A car may be deregistered under certain circumstances:

Quite often you have to deal with a situation where, after selling a car, the new owner does not register it. Naturally, in this situation, the former owner continues to pay taxes. To remove this burden from yourself, you must wait ten days. This is the period given to the buyer to register the car. After ten days, you can contact the traffic police department with a request to stop registration. To do this, you will need to present a contract confirming the sale of this car.

How to deregister a car after an accident while not driving

There are situations when, after an accident, a vehicle cannot be restored. Naturally, you need to take care of removing it from the registration register. If you wish to terminate registration due to disposal, you should determine the future fate of the vehicle in advance. There are several options:

  1. Selling for further disassembly. Often repair services buy such cars to obtain spare parts.
  2. Complete recycling. This process involves sending the car to a company that specializes in car recycling.
  3. Partial recycling. In this case, the owner retains individual components and assemblies. After this, unnecessary residues are sent for recycling.

The order of further actions will largely depend on which of these options was chosen.

What does the new law say?

In this section, we will consider how to deregister a wrecked car according to the new rules, and why owners of damaged cars need to do this first.

Vehicles that cannot be restored after an accident for further use are subject to mandatory write-off. The car owner is obliged to close the registration record of his damaged car so that it is not registered with him.

This needs to be done for several reasons:

  1. The law prohibits the use of a vehicle that cannot be restored.
  2. In addition, the owner of the car, while it is registered, is obliged to pay mandatory transport tax. To rid himself of such liability, the driver needs to cancel his car account.

The process of closing a vehicle registration is documented in the provisions of the Administrative Regulations on Vehicle Registration. Thus, according to Order of the Ministry of Internal Affairs No. 605 (clause 6 of August 7, 2013), the legislation provides for possible options for deregistering emergency vehicles that are not subject to further operation.

There is a specialized government program under which the owner of the vehicle sends the damaged vehicle for recycling, and this can be done in whole or in part (it is possible to take some of the components and spare parts for yourself). After this, the car’s registration is canceled, and the owner’s obligations to pay transport taxes are removed.

According to the provisions of the Administrative Regulations, which document registration actions, vehicle owners now have no connection to the traffic police departments where the car was registered.

Today, to deregister a damaged car, it is enough to visit any department of the State Traffic Inspectorate and write an application to close the registration record.

The procedure for deregistering a vehicle in 2021

Many car owners do not know how to deregister a damaged car (for disposal or sale).
This algorithm will allow them to save money and personal time. The first step is to collect a package of documents. Without them, the procedure for closing a car registration is impossible. They must also be accompanied by a certificate of an accident (if the car burned down, you will need a corresponding document from Fire Supervision). When the traffic police inspector inspects the car, the owner must:

  • remove state signs from the vehicle;
  • return to the State Traffic Inspectorate office with documents and an application for inspection of a damaged car;
  • get transit numbers.

In addition, the owner must receive a PTS with a mark confirming the closure of the registration record.
The validity period of an application for inspection of a damaged car is 20 days. During this period, deregistration of the damaged vehicle is permitted. If, for a number of reasons, the owner of a motor vehicle cannot independently prepare the necessary documents, these actions should be entrusted to a third party. This person is required to have a power of attorney drawn up by a notary.

After it was possible to deregister a car after an accident that is not running or capable of moving, such a vehicle is not allowed to be driven, since it no longer has registration. You can take your vehicle for recycling only by using the services of a tow truck.

You should take with you the documents for the vehicle and license plates that will need to be surrendered. It is worth noting that a vehicle that is being prepared for complete disposal does not always have a registration certificate. It is possible that license plates will also be missing. But this should not be an obstacle to canceling registration.

In general, responsible employees must visually inspect such a vehicle. This will make sure that the car is not running and cannot be restored. To do this, such equipment can be delivered to the department on a tow truck, or a traffic police officer can be called to the parking lot of a non-transportable vehicle. After the inspection, a corresponding report is issued, which confirms that the machine really cannot be used. The act and statement of the owner are grounds for termination of registration. Although you need to know, the inspector can legally refuse to inspect the vehicle. There may be certain reasons for this. For example, an engine sold assembled will cost more if you receive a document from the traffic police confirming that it was removed from a non-restorable car. This document allows the buyer to officially install the engine on the body of another car of the same model.

You also need to be careful with those buyers who do not want to purchase a car for disassembly without documents. Surely such a person is planning to commit some kind of atrocity. There are known cases when a car with a title was sold for dismantling. But the buyer restored it, committed a crime, and abandoned the car. Naturally, in this case the seller becomes the main suspect. If a person is trying to prove that there should be documents on the car, it is better not to contact him at all.

Deregistration due to loss

There are many reasons why an owner is unable to operate a vehicle.
The most common is the loss of a car. Of course, a burnt out or rotten car can be considered a loss. But in this case, its remains must still be disposed of. In most cases, loss means theft of a car.   4. Export from the country. As a rule, deregistration is necessary when the owner of the car permanently takes it to another state. You will need confirmation of payment of the fee, identification card, PTS, STS, and an application requesting termination of registration.
  5. Disposal. Passport, STS, PTS, license plates, payment of fees, application. The cost of the fee includes an inspection of the car by an inspector and obtaining the appropriate certificate.

There are situations when the owner simply does not have some documentation, for example, when a car with a registration certificate is stolen. Or, in a fire, not only the car was burned, but also the license plates and documents for it. In this case, the application indicates the reason why the owner is unable to provide a particular document.

Payment procedure via ERIP

Before we begin collecting documents and visiting the traffic police department, let's turn to the changes in the Rules on the procedure for state registration and registration of cars and other vehicles.
The changes adopted on January 21, 2021 are aimed at simplifying and speeding up state registration and deregistration. The second change concerns the rules for inspecting vehicles subject to registration or deregistration. New vehicles whose production year is the same as the current or previous year do not need to be submitted for inspection. The rule applies only to those who purchased a vehicle from legal entities.

In addition, when deregistering, the following categories of vehicles are not subject to inspection:

  • Recyclable;
  • Stolen and undetected;
  • Seized by court decision and turned over in favor of foreign states.

The procedure for deregistering a car:

  • Download a sample application for deregistration of vehicles in advance and fill it out yourself. The application form for individuals and legal entities is different! With the completed document, come to the interdistrict examination department of the traffic police.

  • The name of the organ and the city where it is located;
  • Full name of the applicant;
  • A specific request, namely, “I ask to be removed from the register”;
  • All available applications are listed, these are PTS, STS and other documents;
  • In the “Information about the owner” column, you need to enter detailed information about him. For individuals, passport details must be provided. If this is an organization, its head and legal address are noted;
  • Please fill in the vehicle details below;
  • The date of completion and signature of the applicant are indicated.

An appendix to the application may be an explanatory note detailing the reason for such a desire. If a proxy acts on behalf of the owner, his details must also be indicated in the appropriate column of the application. When the applicant is the owner, this field is left blank. It is recommended to enter information in printed characters. If the data is unreadable, the traffic police officer may not accept the application. There are also reasons why an inspector will refuse to deregister a car.

These include:

  • outstanding fines or unpaid taxes;
  • credit encumbrances;
  • a crime that was committed with the participation of this car is being investigated;
  • administrative arrest.
