What will happen in 2021 for driving under a “No Entry” sign?

Characteristics of the sign

“Entry prohibited” is a symbol that indicates that further movement of the vehicle is unacceptable. A brick marks a section of the road where the movement of a car is partially or completely prevented in a particular direction. However, this requirement does not apply to all types of vehicles. Some cars are allowed into the restricted area, and drivers are not punished with fines or other measures.

In what cases is it installed

A sign identifies a section of the road on which traffic should be limited. The law does not clearly describe in what situations a prohibitory symbol must be present.

Among the most common cases are the following:

  • Reverse direction on one-way roads;
  • Entry into areas where only route vehicles are allowed to travel;
  • Driving through areas that cannot be reached from the direction where the sign is installed.

“No Entry” is often used in businesses to prevent unauthorized movement within the area. In such cases, the installation of the symbol must be carried out with simultaneous approval from the traffic police. Otherwise, it may be considered invalid and no one will receive a punishment for driving under a brick.

In what cases is a “brick” installed?

“Brick” is popularly called sign 3.1 “No Entry”, which is a red circle with a horizontal white rectangle drawn inside it. It is this rectangle that evokes associations with brick.

The sign number 3.1 belongs to the prohibitory category, and it prohibits movement in the direction or in the area in front of which it is installed. Often the “brick” is placed along with additional signs indicating the specific direction in which movement is prohibited.

The “No Entry” sign is installed in the following places:

  • In parks and other “green” areas, in parking lots, car parks and gas stations - to streamline traffic flows, separate entrances and exits to a certain territory;
  • On any sections of roads for the purpose of restricting travel;
  • On the territory of government institutions (hospitals, fire stations, police stations) - to restrict the passage of any type of transport, except for specialized ones;
  • On roads in large cities, a sign is installed to highlight individual sections of the road or entire lanes for public transport;
  • On one-way roads - to prohibit driving into the oncoming lane or prohibiting a U-turn at the end of a one-lane section of the road. If there are several such strips, then a brick is installed on each of them.

Grounds for fine

There are different ways to violate traffic rules regarding driving under a brick. Further punishment for the illegal action depends on this. Sometimes the driver is only warned. It is recommended to consider several cases in which the owner of a vehicle will face a fine for a brick in 2021.

These include:

  • Driving through the surrounding area. Drivers often ignore the symbol that prohibits driving to a parking lot or gas station. Despite the fact that these areas are not the main road, they are also marked and regulated by signs. In this case, the amount of the fine for violation reaches 500 rubles.
  • Driving in the oncoming lane. On roads where traffic is one-way, a brick is installed as a warning signal. If the driver neglects the ban, the fine can reach 5 thousand rubles.

Signs prohibiting movement

Fines provided by law

If the driver violates the instructions of the “No Entry” sign and, despite the prohibition, continues the trip, he will be punished in the form of a fine. The violation can be recorded by a traffic inspector or a video surveillance camera. The size of the fine depends on the territory in which the “brick” is installed.

1Adjacent territory. If a motorist drove under a “brick” in the territory of a parking lot or gas station, then the fine will be 500 rubles (in accordance with Part 1 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation). This violation may be committed by the driver due to inattention, especially if he is in a foreign city and enters this area for the first time.

2One-way traffic. In this case, driving under a “brick” will be equated to driving into the oncoming lane, and the driver will have to pay a fine of 5,000 rubles or lose the right to drive a vehicle for a period of 4 to 6 months (according to Part 3 of Article 12.16 of the Code of Administrative Offenses of the Russian Federation) . In case of repeated violation, the period of deprivation can reach one year (in accordance with Part 5 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation).

3Dedicated lane for public transport. The size of the fine in this case depends on the specific region. So, according to Part 1.1 and Part 1.2 of Art. 12.17 of the Code of Administrative Offenses of the Russian Federation in cities of federal significance (Moscow, St. Petersburg), the amount of a monetary penalty for entering the lane of passenger transport is 3,000 rubles, in other cities - 1,500 rubles.

