Riding a motorcycle without category A: types of equipment, details about categories and fines

What are the fines for riding a motorcycle?

The order of fines and the category of punishment are determined by the type of offense. Depending on this, in addition to a monetary penalty, the motorcycle owner may be limited in his driving privileges for a certain period, and the vehicle may be confiscated and sent to a penalty area.

In some cases, a resolution can be drawn up remotely (for example, when speeding is exceeded and this fact is recorded by CCTV cameras). In this case, notification of the fine will be sent by mail. You can also check traffic police fines using your driver’s license on the official portal.

What threatens a minor motorcycle driver?

A motorcycle driver under 18 years of age can legally operate it in two cases:

  • If the engine volume of his vehicle is less than 125 cm3. The driver himself must be 16 years old.
  • If he is studying for a category A license and drives under the patronage of an instructor at the race track. But the motorcyclist will receive the driving document only upon reaching the age of majority.

When a traffic police officer stops a teenager driving a bike with an engine capacity above 125 cm3, this is a violation of Article 12.7 of the Administrative Code:

  • If a minor operates a motorcycle without permission, he or his parents will have to pay a fine of 5,000 rubles. up to 15,000 rub. There is no question of the teenager driving further after drawing up the report. The motorcycle will be confiscated and sent to the impound lot.
  • If an adult owner of a vehicle entrusts the steering wheel to a minor, he will also pay a fine, but at 30,000 rubles. Request for payment from the driver of 5,000 - 15,000 rubles. while being preserved. And the owner of the motorcycle will also be charged a fine of 800 rubles. for violation of insurance conditions. After all, the name of a minor to whom he entrusted management cannot be included in the policy.

For driving without category A

Driving a motorcycle can only be carried out with a valid driving license of category A, A1 or M, in accordance with the type of bike. For riding a motorcycle without a license, the offender will face a fine. The amount of the penalty depends on the seriousness of the offense.

If the driver simply does not have a driver’s license with him, the state traffic inspector will issue a decree in the amount of 500 rubles. Moreover, in some cases, the inspector may limit himself to a verbal warning. And if in a short time someone can deliver a driver’s license, they will be able to completely avoid punishment.

If you don’t have a driver’s license at all, the offender will face serious punishment. For driving without category A, a driver who has never formally studied the theory and practice of driving will be fined 5-15 thousand rubles. Fine in the amount of 30 thousand rubles. or a 15-day arrest awaits a motorcycle owner who, for some reason, was deprived of his driver’s license, but got back behind the wheel of a motorcycle.

Other fines

Sometimes, when riding without a license, a motorcyclist may violate other rules. This happens infrequently, but one violation may well “emerge” from another. And the owner of the motorcycle may incur additional fines/punishments.

Without vehicle documents

Of course, there is a possibility that if a driver forgets to take his driver’s license with him, he will not have the documents for the motorcycle with him. Every driver must also have this type of document with him, and they are always requested during any inspection by a traffic police inspector.

Reference. For the lack of documents for a vehicle, its owner will suffer the punishment prescribed in the first part of Article 12.3 of the Code of Administrative Offenses of the Russian Federation, namely a fine of five hundred rubles.

But at the same time, there is a possibility that the inspector will simply limit himself to an oral warning, which is also provided for by this article of the Code of Administrative Offenses. Everything will depend on the current situation when stopping.

Without numbers

The motorcycle is subject to mandatory registration and assignment of a unique registration number. But there are drivers who don't want this. Some of them, taking advantage of the lack of a license plate, evade the recording of violations by video cameras, and even in the event of an accident, it will be much more difficult to find such a driver.

Villagers who use motorcycles often avoid registering their “iron horse”, because it is used for at most a couple of months in a whole year. However, such behavior patterns are very risky, because this serious moment can cause all sorts of troubles for an irresponsible driver.

If a motorcycle does not have a number, it means it is not registered. After purchasing a motorcycle or registering it at customs, the new owner is given ten days to register the vehicle with the traffic police and receive a registration number. After this period, for driving without license plates, a motorcyclist faces punishment under Part 2 of Article 12.2 of the Code of Administrative Offenses of the Russian Federation: a fine of five thousand rubles or deprivation of a driver’s license for a period of 1-3 months.

You can find out more about the fine you will have to pay for failure to register a motorcycle within the established time frame here.

For driving without license plates

Using a vehicle that is not equipped with a license plate is a serious offense, since in this case the vehicle cannot be identified. For riding a motorcycle without license plates, the offender is subject to a fine of 5 thousand rubles or a restriction of rights for a period of 1 to 3 months.

