The traffic rules provide for overtaking across a continuous road, a fine for performing such a maneuver, or, as an alternative, deprivation of the ability to drive a vehicle. The driver must be aware of this violation.

Such a violation has its own nuances; the rules indicate situations when travel is not prohibited according to this principle. But in general, such a maneuver is considered solely as potentially dangerous. And such a trip is especially fraught with problems where several categorical points of the rules “intersect” on one section of the road.

Under what conditions is crossing a continuous line considered / not considered a violation?

The explanations are quite simple: maneuvering on this section of the road is not always regarded as a direct violation. In what situations can you drive into oncoming traffic?

  • Narrow road surface. If it is not wide enough, and the markings are not visible or absent altogether, as well as the “no overtaking” sign, then the driver will avoid monetary penalties when overtaking.
  • Broken marking lines. The traffic rules state that the line is allowed to be crossed only at the points where it is interrupted. If the maneuver is performed on another section of the road where the line is not interrupted, this is a prerequisite for the creation of emergency situations that threaten the vehicle owner with deprivation of his rights.
  • A sudden obstacle blocking the path . The case is considered in a situation where a vehicle or other obstacle has blocked the possibility of driving in a single lane. The rules state that you need to go around it on the left side, and first give way to other cars - the traffic police inspector does not punish you for this. But if the driver could go around the obstacle on the other side and did not take advantage of this opportunity, since this maneuver would have taken him more time, then there will be a fine, according to Part 2 of Art. 12.15.
  • A situation where you need to leave the yard, make a U-turn, to the left. When crossing one continuous line and making a U-turn out of the yard, essentially no action is taken on the oncoming lane. But at the same time, the continuous line itself still intersects. The inspector has the right to issue a penalty, but does not have the right to deprive the driver’s license.

Penalties for illegally driving through continuous lines according to the law

Administrative sanctions for incorrectly driving on a continuous road in violation of traffic rules, as well as for other incorrect actions of motorists, are determined by the provisions of the Code of Administrative Offenses of the Russian Federation.

The amount of the fine for changing lanes through a complete ban or the duration of the driving ban depends on the number of offenses committed and the severity of the consequences of a possible accident.

The following measures are provided:

  • when driving beyond a solid marking line in the same direction;
  • when leaving the yard space through a continuous road.

The choice between an oral reprimand or a fine in the prescribed amount remains with the traffic police inspector, who takes into account the degree of danger of the consequences.

For crossing a solid marking line, administrative sanctions are imposed on the driver.

A receipt with a fine of one to one and a half thousand rubles is issued to the violator if:

  • U-turns or left turns;
  • avoiding obstacles followed by a U-turn;
  • changes at road intersections. In addition to crossing a solid line, the violator will be additionally punished for performing a maneuver in an unauthorized place - at an intersection;
  • incorrect changes.

A five thousand fine for violations or confiscation of a driver’s license is based on:

  • for driving into oncoming traffic, including tram tracks (without revocation of rights);
  • in case of overtaking, even if the maneuver began in the same direction as the other car, away from the broken line - both of the listed measures of influence;

Why are they deprived of rights?

As you can see, the punishments are the same in almost everything, and depending on the severity of the consequences, crossing a single line can be even more severely punished than a double one. But why can you be deprived of your right to drive a car?

Provided that you have no other violations or fines, you can be deprived of your driver's license only because of overtaking. Moreover, the period of deprivation of rights for crossing two continuous lines is the same as for one - from four months to six months. In case of repeated violation, the period of deprivation of the driver's license is not less than one year. It is also worth considering that all periods of deprivation of rights are summed up, so with several violations you can lose your license for a much longer period.

However, they cannot deprive you of your rights for more than three years, no matter how many fines you have. But it’s not worth the risk, because for serious violations you may have problems with re-obtaining a certificate. Then you cannot do without an experienced lawyer, which will entail extra costs. What is the penalty for crossing a solid line?

The rules prescribe a number of prohibited overtaking maneuvers, when traffic police officers are 100% likely to deprive the driver of the right to drive a vehicle.

Provided that a slow-moving vehicle is driving in front of the car, which equates to, for example, a horse-drawn cart, tractors, asphalt pavers, you will have to drive at low speed to the section of the road where overtaking is allowed.

What is the penalty for crossing a solid line?:

  • Overtaking in the oncoming lane through a solid lane means deprivation of a driver's license for up to 4 months , but instead they may impose a fine of 5,000 rubles (Fig. p. 1).
  • an identical offense is repeated , the driver’s license will be deprived for 12 months; if the repeated violation is recorded by photo and video recording, the fine will be 5,000 rubles .
  • Turning left across a solid or double solid line - a fine of 1000 - 1500 rubles . Since it is regarded as driving in the oncoming lane, creating inconvenience for other participants in the flow and leading to emergency situations on the roads (Fig. p. 5).
  • Turning across a solid marking line while exiting and driving in the oncoming lane means deprivation of a driver’s license for 4-6 months (Fig. p.2).
  • Overtaking a slow-moving vehicle through a continuous lane - If the vehicle is considered a slow-moving vehicle according to the manufacturer's passport and it is moving in a lane below 30 km/h. without a posted “Slow-moving” sign and the driver is overtaking through a solid road - at this moment there is no violation of the place. If the vehicle is moving in the lane at a speed below 30 km/h. but according to the manufacturer’s passport it is not considered a slow-moving vehicle, then liability for overtaking a slow-moving vehicle is provided in the form of deprivation of rights for 4-6 months (Fig. p. 3).

