Traffic police fines are prescribed in Chapter 12 of the Code of Administrative Offenses of the Russian Federation. At the end of last year, there were active rumors among motorists that fines for violations on the road would increase several times. The fears were not justified: from January 1, 2021, fines were left at the same amount and no new ones were introduced.

Amendments to the traffic rules concern the system for tracking violations. Now traffic police officers will be able to issue fines based on video recordings, not only from surveillance cameras located on the road, but also based on materials provided by third parties. True, there is one thing: video materials will have to be provided from devices on which the official program must be installed in advance. Carrying out an upgrade will be in the interests of the car owners themselves, because this will make it easier for drivers to prove their rights in controversial cases on the road.

Changes to fines related to traffic violations were last carried out last year, but in 2021, parliamentarians still have a number of issues left for consideration. They are associated with the concept of “dangerous driving”, as well as with punishment for repeated offenses. The first question has nuances related to the development of collection schemes, because the boundaries of that very “dangerous driving” have not yet been determined at the official level.

With the second question the situation is simpler. In essence, the deputies propose returning to the system that was in effect in the USSR. Today, rights are deprived for one serious violation, but parliamentarians propose to return the concept of “set of violations.” Drivers who make four or more minor mistakes in a year can have their license revoked.

Fines for owners of large vehicles may be revised

The Constitutional Court of the Russian Federation, in Resolution No. 5-P of January 18, 2021, recognized paragraphs 1, 2, 3 and 6 of Article 12.21.1 of the Code of Administrative Offenses as contradictory to the Constitution of the Russian Federation and, pending the necessary amendments to the Code of Administrative Offenses of the Russian Federation, ordered the courts to impose the smallest fine within the limits which are established for a legal entity . If the owner of a large vehicle is able to prove that he was transporting cargo for personal use, the fine must be imposed in the amount of the smallest possible fine provided for by these articles for drivers.

Traffic police fines

In 2021, traffic police fines for common violations of traffic rules (exceeding speed, violating the requirements of signs and markings, stopping and parking in prohibited places, etc.) did not change.
As for the fines given in the table above, they relate to fairly rare situations. For example, penalties have been seriously increased for drivers who, while intoxicated, caused accidents in which people died. For such a crime you can get up to 15 years in prison.

Introduction of the term “bike zone”

Based on the Decree of the Government of the Russian Federation No. 1478, from December 4, 2021, a new concept “bicycle zone” appeared in the Traffic Rules , within the boundaries of which the movement of vehicles is allowed at a speed of no more than 20 km/h, and a priority right for the movement of cyclists is established.

In order to mark such sections of the road, new signs “Bicycle zone”, “End of bicycle zone” and road markings duplicating them have been introduced.

The legislator also added clause 12.4 of the traffic rules, which provides for a ban on stopping motorists on paths designed for the movement of cyclists, as well as closer than 5 m from the intersection of a bicycle or bicycle-pedestrian path with the roadway.

Domestic companies are switching to full registration of OTTS only in electronic form. This was done to create a unified electronic database of cars as quickly as possible in 2021. The largest market players signed agreements between five parties. Now it will be possible to simultaneously approve the vehicle type and chassis. Now the digital economy is being introduced everywhere, so we decided to keep up in this direction with OTTS and OTSH. The pilot project has already been launched in early autumn 2021, but full operation will begin only on January 1, 2019.

What bills are currently under consideration?

As they say, what happens, cannot be avoided. The bills proposed by officials and approved by the Russian government are unlikely to be repealed. Of course, citizens will not be able to influence the situation, but it is still worth keeping abreast of important changes. This will allow you to prepare for all the surprises that the state is going to present to citizens, so that the expected innovations will not look like snow falling on your head.

1. Increase in excise taxes

One of the main and at the same time unpleasant innovations for drivers is the increase in excise taxes on fuel. The increase in the excise tax rate on diesel fuel will be 0.5 rubles. /l. According to experts, this will lead to an increase in the price of a liter of diesel fuel and gasoline by 0.6 rubles.

2. New term

They plan to add a new definition to the Rules. We are talking about the so-called “calm movement zone”. Of course, motorists should prepare for the appearance of an additional road sign prohibiting driving at speeds exceeding 20 km/h and overtaking. A pleasant bonus for pedestrians present in this area will be the ability to cross the roadway in any part of it. It is not yet known in what places we can expect the appearance of such signs.

3. A little about OSAGO

OSAGO policies, which become more expensive every year, will also change somewhat. Thus, they are proposed to be supplemented with a QR code, which will be located in the upper right part of the insurance form. The presence of such a mark will make it possible to receive online information about the MTPL agreement on the RSA web portal.

4. Fines and video recordings

Another bill adopted by the Government of the Russian Federation is the introduction of fines for recordings from video cameras owned by third parties. According to legislators, video recordings will only be accepted from devices on which a special program is installed (like DVRs). In addition, the owner of the device must be registered on the government services portal. It is reported that in this case, the participants in the accident will be exempt from drawing up a report.

5. Pre-trip check of drivers

Another requirement that will affect drivers in 2018 concerns passing medical control immediately before setting off on a flight. All drivers of commercial vehicles will be subject to pre-trip inspection. It is possible that examinations will be carried out using telemedicine and reports will be issued electronically. The main purpose of the examination is to identify diseases and factors that may prevent drivers from performing their direct duties.

Innovations for cyclists

Changes to the traffic rules concerning cyclists came into effect in 2021; from January 1, 2021, traffic police officers will issue fines for non-compliance. Cyclists become full participants in the movement. Special signs are even being developed for them - 5.33 and 5.34, which will be installed on the roads. Cyclists have an advantage over cars only in the “bike path” zone. When moving along the roadway (and this right has been enshrined in the traffic rules since 2021), cyclists are subject to the general rules established for transport. Now it will no longer be possible to park a bicycle on a bicycle path; it will be equivalent to parking on the sidewalk.

New GOST for road repair in Russia

The GOST project “Construction of asphalt concrete pavements under adverse weather conditions,” as well as methodological recommendations for the repair of road surfaces in Russia under adverse conditions, will come into effect this fall.

The development of the first part of the document was carried out by the Research Institute of Transport and Construction Complex (NII TSK). 8.9 million rubles were spent on the development of GOST.

The final version of the document will be reviewed in November 2021 .

The documentation mainly concerns the establishment of rules and requirements for carrying out repair work.

For example, the document contains the following features:

  1. Unfavorable weather conditions are considered to be temperatures from +5 to -10 degrees in spring and summer, and from +10 to -10 degrees in autumn and winter.
  2. Road repairs in such weather conditions must be carried out using special equipment prepared for transporting asphalt. Cars must be equipped with heated bodies and awnings.
  3. Before laying the top layer, the road surface will need to be cleared of snow and dirt. If necessary, it can be treated with reagents and dried using transport equipment.
  4. Repair work will be prohibited in case of frost, wind speeds above 6 m/s, as well as heavy precipitation with an intensity of more than 5 mm per day.
  5. Repairs on highways of categories 1A and 1B will be carried out only in the warm season.

Therefore, you should always remember that according to the law you are given 10 days to file a complaint, the period for consideration of electronic appeals is 30 days (plus 3 days for receiving appeals). This means that if the traffic police refuses to consider your complaint (and does so on a legal basis), then the period for the general appeal procedure will have already passed.

Although changes to the Rules have already begun to take effect, there are still differences in interpretation according to the traffic rules and according to the Order of the Ministry of Health. In the first case, disabled people of all groups have the right to hang signs of this kind, and in the second, only groups I and II, and in some cases III. However, indications at what exact moments are still unknown.

This sign, which is usually glued to the rear window of a car, gives the owner a number of advantages. Before the new rules, all citizens of the country could buy or print a yellow plate. However, now in order to get it you will need to go to an organization involved in medical examination. After confirmation of disability, she has the right to issue relevant documents. In addition, such signs will now be issued only at the place of registration, and when you move, you will have to go to the medical office to get a new one.

The difference between the sign itself will be that now the region code, personal number, data, and disability group will be indicated in the fields of the sign. This can eliminate the binding of the table to only one car, however, it will only work if the disabled person himself is directly inside the vehicle.

Extension of no-parking signs to persons with disabilities

Traffic regulations for disabled people assume that such a sign attached to the glass of a vehicle implies the possibility of using a specially designated parking space in public places. Previously, everyone could use this, relying on the luck of not being caught by the traffic police, because such a parking space is usually empty and is located as close as possible to the entrance. After the new resolution comes into effect, signs prohibiting parking, including on even and odd days of the month, will apply to all disability groups. Before this, only disabled people of groups I and II were excluded.

Termination of the Thorns sign

There have been discussions about changing this clause for more than 3 years. Moreover, before the introduction of the new rules, the installation of the “Ш” sign in the form of a triangle with a red border on a white background was mandatory if the car had winter tires with studs. This warned other road users that the vehicle would have a shorter stopping distance and should maintain a greater distance to avoid a collision. If earlier this sign really helped determine the braking distance, now it is almost always measured by the characteristics of the car itself, and not by the studs on the tires. As a result, the sticker itself now does not contain any meaning, and also contradicts traffic regulations, blocking the view when driving.

Changes in the rules for registering a traffic accident

One of the innovations introduced is to simplify the recording of road accidents without the participation of traffic police officers. It states that provided that those involved in the incident on the road have no claims against each other, if this is in accordance with the law on liability insurance of car owners, then the execution of all documents can take place without the presence of police officers.

It will be necessary to record, using a camera or other means, the position of the cars, their damage, objects, traces that will relate to the accident itself. At the same time, another change concerns payments under compulsory motor liability insurance. If previously you could get a maximum of 50,000 rubles, then with the introduction of new rules it will be 100,000. This can help reduce the burden on police officers and reduce traffic jams.

Important conditions for receiving payments are collisions of only two cars, in which no damage was caused to people; the damage will not exceed the maximum amount under insurance. In the event of disagreements, damage to infrastructure facilities and the absence of a compulsory motor liability insurance policy, it is impossible to register an accident without the participation of traffic police officers.

OSAGO in electronic form

Recently, insurance can be issued electronically. Although this innovation was prescribed in the MTPL itself, they forgot to indicate it in the rules themselves. This omission has now been corrected with a note stating that you will need to have a printed copy with you to give at the time of inspection.

Interesting! The contract does not specify what size the copy should be. Therefore, even if you make A6 format there will be no violation.

Behavior in case of an accident

Previously, a decree had already been issued regarding the availability of reflective vests, which should be worn in case of a traffic accident. Before the introduction of the order, the owner’s behavior had already been prescribed: the car should not be moved, the appropriate sign should be put up and indicated with an alarm. Now it is also stated that the driver must take all precautions when on the roadway. However, there is no penalty for violation.

Wheelchairs

When creating traffic rules, the definition of pedestrians included only persons who, among other things, move in special wheelchairs. It was written down separately that there should not be an engine. This is what prompted the government to slightly adjust the existing traffic regulations for 2021. After all, at that time there was no expectation that strollers could be controlled not only manually. Therefore, now, even if there is a motor, such a traffic participant will also be considered a pedestrian.

Summer mode - a ban on trucks entering the highway in the heat

On May 20, new rules for heavy trucks entering the highways came into effect. Now, under certain temperature conditions, trucks will be allowed on the roads only at night.

The corresponding order of the Federal Road Agency came into force on May 20, 2021 and will be valid until August 31. The so-called “summer regime” introduces temporary restrictions on the passage of trucks on some asphalt roads in Russia. By the way, this is not the first year that it has been introduced.

Important: be careful, if the daytime temperature exceeds +32 degrees, you should not go on the highway. The ban is valid from 10:00 to 22:00.

The innovation will protect Russian roads from rutting. Violating motorists will have to pay fines.