You can lose your driver's license as a result of driving under a brick only when there is oncoming traffic on a one-way road. In all other cases of violation of the sign, the driver is subject to only a monetary fine.

Amounts of fines

The size of the sanction varies depending on the specifics of the violation. Obviously, the penalty is greater in cases where failure to comply with traffic rules creates dangerous conditions for other road users. The average fines for driving under a brick are discussed below.

Nature of the violationRecovery amount (RUB)
Driving on single-lane roads against the direction of general traffic5 thousand
Entering a yard or parking lot under a prohibitory sign500
Driving in a bus lane1500
Driving under a prohibiting sign to a place of work500

The fine for driving under a “No Through” sign varies based on numerous factors. It can be extremely difficult for drivers to understand the nature of the violation, especially if traffic police officers do not support this with the relevant articles from the Code of Administrative Offenses. Therefore, in case of illegal actions, the inspector issuing a fine is obliged to notify the exact reason, indicating the nature of the violation.

Is there a discount on the fine for driving under a “no entry” sign?

Receiving a discount when paying a fine is provided for in Article 32.2 of the Code of Administrative Offenses of the Russian Federation. If a citizen provides funds within 20 days from the date of the decision, the discount will be 50%. There are a number of restrictions. The above regulatory legal act provides a list of articles of the Code of Administrative Offenses of the Russian Federation. Monetary penalties applied within their framework are not subject to a discount.

If we consider the punishment for driving under sign 3.1 “entry prohibited,” it will not be possible to reduce the amount of the penalty only for repeated entry into the oncoming lane in violation of the current regulations. In all other cases, a reduction of the fine by 50% is permissible.

Additional penalties

In case of gross violations of traffic rules, especially when driving on a single-lane road against the direction of travel, in addition to a fine, the driver may be subject to other types of liability. We are talking about deprivation of rights for a period of 4-6 months.

Attention! If the violation was recorded repeatedly using surveillance cameras or other means of video recording, the ID may be confiscated for up to 1 year. At the same time, the owner of the car is obliged to pay a fine of 5 thousand rubles. Similar penalties are used in a situation where an unlawful action was recorded by a traffic police inspector.

Application of the prohibitory sign "Brick"

Installation of this sign is used in the following cases:

  • when traffic in the opposite direction is prohibited on a section of a one-way road;
  • when traffic is prohibited on a lane intended for public vehicles, including buses, trolleybuses and trams;
  • when traffic to the territory is prohibited from a certain area;
  • when movement is prohibited when there is any obstacle ahead. In this case, simultaneously with the prohibition sign, a sign regulating the direction of detour traffic is installed.

In addition, the “Brick” sign is often used at gas stations and adjacent areas of entertainment and shopping centers in order to regulate the movement of incoming and outgoing visitors’ vehicles.

Is it possible to challenge

There are ways to prevent a fine or deprivation of your license for driving under a brick in 2021. This method works in cases where the sign was installed incorrectly. In this situation, the driver can appeal the decision, citing the fact that he did not notice the prohibiting symbol.

In accordance with GOST, the “brick” must be located in a visibility zone of at least 100 m. The distance from the road is no more than 2 m, and the height is no higher than 3 m. If these requirements are not met, the offender has the opportunity to challenge the fine. This can be done immediately upon registration. Another way is to file a complaint with the traffic police at your place of residence.

When collection for travel under a brick is impossible

It should be noted that a driver who drives under the “Brick”, in some cases, will not be punished. There are a number of exceptions in the traffic rules that allow such a maneuver.

Thus, the following will not be punished for driving under the “Brick”:

  • drivers driving a vehicle owned by a company, before entering the territory of which this road sign is installed;
  • minibus drivers driving along the lane allocated for public transport;
  • drivers driving vehicles belonging to law enforcement agencies and other special services, such as ambulances or the Ministry of Emergency Situations.