  • Completing overtaking through a solid line is a fine of 1,500 rubles. This fine is issued provided that the markings and installed signs on the road comply with GOST and not for overtaking through a solid marking line, since you did not cross it, but were already moving in the oncoming lane and you need to return to your lane, and the fine is issued for violation of the location of the vehicle .

However, there is a nuance - a photo of a camera recording the intersection of a solid marking line in automatic mode, that is, overtaking across a solid line is not grounds for deprivation of a driver’s license, but involves the imposition of the maximum possible fine.

Despite the fact that even hitting one of the indicated markings with one wheel already violates the rules, deprivation of rights for crossing a solid line or a fine does not always result. The point is that there are different variations on how you can cross a solid line. The type of intersection, location and situations are taken into account. Next, we will analyze the types of violations and possible exceptions in order of increasing importance:

  • Intersection of a passing continuous road. The most insignificant, from the point of view of sanctions, violation. There are no exceptions.
  • When leaving the yard. A fairly common violation due to the desire to save time. Very often, in courtyard areas there are continuous markings that cannot be crossed. Driving is only allowed when turning to the right. The same situation occurs when exiting a secondary road onto the main one. In this case, there must also be a “Right Turn” sign. If there is no sign and the markings are of poor quality, this is a good reason to challenge the charge.
  • Turn left or turn around. This action through a solid line is illegal. Even if there is a turn, this does not always mean that you can turn there without breaking the rules. But the violation is not so serious as to deprive the driving license for this, even for a U-turn.
  • Avoiding obstacles. The case is not a violation if you drive around an obstacle (a broken down car, an emergency section of the highway, road works, etc.) through the marking line due to the lack of opportunity to pass it on the right. It is also not a violation to drive around oncoming traffic, provided there is an appropriate sign. If there is no sign, and the obstacle can be driven around on the right, the consequences of crossing the markings can be serious, including deprivation of your license. Remember that traffic jams are not an obstacle, and if you avoid traffic while crossing the lane, you will also be punished.
  • Overtaking. The most serious offense, threatening a serious fine or deprivation of rights. It's not even a matter of overtaking, but of driving in the oncoming lane. Since the markings are continuous, oncoming drivers do not expect to see an obstacle in their path, which can lead to a serious accident. The situation may be aggravated by traffic on tram tracks. But there are mitigating circumstances - if you started overtaking in a section with intermittent markings, and end it by crossing a continuous one.

To understand what is a violation when crossing an already double solid line, you need to remember what it is. If you don’t burden yourself with complex terminology, double solid is the same marking element as single, only for a larger number of stripes (from four). Undoubtedly, crossing it is an equally serious offense. The rules and violations are identical to the single line, and the punishment for crossing a double solid line is almost the same.

You will not lose your license because you were “caught” by such a camera. But you will receive the maximum fine, even if you simply drove around an obstacle. The fact is that the camera cannot discern the reason for your violation, so it imposes the maximum fine. But not everything is so bad - within ten days you can appeal the fine, thereby reducing it. Just don’t challenge the penalty for overtaking - you’ll only make things worse.

Article 2.7 of the Code of Administrative Offenses of the Russian Federation provides for crossing the line of a double lane marking only when absolutely necessary. There are situations in which crossing a double solid line is not punishable by an administrative fine or deprivation of rights. Extreme necessity is considered as a violation if this harm helped prevent a more significant, widespread harm and eliminate the danger. In this case, danger may threaten the driver or other persons, as well as state interests.

Refer to Art. 2.7 is possible when hitting or crossing a solid marking line was carried out in order to prevent a collision or impact with another car or other vehicle. For example, such actions are quite common on a narrowing section of road or bridge.

What mistakes do drivers most often make when maneuvering on a double solid road?

According to the rules, overtaking in oncoming traffic in any situation is punishable by deprivation of rights under Part 4 of Art. 12.15 Code of Administrative Offences. Moreover, you can lose them for up to 6 months. Even overtaking a tractor traveling at minimum speed will not relieve the overtaking person from responsibility. Although the tractor driver is ordered to pull over to the side of the road, thereby giving way to other road users, this still will not protect the overtaker from fair punishment. This will be regarded as an offense, although car enthusiasts like to experiment and often perform such maneuvers, perceiving them as acceptable.

Violation caused by negligence of road services

In some situations, the driver’s behavior on the road depends on the correct performance of their duties by special service employees.
In a specific situation - from applying road markings. This process is regulated by strict GOSTs, if there are prerequisites, then there is a chance to win a legal dispute with representatives of the traffic police due to incorrect markings. Broken horizontal markings serve as a warning that the line will soon become continuous and overtaking will be prohibited. Based on the rules, a specific sign must be placed in front of the solid ones - a broken line, the strokes of which are three times longer than the space between them.

If there is nothing like this on the road surface, then this is a clear violation of GOST standards. And then the crime remains in question, since the fault lies not only with the driver. But provided the markings are according to all standards, the owner of the vehicle is solely to blame.

That is, drawing solid lines is prohibited immediately after standard broken lines, since the driver does not have time to navigate the situation on the road.