For unreadable (heavily dirty) or incorrectly assigned license plates, the owner of the bike will be fined 500 rubles or receive a warning.

Motorcyclists have the right to ride without license plates only for the first ten days after purchasing the vehicle. During this period, they must register and obtain license plates from the traffic police.

Sanctions for lack of rights to motor vehicles

It was already said in the introduction that the reasons for the lack of rights are different, therefore there are several legislative articles about this violation. There are several most common reasons for driving without a license:

  • license left at home - 500 rubles
  • no documents for the vehicle – 500 rubles;
  • there is no category - from 5 to 15 thousand rubles;
  • rights have never been formalized - from 5 to 15 thousand rubles;
  • no numbers – 5 thousand rubles;
  • was deprived of a certificate - up to 30 thousand rubles;
  • a minor is held accountable only in the absence of a certificate - 30 thousand rubles, which the parents are obliged to pay.

Documents forgotten or abandoned

The first and least-consequent case is forgotten documents. If, when checking the documents, the motorcyclist does not have a license, the traffic inspector will have to check the availability of rights using the databases. To do this, you will need a passport or identification of the driver. The verification may take from a few minutes to 3 hours. You will have to wait a long time if there is no passport and the motorcyclist is detained for identification.

At the end of the inspection, the traffic inspector will issue a fine of 500 rubles or issue a verbal warning. The chances of avoiding penalties will increase if, during the inspection, one of the driver’s friends brings him documents.

There are no rights at all

A more problematic situation is when a motorcyclist simply does not have a license or his license does not correspond to the required category. The second option occurs quite often, as category B drivers often believe that they can legally operate motorcycles. Unfortunately, this popular belief is completely false. Category B drivers can drive passenger cars, ATVs, mopeds and scooters, but not motorcycles.

For driving a motorcycle without the appropriate license, the driver will be required to pay a fine of 5 to 15 thousand rubles. The exact amount depends mainly on the mood of the inspector recording the violation, since there are no specific instructions for making a decision. At a minimum, therefore, when communicating with a police officer, you should behave politely and adequately.

Rights taken away due to violations

Now let's look at an even sadder situation. The largest fine (30,000 rubles) is imposed on motorcyclists who got behind the wheel after deprivation of their license. The punishment is so severe because drivers have already proven their inability to follow the rules. Your license can be confiscated for driving in oncoming traffic, repeatedly running red lights, driving under the influence and other serious violations.

But the worst thing is that instead of a fine, they may impose another punishment. The alternatives are forced labor or arrest. Those who cannot pay 30 thousand rubles will have to sit in a special detention center for up to 15 days or work from 100 to 200 free hours in community service.

Other violations

Speaking about driving without a license, we can recall other similar violations, for example, the lack of documents for a motorcycle or state registration numbers. In the first case, the fine will be the same as for not having a driver’s license with you - 500 rubles (instead of fines, you can also only receive a warning). But for the lack of numbers the punishment is much stricter - 5 thousand rubles. fine or 1-3 months of deprivation of rights.

Minors

If the motorcycle is driven by a minor citizen, then the question of having a license disappears. But another question arises: what responsibility will the child bear for his offense? In this case, there is no leniency for minors: the fine remains at the level of 5-15 thousand. However, of course, parents will have to pay it.

For driving underage

In accordance with the Federal Law “On Road Safety”, the earliest age at which a person can obtain the right to drive a vehicle is 16 years old. In this case, we are talking about category M licenses, which give the right to drive scooters and mopeds.

You can start studying theory and practice in driving courses as early as adolescence, but a minor will not be able to obtain a license - a fine will be issued for riding a motorcycle before the specified age. Moreover, since the young offender has not reached the age of majority, it will not be he himself who will be fined, but the person who handed over the vehicle into his hands, namely the owner of the motorcycle. The fine is quite impressive and amounts to 30 thousand rubles.

Riding without a helmet

An important attribute of a motorcyclist is a helmet. It provides protection and reduces the risk of injury in an accident. Its presence is mandatory in accordance with paragraph 2.1.2 of the Traffic Regulations:

The driver of a manual vehicle is obliged, when driving a vehicle equipped with seat belts, to be fastened and not to carry passengers who are not wearing seat belts. When driving a motorcycle, wear a fastened motorcycle helmet and do not carry passengers without a fastened motorcycle helmet.

