Which cars do not require tachographs?

Please note that there is a list of exceptions, i.e. buses and trucks that do not need tachographs:

  • Trolleybuses;
  • Cars carrying out international transportation and equipped with “European standard” tachographs;
  • Military vehicles;
  • Cars of bodies carrying out operational investigative activities (police, FSB, FSIN, etc.);
  • Vehicles registered with state technical supervision (tractors and self-propelled vehicles);
  • Vehicles over 30 years old that are not intended for commercial transportation (for which a recycling fee is not paid);
  • Training vehicles not used for commercial transport;
  • Cars undergoing road tests.

Please note that earlier this list also included buses providing regular urban and suburban services. However, as of November 20, 2021, these vehicles are no longer included in the exemption list.

In addition to the vehicles listed above, there is another list of exceptions (based on the type of work performed):

  • Truck-mounted concrete pumps;
  • Truck mixers;
  • Asphalt distributors;
  • Truck cranes;
  • Ambulances;
  • Tow trucks;
  • Fire trucks;
  • Vehicles for public utilities and road maintenance;
  • Vehicles for servicing oil and gas wells;
  • Collection vehicles (for transporting money and valuable goods);
  • Vehicles equipped with lifts with working platforms;
  • Medical complexes on vehicle chassis;
  • Auto shops;
  • Buses for funeral services;
  • Car-homes;
  • Armored vehicles;
  • Specialized vehicles (specially equipped milk tankers, livestock tankers, vehicles for transporting poultry, eggs, live fish, machines for transporting and applying mineral fertilizers);
  • Category C trucks used by agricultural producers for on-farm transportation (transportation within the boundaries of the municipal district in which the vehicles are registered, as well as municipal districts bordering it);
  • Special vehicles;
  • Mobile laboratories and workshops;
  • Mobile television studios.

This list includes many specialized vehicles. There is no need to install tachographs on them and this will not entail a fine.

Exceptions when a tachograph is not required

The document in question also contains a list of exceptions in which it is not necessary to install a tachograph. And quite a few changes have been made to this list.

2. The following types of vehicles operated by legal entities and individual entrepreneurs are not required to be equipped with tachographs:

In the old version of the document, which is valid until December 31, 2020, the phrase “except” applies to absolutely all listed vehicles, including trucks and buses of individuals.

The new document directly states that exceptions apply only to legal entities and individual entrepreneurs, that is, exceptions for cars of individuals are cancelled .

However, this fits well with the change discussed above, which requires individuals to install tachographs only on trucks. And the list of exceptions includes vehicles that have a different meaning in the “vehicle type” field on the registration certificate (concrete pumps, milk tankers, etc.).

Changes made to the list of exceptions

Let's look at the changes that have been made to the list of vehicles that do not require installation of tachographs, in the form of a table:

This table makes it clear that the list of exceptions has become wider .

The only vehicle category that has been removed from the list is specialty vehicles. Although it must be said frankly that this category caused more problems than benefits. After all, the wording does not make it possible to understand what is meant by the phrase “special vehicles,” so many truck owners tried to “tailor” their vehicle to it.

Increasing the minimum age for “rare” cars

vehicles included in the list of types and categories of wheeled vehicles and chassis, from the year of manufacture of which 30 or more years have passed, which are not intended for commercial transportation of passengers and cargo, have an original engine, body and frame (if any), preserved or restored to the original condition and in respect of which the recycling fee in accordance with Decree of the Government of the Russian Federation of December 26, 2013 N 1291 “On the recycling fee in relation to wheeled vehicles and chassis and on amendments to certain acts of the Government of the Russian Federation” 2 is not paid;

vehicles not intended for commercial transportation of passengers and cargo, from the date of manufacture of which 50 years or more have passed, with an original engine, body and, if available, frame, preserved or restored to original condition;

Another major change affected the group of “old” vehicles that are not allowed to have a tachograph installed. Until December 31, 2021, this group includes cars over 30 years old, and from January 1, 2021, only vehicles over 50 years old .

That is, on New Year's Eve, cars aged from 30 to 50 years will “fall out” from the list of exceptions. And from 2021, they can only be operated if you have a tachograph.

As an example, consider a category C dump truck, manufactured in 1969 and not used for transporting goods (museum exhibit). The car is more than 50 years old, that is, from January 1, 2021, it will remain on the list of exceptions, and the legal entity that owns it will not have to install a tachograph.

If the same dump truck from the museum belongs to an individual, then the list of exceptions does not apply to it, and from January 1, 2021, a tachograph must be installed on the car.

Do you need a tachograph for a dump truck?

The most popular type of truck used in construction work is the dump truck. Let's consider whether a tachograph is needed for a Kamaz dump truck.

On the one hand, if a dump truck is used by a construction company building residential buildings, then it definitely needs a tachograph.

On the other hand, if Kamaz is used for public utilities, then its owner has reasonable questions. Is it possible not to install a tachograph in this case?

Please note that traffic police officers in many regions interpret the above list of exceptions as follows. Vehicles for public utilities and road maintenance include only vehicles with a specialized purpose. The same applies to vehicles for servicing gas and oil wells.

In accordance with this interpretation, the traffic police does not require the installation of tachographs, for example, on cars equipped with brushes for cleaning roads. However, the traffic police requires tachographs to be installed on dump trucks used in public utilities and imposes fines for their absence.

Do you need a tachograph for a personal truck?

Until November 1, 2021, the installation of tachographs was mandatory only for vehicles used by legal entities and individual entrepreneurs. Those. private owners would not need a tachograph.

However, from November 1, 2021, the following paragraph was added to the Law “On Road Traffic Safety”:

Individuals operating trucks whose permissible maximum weight exceeds 3,500 kilograms and buses are obliged to: ... ensure that the vehicles they operate are equipped with tachographs. Requirements for tachographs, as well as the procedure for equipping tachographs, the rules for their use, maintenance and control of their operation are established in the manner determined in accordance with paragraph ten of paragraph 1 of this article;

Thus, from November 1, 2021, a tachograph is needed

including personal trucks of category C and personal buses.

Who needs a tachograph: clarification of the 2021 law

In 2021, tachographs must be installed on all trucks weighing more than 3.5 tons. It follows from this that this requirement does not apply to popular Gazelle cars, since their mass is less.

The above rule has a number of exceptions. In particular, tachographs are not installed on trucks of any weight if they:

  • were produced 30 or more years ago and are not intended for commercial transportation (for which recycling fees are not paid);
  • used for educational purposes;
  • necessary for operational-search activities;
  • registered by the military department;
  • are freight trolleybuses, etc.

The 2021 law requires a private individual to install a tachograph if he either uses it himself for commercial purposes (for example, under an agreement with an organization for the provision of cargo transportation services), or provides the organization with his truck for a fee. If a citizen transports something on his own truck solely for personal purposes (boards to the country house, new furniture to his apartment, etc.), he has the right not to install a control device. Legal entities and individual entrepreneurs equip their cargo transport with it without fail.

Is a tachograph required for commercial transport in a personal vehicle?

Quite a common question. The driver buys a truck or bus for commercial transportation, but does not intend to register an individual entrepreneur or legal entity. Is a tachograph needed in this case?

Starting from November 1, 2021, the issue can be resolved quite easily, because... tachographs must be installed on all category C trucks and category D buses. That is, it does not matter who the owner is.

In addition, in the situation described above, the driver faces punishment for another violation - carrying out business activities without state registration (Article 14.1 of the Administrative Code):

Carrying out entrepreneurial activities without state registration as an individual entrepreneur or without state registration as a legal entity -

shall entail the imposition of an administrative fine in the amount of five hundred to two thousand rubles.

The size of this fine is comparable to the fine for not having a tachograph.

Traffic police fines

Violation of the tachograph installation procedure will result in administrative penalties. In 2021, traffic police inspectors have every reason to issue a fine:

  • for an AETR tachograph without an access card to international transport;
  • for a digital tachograph not enhanced by a cryptographic information protection unit;
  • for an analogue tachograph (in the vast majority of cases).

Fines for a tachograph in 2021 (for a device that does not meet the requirements, its absence, an attempt to block, correct the operation of the device, etc.), according to Article 11.23 of the Code of Administrative Offenses of the Russian Federation, will be:

  • from 1,000 to 3,000 rubles – for citizens;
  • from 5,000 to 10,000 rubles – for officials.

A driver who violates the work and rest schedule will pay from 1,000 to 3,000 rubles.

The procedure for equipping vehicles with tachographs

Federal Tachograph Law - 2021 and other acts

The issue of mandatory installation of tachographs became relevant several years ago. According to the order of the Ministry of Transport of the Russian Federation No. 273 dated August 21, 2013, a step-by-step plan has been developed for equipping various vehicles with them. In particular, it includes the following terms for installing control equipment on freight transport:

  • until 04/01/2014 – for trucks used for the transportation of dangerous goods;
  • until 07/01/2014 – for trucks weighing more than 15 tons used for international transport;
  • until 09/01/2014 - for trucks weighing more than 12 tons;
  • until 04/01/2015 – for trucks weighing more than 3.5 tons;
  • until 07/01/2016 - for trucks (plus buses) equipped with analogue tachographs;
  • until 01/01/2018 - for trucks (plus buses) equipped with digital control devices, but without cryptographic information protection means (CIPF).

That is, according to the law, from January 1, 2021, tachographs installed on trucks used in commercial transportation must be equipped with cryptographic information protection. Ignoring this requirement threatens violators with a fine in accordance with Art. 11.23 of the Code of Administrative Offenses (CAO). For citizens it varies from 1,000 to 3,000 rubles, for officials - from 5,000 to 10,000 rubles.

It should be noted that the law on tachographs from July 1, 2021 affected other vehicles - commuter buses, where they must now also be installed. And from July 1, 2019, city buses are also required to be equipped with monitoring devices.

Also, a new law on tachographs will soon come into force - from December 21, 2021. This refers to Law No. 398-FZ of December 20, 2017. It edited the 20th article of the Law “On Road Safety” of December 10, 1995 No. 196-FZ - in order to establish additional requirements to ensure safe driving of vehicles. And first of all, they will affect the installation of tachographs.
