We are talking about amendments to No. 49 that came into force at the end of September 2021 regarding compensation for property losses through repair work. The changes, which come into force in 2021, are aimed at changing the format of compulsory motor liability insurance forms, which will have built-in QR codes. Their relevance is determined by the need to strengthen the degree of information protection for policyholders purchasing electronic MTPL policies via the Internet on the websites of insurance companies.

An important aspect of the changes in 2021 is the expected increase in the price of the MTPL policy and the introduction of a new format for calculating the CBM - the bonus-malus coefficient, which affects the cost of the insurance contract. The legislator, as it were, encourages motorists who have managed to avoid accidents throughout the entire year of operation of the vehicle, and gives them the right to take advantage of a discount when renewing the contract. And vice versa, assign an increased tariff for participation in an accident of a certain severity, by calculating the number and complexity of accidents committed while driving.

What other innovations will affect MTPL?

In July 2021, the Russian government proposed bill No. 501904-7, introducing a number of changes to the law “On Compulsory Motor Liability Insurance”. According to the draft law card, the State Duma Committee on the Financial Market supported the proposals and submitted the bill for consideration by deputies in the autumn session. The law was adopted in the first reading with a number of amendments that will prepare for the second reading. The bill makes the following changes:

  • Lifting the ban on reinsurance in compulsory motor liability insurance;
  • Equalization of the status of paper and electronic insurance policies;
  • Prohibition on filing recourse claims against a pedestrian who caused an accident and died or was injured, as well as against his relatives;
  • An obligation for all those entering the territory of the Russian Federation to provide customs officers with an auto insurance policy or contract or other insurance provided for by the provisions of international documents for inspection.

OSAGO for the new year 2021 has led to several discussions. The point that most raised the question among parliamentarians was the clause prohibiting recourse against the pedestrian at fault in an accident. Some deputies felt that this was a violation of citizens' rights. Thus, deputy Roshchin stated that “the norm contradicts the equality of civil rights guaranteed by the Constitution. For some reason, drivers are always more at fault than pedestrians.” Deputy Minister of Finance A. Moiseev agreed that everyone should be equal before the law, but Fr. Among other initiatives related to the “automobile” segment, the following were put forward:

  • Limiting the period for applying for compensation to 5 days;
  • Increased fines for not having a valid policy;
  • Introduction of an unlimited European protocol in 3 years;
  • Introduction of mandatory video recording of the conclusion of “automobile civil” contracts;
  • Cancellation of accounting for wear and tear of parts when paying compensation;
  • Introducing the obligation of the insurer to collect compensation through the court from the culprit of the accident without involving the insured;
  • RSA's obligation to compensate for losses if the person responsible for the accident does not have insurance;
  • Increase in the amount of the fine for unjustified refusal to sell compulsory motor insurance, etc.

At the end of September 2021, it became known that the Ministry of Finance had finalized a bill that would exclude several coefficients from the mechanism for calculating the cost of a policy. It was decided to eliminate the territorial coefficient in September 2021, and the engine power factor a little earlier - in September 2021. In order to prevent insurers from going even further into unprofitability than now, the Ministry of Finance proposed from September 2021 to allow companies to reduce or increase the base rate for compulsory motor liability insurance by 30%, and after canceling the second coefficient, change the rate by 40%. The cost of the policy during these manipulations should not exceed three times the base rate. If we consider another expansion of the base rate in both directions, which was proposed by the insurance market regulator, then, according to the Deputy Chairman of the Central Bank V. Chistyukhin, it should not be expected before the spring of 2021.

How will the price of an MTPL policy be determined under the new conditions in 2018?

Regarding the odds:

  • Age and length of service – KBC;
  • Regional registration – KT (for example, for Moscow registration KT = 2.0)
  • Number of drivers;
  • The duration of the MTPL agreement;
  • Owner of the vehicle: private owner or organization.

Regarding the positions of amount calculations;

  • Insurance company tariff - TB (from 3432 to 4118 rubles);
  • Coefficient for the territory where the insurance company is located – KT (for the capital – 2.0);
  • Driving level – KBM;
  • Driver's age and experience - KBC;
  • Number of permitted drivers – KO;
  • Vehicle service life – KC (up to 10 months KC = 0.5; more than 10 months KC = 1);
  • For violation of the conditions under compulsory motor liability insurance – KH (from 1 to 1.5)

Regarding the type of vehicle:

I class is assigned to:

  • Vehicles equipped with towbars;
  • Cars registered in another state;
  • Temporarily unregistered.

When determining the CBM class, the type of vehicle is not taken into account, but only payments under compulsory motor liability insurance made for insured events are taken into account

For drivers who have been driving a vehicle for less than one year, the calculation of the coefficient depends on the following indicators:

  • Have you been in any emergency situations before acquiring compulsory motor liability insurance (KBM is determined by the driver’s class);
  • If there were accidents, what was the amount of damage paid to them and how many payments were made by insurance companies;

Note! If compensation for damage has already taken place, then the amount of the CBM is determined taking into account payments under the MTPL policy made by the insurance company.

And also, if there is evidence that the policyholder entering into the MTPL contract has already purchased a motor vehicle insurance policy previously, then the initial class for the contract will be at the level of the previously valid policy. If such information is not available, then the KMB is assigned level: 3.

The Malus Bonus values ​​are set by the insurance company based on the highest coefficient indicators. When adding new drivers to the MTPL contract, the coefficient must be recalculated. However, when recalculating, what is taken into account is not the time of change in the number of persons allowed to drive a car, but the time period of no more than 1 year before the conclusion of a new MTPL agreement.

How will the odds change?

It is planned to abandon the engine power coefficient and the territoriality coefficients. The calculation itself will become more complicated, especially if three-year policies are introduced. Violators will be forced to pay more for insurance. If the driver is caught violating traffic rules with deprivation of his license, then in the future the cost of compulsory motor liability insurance for him will rise.

The coefficient will change based on the age of the person who will drive the car and the driving experience. It is possible that the final price of MTPL under the amended rules will be influenced by the fact whether the car is used at night, as well as the driving style of the car owner.

Does this mean that the cost of MTPL will increase in 2021?

In accordance with the changes, increases and some discounts are provided for prices and base rates; they will affect the following groups of policyholders:

  • Drivers aged 22-24 years, with up to 6 years of driving experience in the amount of 50%;
  • Drivers aged 25-29 years with driving experience up to 6 years in the amount of 31%, up to 9 years - 22%;
  • Drivers aged 49 and over, driving a car for 14 years, decreased by - 34%.

It is important to note that the MTPL policy and rates are not tied to the owner, but to a specific vehicle. Therefore, if a careful motorist with extensive experience decides to transfer insurance to a colleague who has a history of accidents, then he loses his discount.

Starting from January 2021, the average value of the coefficient for vehicle fleets of organizations will increase, which will affect the total cost of compulsory motor liability insurance for legal entities upward. This decision was made based on the assumption that the more vehicles the owner has, the higher the risk of accidents.

Conditions for registration of compulsory motor liability insurance in 2021

What package of documents will be required for concluding an agreement for citizens of the Russian Federation:

  1. Completed insurance application form;
  2. Diagnostic maintenance card (issued by the auto diagnostic center);
  3. Registration data (technical passport, cars without registration).
  4. Driver's license;

Based on the new requirements, the cost of maintenance will also increase, which before the changes was determined by the average price of 800 - 1500 rubles.

Exceptions apply only to pensioners. They carry out technical inspections of cars over 3 years old for free.

In what order should actions be taken in the event of an accident according to the amended rules?

In the event of an accident, participants are required to act as follows:

  • Call medical help if there are victims;
  • Give a message to the traffic police;
  • Notify the insurance company about the situation, requesting instructions on further actions.

  2. The participants in the accident agreed on the degree of culpability in the incident;

You can draw up a European accident report if:

Will insurance become more expensive if there are traffic violations or fines?

No. At least not in 2021. This amendment, by the way, was also proposed as part of the MTPL reform, but it was not destined to come true.

The reason here is simple, and it has a lot in common with the cancellation of the accident certificate last year - the traffic police simply did not give the go-ahead to provide the database of violators to insurance companies. The argument was a reference to the Federal Law “On the Police”, and without specifying a specific article or paragraph. But if you try to search yourself, you will not find a word in the law about prohibiting interaction with third-party organizations or violating the rights of a citizen by transferring information to them. However, the disagreement of the traffic police only plays into the hands of ordinary motorists, because many have fines.

Increasing insurance prices for drunk driving

The initiative was based on completely good intentions - if a driver often violates traffic rules, which is reflected in the fact that he has fines, then this means that he is also more likely to get into an accident and become the culprit. And you must agree that this is quite logical! Especially if, to increase the cost of the policy, not all violations of the Rules were taken into account, but only certain ones, for example, such as dangerous driving, repeated speeding, violations of intersections or intentional violations.
