What happens if you don’t pay traffic police fines for cameras is a fairly common question among car owners. The answer to it is tritely simple - the appropriate punishment will come. When authorized persons receive facts from registrars about committed offenses, they send the violator a decision to prosecute on legal grounds.

However, drivers are in no hurry to be held accountable for their actions and avoid fulfilling their obligations. Missing the period for reimbursing a fine will result in the individual being subject to a more severe penalty than a fine.

According to the provisions of Article 32.2 of the Code of Administrative Offenses of the Russian Federation, the total period for eliminating a certain fine is 60 days.   • camera modifications;
  • the established distance from the camera to the nearest information processing center;
  • population of a particular settlement;
  • general load on technical means of information processing and on employees.

Taking into account the above factors, the publication of information about fines in the traffic police may require the following deadlines:

  • For urban settlements with a small population – 10 days;
  • For cities classified as megacities - within one working week;
  • The longest time limits for registering a fine from a video camera are observed for residents of rural areas.

Important! There may be a delay in fine notifications due to post office operations. In this case, the notification may arrive within a month.

Penalties for non-payment of fines

If the culprit fails to fulfill monetary obligations, he may be subject to liability measures set out in Art. 20.25 of the Administrative Code, namely:
  • a fine not paid on time is subject to a new taxation of double the amount. This means that the violator will have to pay the initial amount, and subsequently double it. That is, triple punishment occurs;
  • imprisonment for no more than 15 days. Almost never used;
  • assignment of any public works. In case of malicious evasion of payments, this is the measure most often chosen to suppress illegal behavior.

  3. Prohibit or limit the prerogative to dispose of property during the period of non-payment of debt.
  4. Confiscate the owned car, as well as other property to cover the debt.

Possible restrictions

In 2021, the operating norms of federal legislation establish the possibility of restricting the management of any vehicle if the total debt is more than 10 thousand rubles. If the fine arrived late, can it be appealed and how?

As of 2021, the period for appealing fines in accordance with the first part of Article 30.3 of the Code of Administrative Offenses of the Russian Federation reaches 10 days. However, the countdown of this period begins from the day the addressee receives a copy of the resolution (the first part of Article 4.8 of the Code of Administrative Offenses of the Russian Federation). Therefore, in this case there is no problem with lengthy mail forwarding.

How to avoid paying fines

Internet users can recommend many options on how to avoid liability for a traffic fine. However, almost all will be considered illegal and may result in more serious penalties later. The most legal way of non-payment is the expiration of the statute of limitations for the execution of a court decision.

So, according to Art. 31.9 of the Code of Administrative Offenses of the Russian Federation, the payment period is no more than 2 years from the date of the judge’s conclusion. If at this time compensation has not been paid, then the punishment ceases to apply.

ATTENTION !!! There is always the possibility of a situation arising when a conclusion cannot be made for the following objective reasons.

These factors include:
  1. The meeting did not take place within 3 months from the time the offense was committed. It is no longer possible to collect the fine.
  1. The fact of the act was recorded by a surveillance camera, but a decision on the case was not made within 2 months. A fine cannot be applied.

Cases when fines do not expire

  1. Unlawful behavior on the roads entails sanctions for the offense in the form of a monetary penalty, which must be paid. If this action is not taken, the car owner may be subject to forced execution of the decision. This means that upon expiration of the payment period, that is, after sixty days, the right to collect funds is transferred to the bailiffs. Their main activity is to obtain from the offender full payment of the debt to the state. With this course of action, the two-year limitation period is no longer justified. For the FSSP, such a concept as the expiration of an administrative penalty does not exist. Thus, it is executed by the bailiffs until it is paid.
  2. In addition to all this, a fine that is not paid within two months is considered unpaid. According to Article 20.25 of the Code of Administrative Offenses, the driver has the right to bring another administrative liability. This resolution is the imposition of sanctions for an offense in the form of an amount twice the previously unpaid debt, or arrest for up to fifteen days.
  3. The fine is not considered valid if the car owner deliberately evades paying it. However, it is not at all easy for the authorities to confirm this fact. The main criterion for such evidence will be confirmation that the offender does not actually live at the address that is his permanent place of registration and, accordingly, does not receive notice of the administrative penalty.
  4. Also, a decision on an offense does not expire if it was issued to a person who has been deprived of a driver’s license. Administrative sanctions in this case do not have a statute of limitations. In order to regain the right to drive a vehicle, the driver will first have to pay all the fines he owes.

