Laws for drivers and the size of traffic police fines in 2021

In addition to the main penalties, additional penalties are provided for drivers. If, for example, a driver cannot be fined twice for the same traffic violation, then the inspector has every right to prescribe an additional penalty. Such measures include demands from inspectors to stop the offense committed, up to the evacuation of the car to the traffic police parking lot or confiscation. Below, we will give you the most current offenses for today in 2021, tell you about new penalties with additional, possible information regarding discounts on fines and more. The recommended specialists above understand not only the issues of penalties for traffic violations, but will also help with registering the car with the traffic police with a subsequent guarantee of the services performed.

Latest changes affecting fines in 2021

  • Since the beginning of 2021, fines for the lack of insurance - a compulsory motor liability insurance policy - have increased.
  • Penalties have increased if vehicle windows are not tinted to the required standards.
  • If a drunk driver gets behind the wheel, the presence of a child under 16 years of age in the vehicle is considered an aggravating circumstance.
  • There is also a penalty for refusing a medical examination and document verification. The fine in this case is even greater than for drunk driving.
  • Liability for speeding increases. The size of the corresponding penalties is increasing.
  • The procedure for punishment for “dangerous” driving and creating emergency situations on the roads is prescribed.
  • The responsibility for transporting a child without a special seat corresponding to the age and physical characteristics of the young passenger has been increased.

Drivers need to pay attention to some other changes in the law that have come into force in recent years:

  • On July 3, 2021, changes affecting Article 12.8 of the Code of Administrative Offenses regarding depriving a driver of driving a vehicle while intoxicated came into force.
  • From April 28, 2021, changes affected part 1 of Article 12.3 of the Code of Administrative Offences. Now inspectors can fine drivers for committing violations such as driving on waffle markings. The corresponding term has already appeared in the traffic rules.
  • From November 10, 2021, the amount of the fine has increased from 1,500 rubles to 2,500 rubles for failure of a driver to allow a pedestrian to pass. Now you know what new changes in traffic police fines all drivers should expect.

So, especially for you in this article, we will provide below a table of the most relevant fines this year, their sizes, as well as penalties and other additional information, how many and for what fines a discount is provided with subsequent punishment, whether the violation should be recorded with photos and videos fixation.

Traffic police fines 2021, new table

The information in the table is current as of March 25, 2021. You can get additional information on penalties for violations and how traffic police fines will increase from May 1, 2021 by calling the number above. It is also known that traffic police fines will undergo upward changes from June 1, 2021.

About discounts on fines

They are provided in accordance with Article 32.2 of the Code of Administrative Offenses for most traffic police fines and amount to 50% of the amount of the sanction. The discount does not apply mainly to fines for repeated violations, as well as gross ones.

The deadline for paying a financial sanction with a discount is 20 days, and here lies an important difference from most other deadlines in administrative law. The fact is that the discount period begins to count from the date of the decision (and other periods, as a rule, from the date of entry into force). The beginning of the deadlines in the Code of Administrative Offenses is dated the next day, so 20 days should be counted from the next day after the decision was made.

For example, you were caught on camera on January 1, 2021, the decision was made on January 2 and sent to you by mail. You received a letter on January 12. So, the discount period still lasts until January 22, 2021 inclusive.

If the letter from the camera took longer than 20 days, then this period, alas, will be missed, although the Constitutional Court declared this illegal, and it can be restored upon petition to the body that issued the decision or to the court.

Discounts on traffic police fines

What fines will be included in the traffic rules 2021

Touching upon the topic of future traffic fines, it is impossible not to talk about the rapid increase in their “tax”. The main modernization of this year is that the driver has the opportunity to pay 50% of the contribution amount immediately, and the remaining half over the next 20 days from the date of receipt of the receipt.

The next item on the list of “improving” the lives of drivers is the use of a car that has not passed state registration. First of all, this threatens with a fine of 5 thousand rubles, while repeated violation of traffic rules implies deprivation of rights. Exceeding the permissible speed limit obliges drivers to pay 2 thousand rubles to the state treasury. When driving through a red traffic light, you should immediately prepare for another ticket, while a repeated offense can deprive the motorist of his license for at least 6 months. A complete list of fines with their new “rates” can be found on the official Internet portal of the State Traffic Safety Inspectorate of the Russian Federation.

About repetition

The violation is considered to be committed again according to the letter of the law if you are caught on camera or in the formidable hands of a traffic police inspector within a year after the execution of the first order. You also need to understand what execution is. This:

  • full payment of the fine (with or without a discount),
  • expiration of the period of deprivation of rights,
  • expiration of the period of administrative arrest.

For example, a driver was caught in a state of intoxication on January 1, 2019, and the court deprived him of his license for 1.5 years and also imposed a fine of 30,000 rubles under Part 1 of Article 12.8 of the Administrative Code. The court ruling was made on January 15, came into force after 10 days - on January 26, and the period of deprivation began (provided that the driver submitted his license to the traffic police on time). The driver paid the fine on April 1 of the same year.

In this example, the repetition will last from the end of the period of deprivation of rights - July 26 of the following year and for another year after that. If the driver is caught drunk again under the same article of the Code of Administrative Offenses, then he will face criminal punishment.

List of repeated fines for traffic violations in the table

This is true?

Will there be new fines for traffic violations in November? No! None of the sanctions in the table above take effect in November. And the new fines are a myth. This is relevant as of May 30, 2021, we monitor new information daily and are aware of upcoming legislative changes.

In fact, it is hyped every year by a number of publications and websites for reasons unknown to anyone. We already published a similar article last year and even the year before.

