category “A” retake only this category if they do not have “B”, otherwise only the last one.

What happens after a successful retake?
If you correctly answered all the necessary questions of the theoretical part of the exam, then based on the results you will be given an examination sheet, which must be carefully stored until the end of the period of deprivation.

Conditions for obtaining rights after deprivation
It is permissible to apply for the return of a driver’s license in the following cases:
- A complete package of documents has been collected (depending on the article of the Code of Administrative Offenses, according to which the driver is deprived of his license).
- All traffic fines have been paid (there should be no active debt in the database, including those with an expired statute of limitations).
- The sentence set by the court has expired. The period is calculated from the date of entry into force of the court decision on deprivation. If within 3 days the driver’s license is not submitted to the traffic police or a statement of loss is not written, the countdown is suspended. And it resumes after the specified actions are completed.
- Successfully passed a theoretical exam on knowledge of traffic rules.
When can I take a traffic test after my license has been revoked?
A driver who has been deprived of his driving license has the right to take the exam no earlier than half the period for which the court decision on deprivation has passed.
As an example, we can cite a situation in which a driver committed a violation for which he was deprived of the right to drive a vehicle for a period of 18 months. In this case, he is allowed to take a repeated theoretical exam no earlier than 9 months after the legal decision comes into force.
If a driver does not pass the classification theoretical exam at the traffic police the first time, then he is allowed to retake it, but not earlier than 7 days after the first attempt.
Theoretical exam before reinstatement
Passing a theoretical exam on traffic rules is allowed only at the place of deprivation. It is impossible to sign up for the exam through the State Services portal. On the service you can only submit an application for the return of rights after deprivation. To sign up for the exam, you need to visit the traffic police department where your license is stored with your passport and pick up a coupon at a special terminal. After filling out the application form, the employee will accept it and inform you of the date and time of the retake. You are not required to present receipts for payment of fines or a medical certificate. If an employee of the State Traffic Inspectorate demands these documents, then this is illegal.
The retake process is no different from the test that drivers take when obtaining a driver's license for the first time. Surrender is permitted after half the period of deprivation has expired. The number of retakes is not limited. After the first failure, a second attempt is allowed after 7 days, after the second - after 2 weeks, after the third - after a month.
Questions are asked exclusively within open categories. 2 errors are allowed. For each question there are 5 additional questions, you can no longer make mistakes. Based on the test results, an examination card is issued.
Retaking the theoretical exam and returning a seized driver's license is not subject to state duty. But if during the deprivation the license has expired, you will have to get new ones with payment of the state fee for issuance (2000 or 3000 depending on the selected sample). When paying through State Services until the end of 2020, there is a 30% discount.
Traffic exam after disqualification
There are some differences between the retake exam after deprivation and the usual theoretical exam to obtain a license for the first time. They consist in the content of the exam questions themselves and the time allotted for preparation. The conditions here are:
- The total number of options (tickets) is 40;
- The number of questions in each ticket is 20;
- Preparation time – 20 minutes;
- The maximum allowed number of incorrect answers is 2. Moreover, for each incorrect answer, 5 more questions (additional) are given, which must be answered without errors.
- All tickets are graded by category (“AB” and “CD”). At the same time, tickets for the exams are given according to the highest category (if the driver’s driving license of the “Aircraft” category was taken away, then he will need to prepare for the exam using the “CD” block).
It should be noted that tickets for retake contain questions exclusively on traffic rules, and they do not cover fines and first aid.
