Stop sign in front of a railroad crossing

What is the mark for?

First of all, we should consider the basic definitions. There are drivers who do not even know what a stop line is. As a rule, these are motorists who have little understanding of modern road markings.

How is it designated?

A stop line is a strip drawn on the road surface at a certain distance from the crossing. Sometimes it is presented in the form of a “STOP” sign, which is placed at the place where the driver needs to stop to allow pedestrians to pass. In addition, the purpose of the mark is to protect the car from collision with other vehicles when crossing an intersection.

Stop line and stop in front of it
In general, the stop line is designed to create comfortable conditions for movement and eliminate emergency situations. It is important to note that the presence of a line is not always a reason to stop.

It is important to know! If the light is green or there are no pedestrians or other drivers crossing the intersection, then the vehicle may not stand in front of the line. The exception is if there is a “STOP” road sign indicating the need to stop driving.

Moving rules

To prevent a fine for driving beyond the stop line, you should figure out how to properly cross this area. The traffic rules contain provisions regarding this process.

Basic Rules:

  • Stopping the vehicle is allowed only in front of the mark, and not behind it;
  • If there is no line, you must stop moving 5 m from the zebra;
  • At signalized intersections, crossing is allowed only at the corresponding traffic light signal;
  • Before driving, you need to make sure that there are no pedestrians on the path, and there are no cars driving in a perpendicular direction on the turns.

It is important to know! If the intersection is not regulated, then you can cross the mark if there is no danger. This is especially true for railway crossings. It is important to observe the speed limit and carefully look around to prevent collisions.

What is the fine for a STOP sign in 2021?

On roads with heavy traffic of trains and vehicles, there is a chance of falling into a trap and getting a fine for driving through a crossing at a prohibitory signal. How it works?

As you know, there is no warning signal at the traffic light at the railway crossing. And in heavy traffic, the red light may turn on when your car has already crossed the visibility zone of the traffic light. Traffic lights work synchronously.

On the opposite side of the crossing, an accident patrol with photo recording is located and takes pictures of the car entering the crossing and the red signal from the oncoming direction. The camera angle is set in such a way that it is not visible whether there is a car before or after the traffic light. From which it is concluded that the passage was carried out in response to a prohibitory signal.

The violation can be detected by a traffic police inspector or recorded automatically during filming from a camera. In the first situation, the person will be stopped, informed of the reason for the action and prepared a protocol on the imposition of a fine for crossing the stop line in front of a traffic light. Then the offender will be released. A resolution will be sent to the citizen’s mail with a requirement to pay off the fine for crossing the stop line.

If the violation is recorded on camera, the driver will not be stopped. However, he will subsequently receive a resolution demanding a monetary penalty for crossing the stop line in front of a traffic light.

A stop sign (number 2.5) and a stop line indicate that the driver must slow down to:

  • allow pedestrians to pass if the markings are located at a pedestrian crossing or traffic light;
  • miss a train;
  • make sure it is safe to drive straight and that there are no cars moving along the perpendicular road.

The main functionality is to warn drivers that they need to stop at this place.

This sign must be located:

  • at crossroads;
  • near railway crossings;
  • at the exit to the main road;
  • in front of the traffic light.

In front of a stationary sign, special markings are often applied to the road surface and additional signs are placed warning that there is a STOP sign ahead.

The red symbol at the crossing means that you need to make a complete stop and allow the approaching train to pass, if it is in the field of view of the one driving.

This symbol is a priority and is installed in accordance with GOST R 52289–2004 to regulate the movement of vehicles at complex intersections in populated areas and on highways between cities.

The sign states that driving on this section of the road without stopping is prohibited.

According to traffic rules, the sign can be located on the right side of the road or hang above the part where the stop line is located. The driver must comply with the following rules:

  • when the markings are not visible, you need to stop at the sign;
  • when the traffic light permitting signal is on, you don’t have to stop on a difficult section;
  • It is prohibited to drive into a stop line; this is a violation of traffic rules, for which you can receive a penalty.

Passing a railway crossing at a red light, even if the train has already passed or the barrier has just begun to rise, is prohibited (Article 15.3 of the Russian Traffic Regulations).

For a violation that does not entail serious consequences, depending on the degree of danger of the maneuver for others, a

For a repeated violation, when 12 months have not passed since the first violation -

Stopping at a railway crossing is prohibited (Article 12.4. Traffic rules of the Russian Federation). As well as parking closer than 50 m from railway crossings (Article 12.5. Traffic rules of the Russian Federation). You also cannot go to a railway crossing when there is a traffic jam behind it, due to which you will have to stop at the crossing (Article 15.3. Traffic rules of the Russian Federation). The punishment is

For repeated failure to comply with the rules, you can lose your license for 1 year (Article 12.10 Part 3 of the Administrative Code of the Russian Federation).

