Washing a car in the wrong place - fines and rules for motorists

Where is it prohibited to wash a car?

Federal laws do not list places where car washing is prohibited. The Code of Administrative Offenses only limits washing near water bodies and in forests. Other places are listed in regional codes:

  • areas near bodies of water, such as rivers and lakes;
  • embankments;
  • yards;
  • children's and sports grounds;
  • pedestrian paths;
  • streets;
  • public spaces: squares, squares, parks;
  • forests;
  • agricultural land.

According to the sanitary rules of Moscow, the car cannot be washed or cleaned throughout the city, with the exception of specially designated areas.

Lawyer of "Pravo Group" German Kuts The legislator prohibits washing cars in the wrong place in order to avoid harmful consequences: the formation of dirt on the roads, harm to the environment from detergents and petroleum products washed off from the car body - they go into the soil or water bodies.
In winter, the sink creates ice that can cause you to slip on it. Therefore, when the owner purchases a car, he must understand that he can wash it only in special places, and not wherever he wants.

Advice for car owners

Based on all of the above, we recommend adhering to the following rules:

  1. Remember the list of places that are prohibited for car washing purposes: courtyards, streets, public places.
  2. When improving the appearance of a car near your private home, do not forget about your neighbors: watch out for dirty water drains, which should not be directed to the neighboring area; do not use a lot of automotive chemicals.
  3. Never wash your car closer than 50 meters to a body of water. The width of the water protection zone is determined in each specific case, but 50 meters from the reservoir is always prohibited.
  4. Choose the most optimal washing option for yourself: do it yourself near an individual home, use car wash services, or visit a self-service car wash. Then your car will always sparkle, and you will be clean before the law.

Where can you wash your car?

At the car wash. At the stations, wastewater does not enter the soil and water bodies. Car washes are required by law to treat water before it goes down the drain. Therefore, you can wash your car at the station without harming the environment.

On your own territory. Theoretically, you can wash your car in your garden or in your personal garage. In this case, the owner of the territory himself is responsible for pollution and the entry of chemicals and petroleum products into the soil. To avoid consequences, it is better to install sewer drains with filters and ensure that water does not flow out of the territory - this will be a direct violation of the law.

Washing a car in the wrong place - fines and rules for motorists

A vehicle, like any other equipment, loves order and cleanliness, so motorists should take time to wash the exterior and interior. Everything would be fine if all drivers carried out water treatments for their iron horses in the designated areas. But there are also those who can wash a car on the lawn in the yard or near the lake. Washing a vehicle in the wrong place is punishable by a fine. Its size may vary depending on the circumstances.

Car washing is prohibited throughout the city, except in designated areas.

The Federal Law does not contain a list of places where it is prohibited to wash a car. The Code of Administrative Offenses only specifies restrictions on carrying out this procedure near bodies of water and in forests. All other prohibited places are listed in regional codes. So, such places include areas near water bodies, embankments, courtyards, children's/sports grounds, sidewalks, streets, public places, forests and agricultural lands. If we consider the sanitary rules of Moscow, we can clarify that washing a car is prohibited throughout the city, except in designated areas.

Washing a car in the wrong place may be considered a violation of sanitary standards.

Now let’s look at where the car owner has the right to wash the vehicle. First of all, let's note the car wash. These are stations that are equipped in such a way that wastewater does not enter the soil and water bodies. All car washes are required by law to treat the water before it goes down the drain. Therefore, you can wash your car at such sites without fear for the surrounding environment. The second option is your own territory. In theory, motorists can wash their cars on their lots or in garages. But in this case, the owner himself will be responsible for contamination and the release of chemical products into the soil. If you do not want to face unpleasant consequences, it is better to install sewage drains with filters in advance.

Fine . Many are interested not so much in the ban itself as in the size of the punishment for violating it. Please note that washing a car in the wrong place may be considered a violation of sanitary standards. In this case, an ordinary individual must receive a fine of 500 rubles. If the violation was committed by an individual entrepreneur, the amount of punishment increases to 1000 rubles. For a legal entity, a fine of up to 20,000 rubles is imposed. For individual entrepreneurs and companies, an additional penalty may also be imposed - suspension of activities for up to 90 days.

For polluting forests with wastewater and chemical products, an individual receives a fine of 3,500 rubles

If we consider fines for washing a car near a pond, the Code of Administrative Offenses has 2 articles on this matter. For a violation that leads to water pollution, the fine for an individual is 1,000 rubles, for an individual entrepreneur up to 30,000 rubles, and for a legal entity up to 100,000 rubles. The water strip is used in violation - this article is relevant for those who have a plot of land near a reservoir. The fine for washing in this case will be 4,500 rubles for an individual, 12,000 rubles for an individual entrepreneur and 400,000 rubles for a legal entity.

