Drivers who committed minor collisions had to wait for hours for the traffic police to arrive to register the incident. With the introduction of a simplified system, road accident participants received the right to file minor collisions without the involvement of traffic inspectors. Domestic legislators borrowed this experience from the European Union countries, which is where the unofficial name of the simplified notification came from - the Europrotocol.

  • if the culprit did not send his copy of the Notice signed by both parties to the insurer who insured the civil liability;
  • if, before the expiration of 15 calendar days from the moment of the accident, not counting weekends and holidays, the driver began repairing or disposing of the vehicle involved in the accident;
  • if the culprit’s vehicle is not provided for inspection or independent examination at the request of the insurance company.

Failure by the guilty party to submit the Euro Protocol to its insurance company becomes the basis for a recourse claim for the insurer. In this case, the driver who caused the harm will be charged all compensation to the injured party. Therefore, the at-fault party should always report the accident to their insurance company. Otherwise, the consequences will be much more unpleasant. The client should contact their insurer as soon as possible. The maximum period allotted for filing a Notice of an Accident is 5 calendar days after the accident.

When can you file an accident without the traffic police?

According to the established rules, registration of the Europrotocol is allowed only if several conditions are met.

  1. Only two cars were involved in the accident, both of which were insured through the MTPL system.
  2. As a result of the collision, only these two cars were damaged, and no damage was caused to the property of the third party.
  3. During the accident, no one was injured - neither drivers, nor passengers, nor pedestrians.
  4. One of the drivers fully admitted his guilt in the incident, as a result of which no examination is required.
  5. The circumstances and nuances of the accident are equally assessed by its participants, without causing controversy.
  6. The amount of damage caused to the injured party’s car does not exceed 100 thousand rubles.

When at least one of the listed conditions is not met, the European Road Accident Report cannot be issued. Participants in the collision will have to wait for the arrival of traffic police inspectors to record the circumstances of the incident and subsequently identify the culprit.

How to draw up a European protocol in case of an accident

The form is filled out according to a certain standard. If the rules for drawing up a notice are violated, it may be declared invalid. As a result, compensation payments to the owner of the damaged vehicle will be denied.

  • When writing a notice, use a regular ballpoint pen. Notes made with a gel pen or pencil may be erased and the document will become unreadable.
  • The Europrotocol form must be filled out in legible, preferably printed, handwriting.
  • Try to avoid corrections and erasures in the document. This is another reason for quibbles on the part of the insurer, who does not want to pay compensation.
  • Enter the relevant information into the existing notice columns to avoid confusion.

The form must be filled out on both sides – front and back.

On the front side there are columns in which the following information is entered:

  1. The location of the accident, date and time are indicated. The name of the street and the number of the house next to which the collision occurred. If this happened on a highway, then its number and kilometer are indicated (for example, 35 km of the E-27 highway). The time of the incident is indicated to the nearest minute.
  2. Please note that there were no more than two damaged cars and no people were injured in the accident.
  3. When there are witnesses to the incident (passers-by, passengers), record their details - full name, telephone numbers, residential addresses.
  4. Identification information of the affected vehicles (registration number, VIN), data of the owners and persons driving the colliding vehicles.
  5. Information about insurance companies that issued MTPL policies, their numbers and validity periods.
  6. Describe the nature of the damage caused to the vehicles, with an exact list of damaged parts and body elements.
  7. Draw by hand a diagram of the accident that occurred, indicating the road surface, markings and the trajectory of the vehicles before and after the collision. Mark nearby landmarks on the diagram - traffic lights, houses with numbers, and other significant landmarks. If certain symbols or abbreviations were used in drawing up the diagram, their explanation should be given below.
  8. All information provided in the form is certified by personal signatures of both participants in the accident.