When can you avoid penalties for driving under a brick?

We emphasize that in some cases, a driver who drives under the “Brick” may not fear punishment.

For example, if this sign was installed without obtaining all the relevant approvals, not by traffic police officers, but by property owners who wished to thus limit the access of citizens to it, you can safely ignore it and continue driving without fear of negative consequences. This sign was installed arbitrarily and has no legal force.

You can also avoid liability for driving under the “Brick” if this road sign is installed in violation of very strict rules and regulations governing its installation.

Thus, in accordance with current regulations, this road sign must be visible from a distance of at least 100 meters. In addition, it is not allowed to be covered by tree branches or advertising structures.

If it is installed at the entrance to a one-way street, then a “One-way road” sign must be installed together with it.

In the case when, at the entrance to a one-way highway, only a “Brick” is installed, and you drove under it, you will only be punished for driving under the “Brick”. But they will no longer be able to hold you accountable for driving into oncoming traffic.

If you find yourself in such a situation, you do not have to be afraid of being deprived of your right to drive vehicles. In this case, you can only be punished by imposing a fine, the amount of which will be from 500 to 1,500 rubles.

Despite the fact that driving under the “Brick” is without a doubt an illegal act, the driver who committed it will not always be punished by deprivation of the right to drive vehicles.

In most cases, the driver who has committed such an administrative offense will have to pay a fine. But if he drives under the “Brick”, which is installed along with a sign establishing one-way traffic, he will be deprived of the right to drive vehicles for up to 6 months.

What categories of vehicles can drive under a brick?

There are a number of exceptions in which cars can drive despite a prohibitory sign. This requirement does not apply to certain categories of vehicles. These include:

  • Route and passenger vehicles;
  • Cars that are used to transport disabled people;
  • Vehicles used in private enterprises;
  • Car owners who are residents of the area under the prohibited sign;
  • Special equipment and trucks that unload materials during construction, repair or installation work;
  • Emergency vehicles and mail.

Driving on a section of road that is marked with a prohibitory sign is considered an offence. This is subject to administrative liability, a fine, and in some situations, deprivation of rights. To prevent punishment, drivers should know when driving under a brick is not prohibited.

Passage under the “Brick” sign

The legislation provides for a certain case of driving under a brick in the opposite direction to traffic, but only in reverse.

For example, you are driving along a one-way road and accidentally overshot a turn by literally ten meters. In this situation, you can carefully turn on the emergency signal, without interfering with the general flow, and begin to move back into your ill-fated turn.

In conclusion, I would like to say that the “brick” is the most respected prohibitory sign among motorists, since in many cases it has an important function of traffic safety and security.

And accordingly, if you ignore it, you can have not very pleasant consequences for your wallet and comfortable movement.

Road signs are divided into a number of categories that the driver must know. The group of prohibitions is quite extensive and includes various restrictions that must be observed in a specific area of traffic. Bricks belong to the category of prohibition signs.

Penalty for driving under a brick onto a regular road?

The peculiarity of the “no entry” sign is that it only tells the driver that the specified section of the road cannot be entered. However, it gives absolutely no information about what exactly awaits the driver at the specified section. In principle, this is quite logical, because a law-abiding driver simply will not drive under a brick.

However, if we consider the situation from the other side, then a driver driving under a brick cannot know in advance what punishment awaits him. It all depends on which road the car ends up on:

  • on the regular road
  • on a road with a dedicated lane for public transport,
  • onto a one-way road.

Let's consider each situation separately.

In this example, the driver drives through a prohibitory sign and ends up on a very ordinary two-way road. That is, in this case, he violates only the requirement of the road sign and can be punished under Part 1 of Article 12.16 of the Administrative Code - a warning or a fine of 500 rubles .

For example, such a fine will be imposed on a driver who drove under a brick into a gas station where there is no one-way traffic.

Table of fines for driving under a brick

Let's present the fines listed above in table form:
