If, upon the occurrence of the listed cases, changes are not made to the policy, it is considered invalid. It will not be possible to receive insurance compensation for it if the driver gets into an accident. When a document is checked by a traffic police officer, the owner of a policy with outdated information will be fined. This applies to both the traditional paper format of the form and its electronic analogue EOSAGO.

In a number of situations, making changes to the MTPL policy is not provided for by law:

  • When replacing one policyholder with another, while maintaining the same car in the contract. For example, when changing the owner of a vehicle.
  • Adding another vehicle to the contract while maintaining the same policyholder. This need arises if the owner sells his previous car and buys another.

In these cases, the old insurance contract is terminated and a new one is renewed. You can change information about the owner of a car when selling it if the policyholder is a third party.

At the legislative level, there is no fine or other sanctions for using insurance with outdated information, but provided that it is real and not issued by fraudsters. But insurers often deny such policies to persons injured in an accident, or reduce the discount for accident-free driving, for example, when the driver’s license plate is replaced, but there is no notification about it.

In some cases, difficulties arise with making changes to the car title agreement. For example, after receiving a new policy, a check reveals that there are no adjustments in the database. In this case, you must contact the central office of the insurer and report the incident. If employees refuse to investigate, then the client can protect his rights in court or by contacting the RSA and the Central Bank of the Russian Federation.

To confirm the changes, the policyholder additionally submits originals or certified copies of relevant documents, for example:

  • when registering a new driver or replacing a license: driver’s license;
  • when adding or changing the license plate: vehicle registration certificate;
  • when changing the surname of a person specified in the policy: a document confirming the change of surname (marriage or divorce certificate, certificate of change of surname);
  • when the owner of the vehicle changes: passport details of the owner, vehicle passport, purchase and sale agreement or other document confirming the fact of the change of owner.

To add an additional person to the current MTPL insurance policy, the following documents will be required:

  1. Valid insurance policy.
  2. Technical passport (a document that contains information about vehicle registration).
  3. New driver's passport (identity document).
  4. Driver's license of the person whose data is included in the insurance policy.
  5. Application from the owner of the vehicle, in which he contacts the insurance company with a request to enter information about the new driver. The application is in the form of a form, filled out personally by the owner of the vehicle, without corrections or errors.
  6. A certificate issued by the State Traffic Safety Inspectorate confirming the absence of involvement in an accident within the period specified by law.

Procedure for entering data

  5. Fifth step. If no inconsistencies are found in the submitted papers, the necessary adjustments are made to the policy and the unified register of the RSA. If new data entails a recalculation of the MTPL price, then the policyholder will need to pay the difference and present a receipt to the insurer.

However, in some cases, the auto insurer may insist on early termination of the contract. In this case, part of the paid insurance will be returned to the policyholder, in proportion to the time remaining until the end of the insurance.

Do I need to pay and how long to wait?

Changes to the MTPL policy are made both free of charge and with additional payment. There is no need to pay additional fees for:

  1. Changing the passport data of the vehicle owner or policyholder, if these are different persons.
  2. When the owner of the car is an organization, there is no need to pay for changes to the policy after changing its name.
  3. Change of registration number, technical passport, registration certificate.
  4. Changed passport details of drivers included in the policy will also not require additional payment.

Some adjustments made to MTPL insurance will require recalculation of the contract. They will be registered only after paying an additional amount and providing a bank receipt as confirmation.

Recalculation is carried out in the following cases:

  • The validity period of the car insurance contract is changing. If this period increases, the policyholder must pay extra for additional months. If the validity period is shortened, he, on the contrary, has the right to demand the return of the overpaid amount from the insurance company.
  • Adding one more driver to OSAGO, in addition to those already included in the policy. Here, the need for additional payment and its size depend on several criteria. This is the age and driving experience of the new driver. If he is under 22 years of age, with little driving experience, then the policyholder will have to pay an additional amount for insurance.

This is due to the increased risk of an inexperienced driver committing an accident, and, consequently, to the increased likelihood of the company’s expenses for paying compensation for the damage caused to them. The same applies to the class of the person being entered in the KBM system. The lower the class, the more expensive it will cost to reissue an insurance policy.

  • Technical changes in the design, as a result of which the engine power, the number of passengers carried, and the maximum weight of the vehicle became different.

According to the standards established in Federal Law No. 40, the insurer is given a period of three days to review the received set of documentation. The time it takes to make changes to the MTPL policy and information base is usually one, less often two, working days. If you arrange an appointment with an insurance agent in advance, the entire procedure can take less than an hour, provided that the accompanying documents are completely complete.

What data in the policy cannot be changed?

There are some basic data that under no circumstances can be changed in the contract. In this case, the old contract is terminated and a new one is concluded. What kind of data is this?