What to do if you don’t agree with the punishment

Many problems are caused by real video camera errors, which subsequently lead to fines being imposed on innocent persons. Each individual who receives a letter of violation has the prerogative to appeal the decision within 10 days. The message contains direct photographs confirming the fact that the act was committed.

When considering the case materials, you should pay attention to:
  • compliance with road markings;
  • designation of car numbers (not the fact that it is the owner’s car that is recorded);
  • specified speed.

It is possible to prove innocence only in a situation of obvious error (for example, a car owner in the capital was charged with a fine for driving into the oncoming lane. He managed to present evidence that only the shadow of the car was caught).

IMPORTANT !!! If the decision made is illegal, then you should contact the traffic police, already preparing to defend the violated interests in court. It is only possible for those who did not commit the act to hope for the resolution to be repealed. If the violation nevertheless occurred through your fault, then it is better to quickly pay the fine while the 50% discount is valid for 20 days.

After what period does a fine appear in the database?

All issued fines must be displayed in a special database of the traffic police service, but they do not get there instantly.

Article 29.6 of the Code of Administrative Offenses of the Russian Federation states that for consideration of the case of admin. For traffic violations detected by cameras, the relevant authorities are given 15 working days.

Must be considered:

  1. Video for the period when the offense was committed.
  2. Photos of the moment of the offense itself.
  3. Protocols proving the fact of recording the offense.

Is it possible not to pay a fine if you do not sign the mail notification?

Many motorists mistakenly believe that if they received a fine letter in their name, for which they did not sign and receive it, or even pretended that they knew nothing, then the collection period will expire and they will not have to pay anything. However, in reality everything is far from the case.

IMPORTANT !!! If the letter does not find a recipient, then after 30 days the postal workers send it to the sender. From the period of such return, the period without an authorized payment period of 70 days begins to expire. That is, non-receipt actually somewhat delays the moment of payment, but does not free you from it.

Cases of loss of a notice or letter cannot be excluded. But even under such circumstances, no one is exempt from responsibility. Back in 2021, the traffic police website system was updated, and now it has become much easier to find out about fines received for speeding or other traffic violations. Immediately after the traffic police decided to fine the driver for violating traffic rules and issued a decision, the fine appears in the system. That is, on the day of a possible violation, you should not check all available applications and sites in search of sanctions.

Information is not stored in the database forever. They have a statute of limitations; after its completion, all sanctions are written off. For such administrative violations it is two years. According to the Code of Administrative Offenses and its Article 31.5, such sanctions must be lifted, so with the next update of the database they will simply disappear. But if the driver was hiding part of the time, then this period is subtracted from the date of the violation. A registered letter can arrive even after a month, and on the website of the traffic police or similar services the presence of a fine can be checked within a few days after the violation.

Note! In any case, a registered letter is sent to the offender at his last place of registration. If the sender received a letter back from there, then the countdown for the violator begins from the moment of return. He has 10 days to appeal, 20 to pay with a 50% discount, 60 to simply pay for recording his violation. If the driver has not received the letter, then this is not a reason not to pay the penalties.

On State Services and through applications

To find out about the presence of penalties as quickly as possible, you need to register on the State Services website and enter the details of your vehicle. The site's databases are constantly updated, so you can find out that a fine has been imposed immediately after a ruling or decision has been made. After authorization on the service, you should go to the “Ministry of Internal Affairs of the Russian Federation” section, then “Providing information”.
