  • if the detour involves hitting the trunk line;
  • if the detour involves going into the left lane, and the highway contains only three lanes;
  • if a detour involves driving in the opposite direction in front of the railway tracks (regardless of the number of lanes of the highway).

Conversely, an object is allowed to be bypassed if:

  1. Detour means entering the turning lane.
  2. If the detour does not imply the exit of traffic into oncoming traffic.

If the driver had a way to pass the car on the left, but he went around on the right, this is considered a serious violation, especially if such behavior on the road is recorded on video.

If the violation occurs again and the camera records it again, the fine for hitting a road will be 5,000 rubles.

There are other cases in which it is prohibited to overtake vehicles:

  • if the driver tries to get ahead of a car that is going around an obstacle (creating an emergency situation on the road);
  • if a slow car has indicated with its turning lights that it plans to make a left turn;
  • if the driver tries to get ahead of a vehicle at a time when another car is ahead of him;
  • if the driver, having completed the detour of the car, is not able to return to the same lane;
  • If traffic occurs in an underground tunnel, overtaking is prohibited regardless of the situation.

Each driver, one way or another, was forced to attend a driving school, where they talked a lot about what you can do on the road and what you absolutely cannot do. Moreover, in order to develop driving discipline among future drivers, teachers talked much more about prohibitions than about what was allowed. This methodology of “educating” competent drivers is reflected even in exam questions, where the main point is to make the right decision - “is it prohibited?..”.

That is why, having become drivers, we see every day how traffic rules are unceremoniously violated, it catches our eye, cars try to cross the oncoming lane and overtake at any cost. That is why, you should always remember that overtaking is a dangerous maneuver, and SL is not just a marking, but a line, having stepped over which many have chosen the tragic path of development of their lives.

According to the Administrative Code, an important role is played not only by correctly setting the amount of the fine itself, but also by regulating the timing of its payment. Article 32.2. states that for violating traffic rules the driver must pay a fine within 2 months from the date of notification.

Failure to pay a fine for violating traffic rules means another administrative violation - deliberate evasion of fines.

In such cases, the measures taken are as follows:

  1. Assigning a citizen to undergo compulsory correctional labor for up to 50 hours.
  2. Double fine, but the total amount must be more than 1000 rubles.
  3. Arrest for no more than 15 days.

Therefore, simple evasion from paying fines may not only not be an expression of one’s disagreement with the inspector’s decision, but also contribute to aggravating the punishment.

How to challenge a solid claim in court

Often the driver has to prove his position in court, independently resist bureaucracy in order to maintain his driving license or challenge a fine. This will require a lot of effort and emotions, time and knowledge, because the presumption of innocence does not work in this case; the traffic police officer is believed a priori.

The driver goes to court with hope:

  • reclassify the article to a lighter option, when it is not supposed to be the withdrawal of rights, but a fine;
  • prove that the collision with a solid road was unintentional, or it did not happen at all.

To challenge a case in court, you must:

  • seek the services of an auto lawyer, if your knowledge base is not enough, the lawyer will control all the timing, form and essence of filing applications, petitions, appeals;
  • analyze the traffic pattern of this place, take into account conditions, signs, markings and their condition;
  • make inquiries, if necessary, whether markings are applied and signs are installed in accordance with GOST;
  • correctly and competently compose a defense speech, taking into account all the details of what happened;
  • invite witnesses, show photos and videos that will confirm the driver’s words;
  • note all the inaccuracies in the words of the inspector and the protocol.

Naturally, when a driver goes to court to prove his innocence, he must, firstly, be well versed in traffic rules and road situations, and secondly, be absolutely sure that he did not violate the clause that he is charged with.

Penalty for crossing a double solid line

  • on bridges and inside tunnels;
  • in conditions of poor (limited) visibility;

  • at the crossroads;
  • if there are obstacles to traffic in the form of cars maneuvering in front of your car;
  • when it will be impossible to return to your lane (this also applies to the dividing strip - it is easy to lose your license in such a situation, because you will not be able to miss a traffic police patrol car driving along this lane behind you).
  • do not sign the resolution and do not pick up the payment receipt;
  • ask for a protocol to be drawn up and carefully monitor its completion;
  • write down the patrolman's badge number, rank, car number, full name;
  • It is always useful to record the circumstances with a DVR.

Markup functions

Despite the fact that every driver almost all the time encounters road markings on the roadway, unfortunately, not everyone understands what they mean. For example, many drivers do not know that the broken line comes in several types, namely, with the same short lines and with gradually lengthening ones. In the first situation it is 1.5, and in the second it is 1.6, it warns of the imminent appearance of a “solid” one.

Although many drivers either do not attach importance to this, or believe that road services accidentally or inadvertently draw uneven marking lines, not realizing that this is a completely different type of stripe that carries a certain meaning.

And this is not an isolated case. It gets to the point that some drivers seriously claim that the fine for crossing a double solid line marking is twice as high as for violating a single solid line. Which, of course, is not true.

However, each type of road marking has its own specific functions. They are associated, as a rule, with a prohibition or permission to perform any actions or maneuvers, for example, overtaking, turning, turning around, changing lanes, stopping.

Fines and sanctions for crossing a continuous strip of road markings according to traffic rules for 2021

The intersection of a solid marking line is recorded automatically by photo and video cameras. The practice of using these means to monitor compliance with traffic rules on the road was introduced in 2021. We are talking about the following types of fixation.

  1. Single is designed to divide the roadway into two parts, where movement occurs in opposite directions. Apply using yellow or white paint.
  2. The double serves the same purpose, but there will be multiple lanes in each direction on the right and left sides. White or yellow paint is also used to apply it.
  3. Temporary solid paint is applied in orange while the road surface is being repaired.
  4. Permanent is applied in yellow or white.

Types of fine

The specific type of violation determines the degree of administrative liability for the driver. The cases considered are shown in the table:

According to Russian legislation, a traffic police officer does not have the right to confiscate driving licenses at the scene of an offense: the car owner himself must hand them over when the appropriate court decision is made.

If the driver has committed an offense of crossing double markings in the same direction for the first time, he will only be charged with a fine.

An unambiguous deprivation of rights is applied in the event of an additional trip into oncoming traffic during the maneuver. A second similar offense within a year will result in loss of driving privileges for 12 months.

An offense can be detected using 2 options:

  • Application of technical equipment: photo/video recording. In this case, the driver may not be aware of the recorded traffic violation. A receipt for payment of the fine and a notice will be sent to him by mail. The maximum penalty (deprivation of rights) is not imposed in such a situation.
  • Traffic police officer. The violation is recorded in the protocol by a law enforcement officer. The payment receipt indicates the amount of the fine and is given to the driver on the spot.

The driver has 10 days to appeal the penalty immediately after it is issued. This is only possible upon presentation of evidence of legal crossing of the double line.

When turning left, crossed a continuous line or drove into oncoming traffic - deprivation or fine

What then remains? Is there a continuous fine for crossing? Not at all. Since, according to GOST, markings cannot be applied in this way, it is natural that there is no provision for attracting a driver to a fine here.

Crossing a solid line, including a double line, does not always result in a traffic violation.