If you are forced to stop as a result of force majeure, for example, a breakdown of your car or the one in front, be sure to act correctly (Article 15.5 of the Russian Traffic Regulations):

  • disembark passengers;
  • take possible measures to clear the tracks;
  • if possible, send people along the tracks 1000 m in both directions from the crossing to give a stop signal to the train driver;
  • stay by the vehicle and sound a general alarm (a series of 1 long and 3 short beeps);
  • when a train appears, give a stop signal: a circular movement of the hands (with a noticeable object or flashlight).

Overtaking is when the driver moves ahead of other vehicles, usually with an increase in speed, in the oncoming lane and then returns to the previous lane. A detour involves a maneuver with a change of lane, provided that the lane along which the driver was moving is blocked by something.

At railway crossings and closer than 100 meters in front of them, overtaking is prohibited (Article 11.4 of the Traffic Regulations). Detour is also prohibited. But in terms of punishment, these violations differ (Article 12.15 of the Code of Administrative Offenses of the Russian Federation):

  • a fine of 1000-1500 rubles (if the driver drove around an obstacle and entered the oncoming lane)..

Overtaking another vehicle at a railway crossing may result in

  • a fine of 5,000 rubles, but more often -
  • deprivation of driving license for 4-6 months.

If you commit a second offense, you will be deprived of your license for a year.

IMPORTANT!

  1. If overtaking was accomplished without entering the oncoming lane, then it is interpreted as an advance. The protocol must indicate that the number of lanes at the crossing was 2 or more in one direction. If necessary, you can request that the width of the crossing be measured.
  2. Overtaking is allowed immediately after a railway crossing if there are no prohibiting markings or signs there.

What is the punishment?

The driver will face a monetary penalty if failure to comply with traffic rules was recorded by a traffic police officer or on video. Moreover, a fine for a stop line on a camera is much more common in 2021, as video recording systems for violations are being actively introduced.

Attention! The motorist may not be aware that he has come to the attention of law enforcement until he receives a collection notice. By the way, it must contain all the details of the violation with an indication of the relevant article of the Administrative Code.

It is important to consider that the fine for a stop line in 2021 depends on the intersection at which the illegal act was committed. If the intersection of roads was regulated by a traffic light, the amount of the penalty will be 800 rubles. If a violation is recorded in an unregulated area, the driver will have to pay 500 rubles.

In case of violation of the rules for crossing railway tracks, including when crossing the stop line while the train is moving, the amount increases to 1000 rubles. It does not take into account whether the illegal act was committed in the city or outside it. A fine of up to 1,500 rubles is imposed provided that the driver did not comply with the norms for turning around or turning to the side.

According to the law, the owner of the car has the right to challenge the fine. The easiest way to do this is if the violation was not recorded by video recording. Many people advise saying that another person was driving and thus avoid punishment. But usually law enforcement officers require information about the person who was allowed to drive.

Fine for not stopping at a stop sign at a road intersection (Article 12.16 of the Code of Administrative Offenses of the Russian Federation)

So, a stop sign is installed at a road intersection; as a rule, these are roads with a significant difference in their meaning, for example, a highway and a road out of town. We can say that the sign is placed in situations where driving onto the main road involves the risk of a serious accident, which will be difficult to avoid if the driver does not follow priorities. You can also say that the sign is placed in particularly sensitive areas. Now about cases of violation... If the driver ignores the requirements of the Stop sign, that is, does not stop or does not stop in accordance with the Rules. Not according to the Rules, this is when the stop will be made behind the stop line, and if there is none, then not at the intersection of roadways. In this case, he will be issued a fine under Article 12.16 of the Code of Administrative Offenses of the Russian Federation. Article 12.16 itself regulates violations associated with ignoring the requirements of signs and markings. It is called “Failure to comply with the requirements prescribed by road signs or road markings.” And in part 1 of the article the following is stated.

Failure to comply with the requirements prescribed by road signs or markings of the roadway, ..., entails a warning or the imposition of an administrative fine in the amount of 500 rubles.

The fine in this case will be the minimum possible today - 500 rubles. A warning is also possible.

