European protocol for non-contact road accidents

A non-contact accident is a situation typical of modern roads. When the result of an obstacle created by one of the cars is an accident for the second, this is the term they express.

In this case, there is no question of drawing up a European protocol. It is necessary to invite a traffic police officer who will immediately begin a trace examination. The work represents a whole complex of activities in which the circumstances of the accident, the conditions contributing to it, and the degree of guilt of each of the participants are clarified. The immediate objectives of a correct traceological examination are:

  • recognition of objects by their traces;
  • thorough inspection, determining the degree of damage to vehicles on the road;
  • inspection of the scene of a traffic accident, linking the discovered facts to one or another means (broken glass, broken parts, scattered mechanisms, etc.).

Registration of the Euro protocol for CASCO

The CASCO insurance system does not provide for the registration of an accident by drawing up a European protocol. If the driver of the car involved in an accident has a CASCO insurance policy, calling a traffic police officer is mandatory. Upon arrival, he must carry out the necessary recording of the case and complete all the necessary documents.

Is an emergency commissioner required when registering the Europrotocol?

The law does not provide for the mandatory presence of an emergency commissioner in case of an accident with the registration of a European protocol. But at the request of one or both parties, this is not prohibited.

When the 2021 European Protocol form is filled out, you need to analyze how fully the facts confirming what happened have been collected. It's time to take as many necessary photographs and videos as possible, measure braking distances, identify the witnesses present, and collect their coordinates.

When the entire set of facts has been collected, the necessary documents have been filled out, the main task is to inform the insurance company. According to the new law, this is given 5 days, but you can contact the insurance agent in advance, consult what additional data may be needed, and whether an additional examination will be carried out.

Europrotocol is a modern way of resolving issues of insurance payment for road accidents without the participation of traffic police officers. It is efficient, effective and convenient. In such a situation, the driver does not have time to get his bearings and offer to register it. For traffic police officers, this is not a very desirable option: they do not draw up a protocol, do not punish the culprit, and do not participate in eliminating violations in the organization of traffic. However, practice is provided. It can be used successfully if necessary, especially on congested roads.

How to report a parking accident?

How to fill out the Europrotocol correctly? There are certain conditions according to Art. 11.1 No. 40-FZ, in which participants in an accident have the right to independently issue a notification in the event of an accident:

  • no casualties;
  • only material damage was caused to the victim’s property;
  • no more than two participants in the accident;
  • every car owner has a valid MTPL policy;
  • absence of disputes and disagreements between participants in the accident;

Rules for filling out the Europrotocol form:

  • Until the document is fully completed and signed by all participants, vehicles cannot be moved from the collision site.
  • Take photographs or videotapes of the consequences of the accident.
  • You need to fill out the form with a regular blue ballpoint pen.
  • The form must be filled out on each side and in two copies.
  • All data must be entered in accordance with the columns. It is necessary to correctly fill out the fields with the collision diagram, vehicle license plates and their brands, and accurately enter the details of the driver’s license and vehicle registration certificate.
  • In the line “Other participants” there is a dash.
  • You must check the appropriate box next to the word “Yes” or “No” in the section with the question: can the car move on its own.
  • In the note, indicate the name of the equipment used to take photos or videos of the accident scene.
  • The protocols of the culprit and the victim must be completely identical. This also applies to signatures, date and time of filling.

To do this, you will need the following documents from all participants in the accident:

  • identity documents (passports);
  • driver's licenses;
  • current MTPL insurance policies;
  • PTS or STS for a car.

After the documents for the accident have been completed, you need to record the incident at the nearest traffic police department and submit the Euro Protocol form to the insurance company within 5 working days in accordance with clause 10 of Article 12 No. 40-FZ.