And the lack of protection on the bike driver is regulated by Article 12.6 of the Code of Administrative Offences:

Driving a vehicle by a driver who is not wearing a seat belt, transporting passengers not wearing seat belts if the design of the vehicle provides for seat belts, as well as driving a motorcycle or moped or transporting passengers on a motorcycle without motorcycle helmets or wearing unfastened motorcycle helmets shall entail the imposition of... a fine in the amount of one thousand rubles .

Punishment will follow not only for the lack of protection on the driver, but also if it is not on the passenger. An important point is that the helmet must not only be put on the head, but also fastened correctly. A dangling harness is a reason to fine a motorcyclist 1,000 rubles. The helmet must also match the size of your head.

Which motorcycles do not require a license?

Currently, to drive these vehicles you need a category A license. You can get them upon reaching the age of majority, in Russia this is 18 years. A license of category A1, which allows you to drive two-wheeled vehicles V up to 125 cm3, as well as a license of category M, which allows you to drive scooters and mopeds, can be obtained 2 years earlier - already at the age of 16.

In what cases are rights not required?

Driving a motorcycle, like any other vehicle, without a license is considered a gross violation. There are no exceptions to this in the law.

Today even scooters are classified as "M". In order to receive it, the vehicle owner will need to undergo training.

If earlier traffic inspectors did not pay much attention to owners of low-power vehicles, now they are closely monitored.

When you don't need it on a motorcycle

But violations only apply to movement on public roads. Without a license, you are allowed to ride a motorcycle and in forest clearings. But it is worth considering the fact that if an unpleasant incident occurs, even off the road, the owner of the vehicle will be responsible for it.

There is one clause in the law according to which it is still possible to ride a motorcycle without a license. It is necessary that the road along which travel is carried out does not provide for general use.

So, riding a bike without a license is allowed according to:

  1. Autodromes and training grounds;
  2. Technological paths of companies;
  3. Private areas that are closed;
  4. Dirt paths that people themselves have built.

The fact is that in these cases the probability of meeting a traffic police inspector is very low.

Cross

Cross bikes are a special type of two-wheeled equipment designed for motocross. Such motorcycles are not equipped with lighting equipment, and the special rubber does not provide sufficient grip on the road surface.

Cross bikes are the only two-wheeled vehicles that can be driven without a license. But taking into account the specifics of the vehicle, it is prohibited to use it on public roads. You can get a fine for riding such a motorcycle. Motocross bikes must be delivered to the tracks by special transport.

Is it possible to avoid responsibility?

Some particularly cunning motorcyclists claim that they have been riding without a license for many years. You should not try to repeat their achievements, as this is fraught with serious consequences. If the vehicle does not also have a license plate, this will entail an additional fine of 5 thousand rubles.

When is a motorcycle license not required?

And if the vehicle has never been registered in the country, and its owner does not have ownership rights to it, then it may also be confiscated. And the owner of the confiscated bike will face criminal penalties.

Fearless bike owners advise their colleagues to simply take off their helmet to avoid being harassed by traffic police officers. In fact, traffic police officers do not have the right to pursue a person who is moving without special equipment. Because in the event of an accident, they will be responsible for the damage he receives. But without a helmet, the biker will only be able to travel a few kilometers to the next traffic police post, where he can be stopped.

Some people believe that minors are not punished with all severity for driving a motorcycle without a license. However, after the driver’s identity is established, his parents will receive a fine of 2.5 to 5 thousand rubles. If a child is seriously injured while driving a motorcycle, his parents may lose their parental rights.

Driving a motorcycle without a license poses a danger not only to the driver himself, but also to the people around him. Every owner of a two-wheeled vehicle must understand this and be aware of their responsibility.

Not just money

But the possible measures to prevent repeated violations do not end there. It has already been said that if you have been deprived of your driver’s license and you decide to drive or ride a motorcycle, you will have to pay a large fine. But under such circumstances, it is possible to answer differently under the law for the committed act.

For example, according to modern legislation, you have every right to be arrested for a crime. And for a long period - 15 days maximum. Not a very pleasant event, is it? Additionally, your vehicle will most likely be confiscated.

An alternative punishment for such a violation of the rules is compulsory labor. Their duration varies, but by law it cannot be less than 100 or more than 200 hours. Please take this into account. As you can see, there is not only a fine for driving without a license. A car, motorcycle, bus and most other vehicles will require a driver's license. In the absence of this, you will have to put up with certain penalties.
