Checking a person's administrative fines

How to find out about traffic police fines

Letter. The traffic police sends the driver a copy of the administrative violation resolution - this is a document with information about the fine and how to pay it. Such a letter does not always arrive. And if the motorist does not live at the place of registration, he will definitely miss the official notification.

At the traffic police department. This is what they did before - they came to the traffic police in person to find out their fines. To do this, you had to stand in line at the administrative practice department. With the advent of online services for checking fines, this no longer made sense.

Through the bank. Some banks notify customers about fines, but such a service must be configured first - saving car data in the Internet bank or application.

Using Internet services. The easiest way to find out fines online is to enter your car data on a service such as “Traffic Police Fines.”

Necessary data to find out traffic police fines for free

Driver's license number. The driver is stopped by an inspector on the road; if a violation occurs, he fills out a protocol and enters his driver’s license number into it. Such a fine will go into the database and will be linked there to the license number. To find out about such fines, the driver enters this number into the verification form.

STS number. The bulk of fines in Russia come from photo and video cameras. The camera records the violation and sends the material to the police. The inspector looks at the pictures and checks the data with information about the car owner in the database, after which he draws up a fine. Fines from cameras are tied to the STS number, so it is also important to enter this number on the form.

Resolution number (UIN). Each fine decision has this number at the top of the document. If the driver received a paper letter, he can find this number and pay a specific fine using it. But there is no need to receive and store a paper document: just enter the STS and license numbers into the form - the service will show all unpaid fines, they can be paid off immediately.

The required numbers are indicated in large print on the documents: on the STS on the front, on the license - on the back

How to check traffic police fines on a driver's license

Driver's license fines can be found on various websites that have access to the traffic police database. But there are nuances here. Using the driver's license number, the user will find only those requests for payment for traffic violations that were issued directly to him by the traffic police. That is, they had to issue a fine to the motorist manually and hand over a receipt. Data transmitted through street cameras will not be displayed. To do this, you will need to search for them not by ID, but by the vehicle registration certificate number. As in other situations, if a decision is detected, the motorist will be able to pay the fine immediately on the website.

What you need to know - when entering in the search field, you need to indicate not only the driver’s license number, but also its series. Otherwise, the system will generate an error.

Another advantage of using online services is that the user can subscribe to their newsletter. In this case, as soon as he receives a new fine, information about this will be sent to his phone via SMS message. This will allow him to avoid late payments on issued orders and not have to go into services once again to find out if there are any debts.

Why is it important to find out in time whether there are traffic fines?

To pay foreclosures at a discount. In the first 20 days from the moment the driver received a fine, he can pay it with a 50% discount. For example, the fine for exceeding the speed limit by 40 km/h during the grace period will not be 1000, but 500 rubles.

To prevent delays. It is important to pay the fine within the first 70 days from the date of the decision. Otherwise, the case will be transferred to the bailiffs, who will initiate proceedings and add an enforcement fee to the fine - at least 1,000 rubles. If the driver does not find out about the fine even after that, after another 70 days there will be a trial and the money will be debited from the account. There are other methods of forced collection: the debt can be deducted from the salary, the car can be seized, the license can be suspended, or the debtor cannot be allowed to go abroad.

To identify a duplicate car. Sometimes, when checking a fine, you may discover that it was issued by mistake. For example, the camera did not film your car, but someone else’s with an identical number plate - this happens. If you don’t know about the fine, you won’t be able to challenge it—the money will simply be written off from your account.

You need to know that not all fines are covered by this law. It does not apply to gross traffic violations: - violations while under the influence of alcohol and/or drugs (Article 12.8, Part 3 of Article 12.27, Article 12.26) - Repeated violations: speeding by 40 km/h (Parts 6 and 7 of Article 12.9), driving on a red light (Part 3 of Article 12.12), entering the oncoming lane (Part 5 of Article 12.15), driving towards one-way traffic (Part 3.1 of Article 12.16), errors in vehicle registration (Part 1.1 of Article 12.1) - accidents with victims (Article 12.24) . What are the consequences of failure to pay fines?