What to do if you cross the mark

There are situations when a driver ends up in a prohibited lane due to various circumstances. Therefore, cases when punishment can be avoided should be considered in detail. These include the following:

  • A common situation is when a driver passed the stop line at a green signal, but did not have time to complete the maneuver. In this case, you need to continue driving despite the fact that the color of the traffic light has changed. This is discussed in paragraph 7 of Article 13 of the Traffic Regulations.
  • In large cities, a different picture is common, with several traffic signals and stop lanes stopped at large intersections. The solution to the problem is also described in the presented paragraph of the traffic rules. In this situation, the driver needs to be guided by the signal of each traffic light.
  • Before changing color, the green signal flashes several times. If at this moment the car has reached the mark, you need to stop immediately. It is allowed to continue driving after pedestrians and other vehicles have passed the road. In such a situation, the driver does not face a fine for crossing the stop line in 2021, since he drove into it at the permitting signal.
  • Motorists are not liable provided that after entering the lane, the vehicle was reversed without creating a danger for other cars behind. But this can only be done if the traffic light color is not red. It is strictly forbidden to move, even while on the stop line. Otherwise, the driver will be given an additional fine for driving at a prohibitory signal.

Is it possible to avoid a fine for a stop sign violation or pay a fine at a discount?

If such a nuisance does happen to the driver as a violation and traffic police inspectors stopping him for it, then here you can try to solve the problem with a “peace agreement”. In fact, if the violation of the sign requirements was related to Article 12.16 of the Code of Administrative Offenses of the Russian Federation, that is, at the intersection of roadways, and not at a railway crossing, then it is necessary to say that you understand your mistake and repent. If before this you have not had administrative violations for a long time, then you can resort to this in your apology. In the end, everything may end with nothing more than a warning. If a stop sign violation was detected at a railway crossing, then a warning is no longer enough. In any case, the traffic police inspectors, with all their desire, will be obliged to issue you a fine. However, here another article of the Code of Administrative Offenses of the Russian Federation will come to your aid, namely 32.2. From it you can find out that within 20 days from the date of drawing up the protocol, you can pay the fine associated with violating the stop sign, with a 50 percent discount. More details about this in the article “How to pay a fine at a discount.”

In what cases can you not stop?

It is allowed to continue driving if a traffic light or traffic controller does not restrict this possibility. That is, when the signal is green, the driver can drive further in the desired direction.

A similar possibility remains provided that there is no STOP sign. If there is one, then the driver must stop, regardless of the number of vehicles and pedestrians at the intersection. If a potentially dangerous situation arises, you can drive through the yellow signal. However, this option is allowed provided that the motorist cannot perform emergency braking. It is prohibited to perform this maneuver in the absence of a real threat.

A stop line is a mark that indicates that a car must stop moving due to an intersection ahead. Crossing this line at a stop signal is an offence. For failure to comply with the standards described in the traffic rules, you will have to pay a fine of 500 to 1500 rubles.

Stop sign, its interpretation in traffic regulations and installation locations

Everyone who once tested their license knows that there is such a “Stop” sign. But not everyone already remembers what requirements it interprets. If we quote the traffic rules, and what is written for sign 2.5, we will find the following information...

“Driving without stopping is prohibited.” It is prohibited to drive without stopping in front of the stop line, and if there is none, in front of the edge of the roadway being crossed. The driver must give way to vehicles moving along the intersection, and if there is a sign 8.13 - on the main road.

Sign 2.5 “Stop”, in fact, STOP is written on the sign in English, can be installed in front of a railway crossing, a quarantine post, at a road intersection, that is, at an intersection. In these cases, the driver must stop in front of the stop line, and if there is none, in front of the sign, at the edge of the roadways. To make it clear how you still need to stop at each of the possible options, take a look at the picture. In the first case there is a stop line, but in the second there is not.

(The figures show where it is necessary to stop the vehicle in the presence of a Stop sign, in the case of a stop line and in the absence of one.)

Now that we have found out that the “Stop” sign dictates a mandatory stop, we need to understand what threatens if we do not comply with this requirement.

Penalty for driving beyond the stop line

If a violation is recorded in the form of crossing the stop line with a prohibitory traffic light signal or sign 2.5, the owner of the vehicle is subject to an administrative sanction in the form of a monetary fine.

Its size depends on the type of intersection where the violation was committed.

  • Adjustable intersection – 800 rubles.
  • Uncontrolled intersection with sign 2.5 “STOP” – 500 rubles.
  • Railway crossing – 1000 rubles.

It is important that the existing regulatory framework involves imposing a fine on the owner of the vehicle, and not on the one who was driving it at the time of the violation.

A collision with a stop line recorded by a camera.

There are often cases when photographic recording devices incorrectly display vehicle license plates. In such a situation, it is possible and necessary to challenge an unfair sanction.