  • When the vehicle itself changes.
  • When there is a need to change the policyholder himself (not the owner of the vehicle, but the policyholder).
  • When the policyholder wants to change the term of insurance (for example, you want to change temporary insurance to regular insurance).

How to change your insurance policy?

As soon as you receive a new driver's license, you should immediately visit the office of your insurance company and write an application to change your data. Usually the insurer provides the driver with a special template for this, but sometimes it itself makes all changes to the insurance based on the documents provided.

The application will need to be accompanied by:

  • passport of a citizen of the Russian Federation;
  • vehicle registration certificate;
  • new driver's license;
  • current MTPL insurance policy.

Sometimes the insurer may require a certain fee to be paid when changing information in the insurance; this is not prohibited by law (for example, if the insured person has a short driving record). However, serious and large insurance organizations rarely charge money for this.

As a result, a record of new rights will appear on the insurance policy form in the “Special Notes” column, as well as the date and time the change was made to the policy. In very rare cases, it may be necessary to make a duplicate of the insurance policy, which takes no more than 2 days. All changes to the compulsory motor third party insurance (MTPL) insurance are made to the electronic database by the insurer within the next 5 days.

Making changes requires the driver to appear in person at the insurance company's office. This cannot be done via the Internet or by phone. The application can be written either by the policy holder himself or by his authorized representative if he has a power of attorney correctly executed by a notary.

The right to add drivers to the MTPL policy

When concluding an insurance contract, the insurer assumes financial responsibility in the event of an insured event. The insurance contract is valid for 1 year. These legal relations are regulated by the Federal Law “On compulsory civil liability insurance of vehicle owners” and the Bank of Russia Regulation “On the rules of compulsory civil liability insurance of vehicle owners” (hereinafter referred to as the Regulation).

In accordance with Art. 1.1 of the provisions, the legal owner of the vehicle has the right to conclude an insurance agreement in relation to himself and the circle of persons specified in the contract. In addition, the policyholder can allow an unlimited number of people to drive a car, provided that the permission to drive the vehicle has legal grounds.

In 2021, the Russian Ministry of Finance indicated that if the applicant complies with all mandatory requirements, insurers do not have the right to refuse to conclude MTPL contracts. This rule also applies to cases of changes to existing MTPL agreements. A change typically means adding a new driver to your existing insurance policy.

When should you notify your insurance company?

To promptly notify the policyholder of any changes in personal data, including when replacing licenses due to the expiration of the validity period, is the responsibility of the driver, which is usually stated in the insurance contract, in the section “Rights and Obligations of the Parties.” And always remembering this responsibility is in the interests of the driver himself. This will save you in the future from possible problems with the insurer, who may try to refuse insurance payment on the basis of failure to fulfill the terms of the contract.

Do I need to completely replace the MTPL insurance form when replacing a driver’s license? No, when changing a driver’s license, the insurer must only change one line in the insurance policy and put a special note in the column about the previous license (their number, date of issue).

In this case, the entire policy is not replaced. And putting this mark on the policy is free of charge at any serious insurance company.

Changes to insurance are required in the following cases:

  • the list of persons who are allowed to drive a vehicle (enrolled in the MTPL policy) has changed;
  • one of the drivers included in the insurance replaced his driving license;
  • registration of a new car with the traffic police, if insurance for it was previously issued (the vehicle owner is given only 3 days after registration for this);
  • it is necessary to change the period of operation of the vehicle.

In the following cases, it will not be possible to make adjustments to the insurance contract; you will need to draw up a new document:

  • change of vehicle (insurance is always issued for a specific vehicle);
  • the owner of the car has changed (or the policyholder himself has changed);
  • the term of car insurance has changed (the previous insurance is terminated, and then a new contract is concluded);
  • the insurance policy was lost, stolen or damaged;
  • The driver’s personal data has changed (change of last name, first name, patronymic).

How to avoid zeroing the KBM coefficient?

Another unpleasant consequence of the fact that the driver did not notify the insurance company about the replacement of the driver’s license is the reset of the bonus-malus coefficient. If the driver did not provide the insurer with information about his new driving license after changing his license before the expiration of the compulsory motor liability insurance policy, then when applying for new insurance, he may be credited with a new insurance coefficient.

That is, the bonus malus will be awarded to a new driver, and the old value will be reset to zero. Accordingly, the cost of the MTPL policy may increase.

What to do with insurance to try to save your KBM coefficient when replacing your license? When submitting an application to make changes to the insurance in connection with a change in the driver’s license number, you must also write a special request to preserve the previously accumulated bonus-malus coefficient.

In some companies, this can be done orally, but it is better to secure the request in writing. This way there will be a greater chance that this request will not be forgotten and all the necessary information about new rights will be promptly entered into the RSA database.

The KBM coefficient is maintained if all information about new rights and changes in other data is entered into the unified electronic database of the RSA in a due time. And only a representative of the insurance company can do this.