Another form of punishment is provided for washing a car in the forest. For polluting forests with wastewater and chemical products, an individual receives a fine of 3,500 rubles, an individual entrepreneur - 20,000 rubles, a legal entity - 300,000 rubles. Please note that for all the violations listed above, no discount is provided for payment within 20 days from the date the fine is issued. This type of fine will have to be paid in full.

Bottom line . Washing a car in the wrong place is regarded as a violation for which punishment is provided. Motorists can only service their car at a car wash and personal lot.

What are the penalties in case of violation?

For violating sanitary standards. Washing a car in the wrong place can be considered a violation of sanitary standards. Then according to Art. 6.3 of the Administrative Code, a citizen will pay a fine of up to 500 rubles, a director of a company or individual entrepreneur - up to 1,000, a legal entity - up to 20,000 rubles. For individual entrepreneurs and companies, it is possible to suspend activities for up to 90 days.

For washing a car by a pond. The Administrative Code has two articles related to car washing near rivers and lakes:

  • violation that may lead to water contamination. The fine for a citizen is up to 1,000 rubles, for a director - up to 30,000, for a company - up to 100,000 rubles. This is stated in Art. 8.13 Code of Administrative Offences;
  • use of the waterway in violation. Art. 8.42 of the Administrative Code is relevant for those who have a summer cottage near water. The fine for washing in this case is higher: for a citizen - up to 4,500 rubles, for a director or individual entrepreneur - up to 12,000 rubles, for a company - up to 400,000 rubles.

For washing a car in the forest. For polluting forests with wastewater and chemicals, the fine for a citizen is up to 3,500 rubles, for the director of a company or individual entrepreneur - up to 20,000 rubles, for a legal entity - up to 300,000 rubles. The company's activities may be suspended for 90 days.

Regional fines. Local laws govern car washing in other prohibited areas. Fines vary in different cities. If a fine is not established in the city, penalties for violating sanitary standards will apply.

Washing a car in the yard: is it possible to do this task yourself?

A citizen is the owner (proprietor, trustee, lessee) of the car. His job is to keep the car clean. But administrative legislation directly states that washing a car in the yard is prohibited. It is allowed to do this only in private yards, if such actions do not harm other people. For example, if a car is washed near a well, cleaning agents and petroleum products are absorbed into the ground and penetrate into the water.

A careless car owner who decides to wash his car in the courtyard of a multi-storey residential building will be fined. The amount of the fine will be many times greater than the savings on the car wash.

Provisions of the Code of Administrative Offenses

To clarify the situation, you need to refer to Art. 18.3 Code of Administrative Offenses of the Russian Federation. There is no direct indication that washing a car in a common yard is prohibited. However, it can be used by law enforcement officers for the reason that the car owner, through his actions, violates the water protection regime, which contributes to unacceptable pollution of watersheds.

A car washer who processes a car in a yard faces the following fines.

First point. The offender is a private person. Will pay a fine - up to 1 thousand rubles.

Second point. The rights of citizens and the provisions of SNiP are violated by an official. You will have to pay up to 2 thousand rubles.

Third point. A car owned by the organization was washed in the wrong place. Or the car is washed in the organization’s yard. Such a legal entity will need to pay 20 thousand rubles. fine

On the one hand, this article seems to be directly related to washing cars in yards; on the other hand, the legality of the requirement to pay a fine is somehow not consistent with this situation. Such demands seem not entirely logical and completely unacceptable.

Explanations

Remains of fuel and lubricants and dirt mixed with auto chemicals are washed off from the car. Wastewater carries these pollutants into city sewers, and from there into the reservoir of the water collection facility. These systems become polluted.

And stationary car washes do not discharge waste water into city sewer systems. Specially equipped tanks are filled, a sewer truck arrives, pumps out, and transports the liquid to places where liquid household waste is stored and processed.

Regional requirements

More detailed prohibitions on car washing are established in the legislation of the constituent entities of the Russian Federation and in municipal acts. Therefore, when deciding where you can wash your car and not get a fine, you should look at:

  • regional environmental laws;
  • city code on administrative responsibility;
  • rules for improvement of a particular municipality;
  • decisions of municipal authorities.

Such acts should not contradict federal regulations that establish general rules of protection in the state. They define specific places where the car cannot be washed. These areas include:

  • courtyards of apartment buildings;
  • coastal strip of rivers, lakes, reservoirs and other water bodies;
  • forests;
  • agricultural territories;
  • city-wide parks;
  • pedestrian areas.

For example, according to clause 10.5 of the Decree of November 9, 1999, establishing sanitary rules for organizing cleaning and cleaning of the territory in Moscow, washing and cleaning vehicles is prohibited in the city outside specially equipped places. The same rule is duplicated in paragraph 1 of Art. 8.8. Moscow Code on Administrative Offenses of 2007, which establishes the amount of punishment for washing a car in the wrong place. The same rules are in the Law of St. Petersburg on AP of 2010 (Article 22), the Law of the Sverdlovsk Region of 2005 and other areas.