The truth about changes to the Code of Administrative Offenses and new traffic rules in November 2019

How can I check this?

It is logical to conclude that, although we write about a number of publications with news about increasing traffic police fines, we ourselves can be the same site, writing not entirely truthful data, without referring to the official website of the traffic police.

Therefore, we will refer to official sources, although the traffic police website actually has nothing to do with it. And what does it have to do with it?!

There are 2 ways to check whether this information is myth or truth:

  1. check for new fines from November 1 on the official website of the traffic police, as well as new laws from November 20, 2021 in legal information databases - that is, more authoritative sources,
  2. look for changes on the government website, where new traffic rules must be published.

So, let's look at more authoritative resources:

  • on the website of the State Traffic Inspectorate, all the above amounts for administrative fines, including speeding, tinting, driving without compulsory motor liability insurance and others are the same as at the beginning of the year and even in the past,
  • Let’s also look at the Consultant Plus website - here there are all new editions of the Administrative Code, depending on the dates of changes that come into force; You won’t find any new traffic police fines here either, which come into force in November.

The truth about changes in fines and traffic rules - proof

Did you know that every change and every new law must be officially published in government publications, including on the Internet? The second way is to check this.

But let’s first find out where the statement above comes from. Article 4 of Federal Law No. 5 tells us about this back in 1993, which also indicates on which website the changes are published.

In turn, Article 4 of the same law prescribes that only after 10 days of publication such new laws come into force. The Code of Administrative Offenses of Russia is amended by federal laws.

Article 6. Federal constitutional laws, federal laws , acts of the chambers of the Federal Assembly come into force simultaneously throughout the entire territory of the Russian Federation after 10 days after the day of their official publication , unless the laws themselves or acts of the chambers establish a different procedure for their entry into force.

Article 4. The official publication of a federal constitutional law, a federal law, an act of the chamber of the Federal Assembly is considered the first publication of its full text in the “Parliamentary Gazette”, “Rossiyskaya Gazeta”, “Collection of Legislation of the Russian Federation” or the first placement (publication) on the “Official Internet legal information portal" (www.pravo.gov.ru).

There's only one small thing left to do - we go looking for new fines on the Pravo.gov.ru portal and don't find any federal laws there that were developed before November 2021. Thus, we receive “proof” that there will be no changes either from November 1 or from November 20.

Amount fork

In the table of fines you can see that for certain violations there is a range of fine amounts. This means that the person hearing the case decides, at his own discretion, what amount to assign to the specified person. The most important role in this is played, as a rule, by the presence of other traffic police fines for the driver, especially under the same article of the Code.

The following circumstances will help you set a minimum amount threshold:

  • driver's remorse
  • their admission of guilt,
  • presence of dependents.

But the following can lead to a maximum fine:

  • the presence of harm caused by traffic violations,
  • the presence of other fines during the last year, especially similar to the current one.

Amendments to traffic rules in 2021, requiring special attention for motorists

Over speed

This violation is considered one of the most common on the roads of the Russian Federation. After all, modern cars allow you to accelerate to high speeds, which of course is prohibited by the limits. Moreover, the excess can be recorded both directly by traffic police officers and by auto-recording cameras, which are installed in most populated areas and busy highways.

10-20 km – no fine is applied; 20-40 km – a fine of 500 rubles; 40-60 km – 1,000 -1,500 rub. In the event that this is a repeated violation, the amount increases several times and can range from 2,000 to 2,500 rubles; more than 60 km – 2,000 and 2,500 rubles, in the second case 5,000 rubles; more than 80 km – 5,000 rub.

No child seat

The law stipulates that small passengers must be in special car seats that are properly secured and can save the child’s life in case of unforeseen situations.

Types of punishment: driver – 3,000 rubles; manager, this also includes a taxi - 25,000 rubles; carrier company – 100,000 rubles.

Safety belt

If you do not fasten your seat belt, the risk of injury in an accident increases several times, which can sometimes be fatal. That is why in this matter it was decided to increase and increase the amount of the fine in order to at least somehow protect drivers and teach them to be more careful and attentive to their lives. Unfastened seat belt – 1,000 rubles. Unbelted child – 3,000 rubles. Unbelted adult passenger – 1,000 rubles.

Driving while drunk

This is one of the problems that our authorities have been facing for years, increasing punishment every year. After all, it is precisely such a driver who poses a terrible danger on the road, which can subsequently lead to the death of innocent people. Today, according to the law, the inspector has every right to ask to undergo an examination if the driver shows signs of drinking alcohol, that is, unclear speech, the smell of alcohol, excessive aggressiveness, and if this is confirmed, the motorist may even lose the right to drive a car. As for punishment, the following changes are noted.

Driving a car by a drunk driver or transferring control of a car to a drunk driver - 30,000 rubles, if this is a repeated violation, then 50,000 rubles.

Driving by a drunk driver without a license or deprived of one - 30,000 rubles or arrest for 15 days. Drinking alcohol after an accident – 30,000 rubles or deprivation of rights for 2 years.

How to appeal?

You will always find the procedure for appealing a traffic police fine on the back of the decision. According to the law, this cannot be done officially via the Internet, although the traffic police website accepts complaints as a gesture of goodwill, but some are refused and asked to be addressed officially. Therefore, you should always remember that according to the law you are given 10 days to file a complaint, the period for consideration of electronic appeals is 30 days (plus 3 days for receiving appeals). This means that if the traffic police refuses to consider your complaint (and does so on a legal basis), then the period for the general appeal procedure will have already passed.