Rules for filling out the Europrotocol form

  • instructions are attached to the document, which should be read before filling out;
  • You only need to enter data with a ballpoint pen. It is advisable to use dark ink and block letters;
  • Before the participants in the incident leave the scene of the accident, it is necessary to collect information about them;
  • one half of the protocol is filled out by one driver, the second by another. Moreover, it makes no difference who gets which column;
  • After entering the necessary data, everyone confirms that they agree with everything stated in the protocol. Signatures are required for this purpose.
  • there should be no errors in the form. No corrections or crossing out are allowed here. If there is an error, a new form should be used;
  • separation of sheets should be carried out only after affixing signatures;
  • if the culprit damaged not one car, but several, he needs to draw up a European protocol with each injured participant in the accident;
  • All fields on the form must be filled out.

Although the form contains a large number of lines, filling them out should not be difficult. Everything here is very clear. Just enter the required data in the appropriate lines. However, it is worth paying attention to two points:

  1. Description of the list of damaged components and parts. Practice shows that many car owners do not pay due attention to a seemingly ordinary scratch. However, you need to remember that it can hide quite serious problems that require expensive repairs. It is in the interests of the injured party to inspect as thoroughly as possible the areas of the vehicle that are damaged.
  2. Drawing up a diagram. There are no specific rules for drawing up a diagram. But you need to try to compile it in as much detail as possible. To avoid any additional questions, make a clear drawing.

The form has a special field intended for the diagram. It must be compiled in a certain sequence:

  • map the road where the collision occurred. Also indicate adjacent roads, neighboring streets, markings and other landmarks;
  • schematically depict the cars at the time of the accident. Each one must be designated by the letters “A” and “B”. The location of the collision is indicated by an "X". Arrows indicate the directions of movement.

After signing and separating the documents, drivers will have to fill out the back of their form. Try to describe the situation in as much detail as possible from your point of view. You should also indicate whether the owner was driving the car or not. If there is any additional information, for example, data from a video recorder, they are also entered into the document.

After the forms are separated, it may be necessary to make some additions. If such adjustments are approved by both parties, they must confirm such actions with their signatures.

How many copies should I fill out?

Each participant, after completing the Europrotocol, must have his own notification form. When filling out a self-copying form issued at the insurer's office, the document is filled out only once. In the second sample, all information will be displayed through carbon paper. The participants in the collision will only need to certify each copy with their signature.

When filling out a form printed on a printer yourself, you will need to fill it out twice , duplicating the information for each copy. If you have carbon paper, you can place it between two copies when filling it out.

Registration of the Europrotocol through the application

When deciding whether to go to the traffic police, the driver of the injured party should also take into account the maximum amount of payments under the Europrotocol. Without confirmation from the traffic police, the insurance company will not pay for exceeding the limit.

Stages of registration

Despite the stress factor, it is recommended to act in strict accordance with the requirements of the law, which in this situation are most fully reflected in the paragraphs of the protocol. This behavior can prevent the emergence of many problems and successfully resolve the difficulties that arise.

In reality, everything is very simple - when registering a traffic accident under the European Protocol, both participants must contact the insurance company. If the accident is recorded by police officers, only the injured driver can submit a package of documents to the insurer.

A participant in an accident who is not at fault in the accident has the right to contact both his insurance company and the insurance company of the culprit. In addition to the Notice, an application for insurance payment is submitted. Photo and video recording materials are attached to the package of documents. The insurer agrees with the applicant on the date of inspection and, if necessary, sends it for an independent examination. Then the following steps are performed:

  1. After an investigation, the insurance company reimburses the damage. For car owners, this is car repair. The affected person is given a referral to an accredited service center. Truck repairs may be replaced by a cash payment.

But these rules apply only in case of registration of an accident in the usual way , with the involvement of a traffic police officer. For notifications issued independently using Europrotocol forms, the limit of compensation payments does not exceed 100 thousand. This also applies to situations when a notice is issued and sent to the insurer via a mobile application.

In what cases can you use the AlfaStrakhovanie European protocol?