In case of failure to pay the fine within the period (see above) allotted for voluntary payment of fines, the case materials are transferred to the Bailiff Service and enforcement proceedings are initiated. In addition, at the same time, material for the trial is being formed. A new administrative proceeding may be initiated against a person who has not paid the fine and a fine of double the amount may be imposed.

How long does it take for traffic police fines to expire?

According to Art. 31.9. Code of Administrative Offenses of the Russian Federation:

A resolution on the imposition of an administrative penalty is not subject to execution if this resolution has not been enforced within 2 years from the date of its entry into force.

A decision in a case of an administrative offense comes into force after ten days, unless it has been appealed. Thus, the statute of limitations for traffic police fines is 2 years and 10 days from the date of the decision.

The traffic police fine was dated when I did not use the car. How can this be?

It is important to know the peculiarities of the functioning of the traffic police fine databases. In them, the fine is always tied to the date of the decision

. If a fine is imposed by a traffic police officer, then, as a rule, the decision is issued immediately, i.e. on the day of the traffic violation, although there are exceptions.

If you find a fine in the online database dated to a date when you were not using the car, then most likely we are talking about a previously committed offense recorded by photo and video cameras. Such fines have two features.

First: the date of recording the offense and the date of the decision, as a rule, differ for the period required by the traffic police to process the data received from the recording means. On average, this period is 1-3 days. For example, if a traffic violation actually occurred on July 1, then the fine decision will be dated July 2-4, and when searching in online databases, this exact date will be indicated - the date of the decision.

Second feature: in accordance with Article 2.6.1 of the Code of Administrative Offenses of the Russian Federation

, fines for violations recorded by automatic technical means are issued to the
vehicle registration certificate (VRC) number
.

Administrative liability for administrative offenses in the field of traffic and administrative offenses in the field of landscaping, provided for by the laws of the constituent entities of the Russian Federation, committed with the use of vehicles, if these administrative offenses are recorded by special technical means operating automatically, having photo and filming functions , video recording, or by means of photography, filming, video recording, the owners (owners) of vehicles are involved.

Thus, the decree is always issued to the owner of the vehicle, even if another person was driving. However, if it was not you but another driver who was driving, you can appeal the fine in accordance with the established procedure.

Part 2 of Article 2.6.1 of the Code of Administrative Offenses of the Russian Federation

The owner (possessor) of a vehicle is released from administrative liability if, during the consideration of a complaint against a decision in a case of an administrative offense made in accordance with Part 3 of Article 28.6 of this Code, the data contained in it is confirmed that at the time the administrative offense was recorded the vehicle was in the possession or use of another person or has now been removed from its possession as a result of unlawful actions of other persons.

Where do online services get data on traffic police fines?

The State Information System on State and Municipal Payments (GIS GMP) is the only source of information on fines for all online services for checking and paying traffic police fines. The development and maintenance of GIS GMP is carried out by the Federal Treasury of the Russian Federation.

You can check the list of organizations (banks) connected to the GIS GMP by following the link in the section “List of credit institutions that have provided connection to the GIS GMP”.

Not all online services work directly with GIS GMP. Often the data is provided to them by partner banks. This is an absolutely legal way of working.

However, there are fraudulent sites where you can supposedly check traffic police fines, but in fact the whole point of such services is to impose a paid SMS subscription. It is not difficult to distinguish fraudulent sites from legitimate ones. — Legal services do not require you to enter your mobile phone number to receive search results for fines. — On fraudulent sites, as a rule, you can enter any data as a search query and the appearance of a search in the database will be created. — All legal sites indicate where the data on fines comes from (GIS GMP or partner bank), and you can easily check the presence of this organization in the list of treasuries, see the link above.
