According to the law, compulsory motor liability insurance is a mandatory document for all drivers, so failure to comply with it is fined, and the issue of meeting deadlines remains very relevant. Because of this, many vehicle owners are interested in whether it is possible to obtain this car policy in advance or extend it until the end of the current validity period.

Re-concluding a contract in advance is necessary in quite common cases, and it is important to figure out how many days before the expiration of the current insurance you can conclude a new version of the deal. What circumstances should you pay attention to in this situation?

How to buy a new policy if the old one has not expired?

Domestic legislation in 2021, in principle, does not limit the right of drivers to take out new insurance if the validity period of the old copy has not yet expired. Such a prohibition is not contained either in the law on compulsory motor liability insurance No. 40, or in other insurance rules of the Central Bank of the Russian Federation or related regulations.

At the same time, it is worth remembering that by default, every car insurance contract is public, so it has significant restrictions. For example, the Civil Code of the Russian Federation and road safety requirements imply for such contractual relations the seller’s obligation to conclude a new transaction at the buyer’s first request.

From this it follows that the company is obliged to sell the mentioned service. But at the same time, the law allows firms to consider any application for a whole month (Article 445), and allocates another month for discussing the protocol of disagreements.

How many days before the expiration date can I apply?

In fact, early receipt of the next MTPL policy is allowed only 30 days before the expiration of the previous document. But some organizations independently extend this period to 2 months, so more current and accurate information on this issue should be obtained directly from your company’s office. Although formally there are no strict restrictions and by law it is possible to buy new MTPL insurance for:

  • day;
  • week;
  • month;
  • 3 months or more.

Only sometimes insurers specifically refuse to issue insurance when there is a long period left before its validity begins. It is logical in such a context to clarify that a request to issue a policy with a start date of more than 1-2 weeks may result in a refusal from the company. But in this case, your rights as a client will be violated.

So the option of filing a response complaint is also not very appropriate here. If you start filming or demanding a written argument for refusing a request to sell insurance much earlier than the start of the action, then the representative may immediately change his decision, because then there will be a good reason not to sell you the policy.

According to Art. 426 and 445 of the Civil Code of the Russian Federation indicate that car owners have the right to agree on the terms of insurance under MTPL for about 30 days. And in order to regulate the protocol, the regulations also provide the same period - a similar extension rule was relevant until 2015.

Previously, drivers bought a motor vehicle license almost 60 days before the old version expired, doing so ahead of schedule. But then RSA began to re-fix tariffs for Green Card agreements every month, so the previously agreed period was halved (to complete all registration procedures).

Therefore, already in 2021, you can insure a vehicle ahead of schedule by purchasing an MTPL policy online or directly in the office only 30 days before the previous contract expires. How to apply

The procedure for drawing up a new contract when applying before its expiration follows the standard renewal scheme. You are required to:

  1. Provide the insurer with a package of documents.
  2. Write an application for a new OSAGO policy. The law does not establish a uniform form of registration, so each company has its own template that must be followed.
  3. Pay the cost of insurance and present the corresponding receipt.
  4. Receive a document whose validity period coincides with the issue date. It can be in electronic or paper format, depending on your preference.

If you plan to take out a compulsory motor liability insurance policy in advance, you need to take into account that this will, in fact, be the conclusion of a new contract. When considering the question of whether it is allowed to renew the policy in advance, it is worth emphasizing that this should be done at least a few days before the final validity period of the current OSAGO . At the auto insurer’s office (you need to personally visit a branch of your insurance company, collect and take a typical package of documents, show your old expired policy, wait for the due amount to be recalculated taking into account accident-free driving rates and a number of other factors - they may differ depending on the organization and region of residence).
  2. Via the Internet (motorists have the right to draw up a new contract online, if the selected insurer has its own portal with the necessary functionality - at least contacts for communication via email - similar actions should be taken, but all documents should be uploaded using a special form and the form should be filled out).

Despite the chosen option, the total period is still exactly 30 days, during which a Russian motorist can legally conclude a new insurance contract while the old one has not yet come to an end.

On April 3, 2002, the Federal Law “On Compulsory Motor Liability Insurance” was adopted. A week later, the Federation Council approved its adoption. Everything related to the validity period of the compulsory insurance contract is reflected in Art. 10.

The MTPL policy is obtained annually. In some cases it is valid for less than a year. After a year has passed, it is extended for another year unless the driver notifies the insurer of his cancellation two months before the expiration of the contract. After that, he can come to the insurance company any day and get new insurance. If he does not come for him on the due day, the insurer will not change the price of the policy, calculated taking into account the current tariffs, benefits and concessions for the driver, for another thirty days.
