What new penalties and changes will come into effect on November 20, 2021?

The network says that from November 20, 2021, according to changes in traffic rules, an inspector can issue a fine of 8,000 rubles for driving oncoming traffic (such a violation of the law is currently punishable by 5,000 rubles). Also, such a considerable fine awaits persons who drive over a continuous road or stop on the side of the road in unacceptable places. In addition, there is a fine for overtaking and shortening the road through a gas station.

Traffic inspectors noted that they had not heard about the increase in the fine by 3,000 rubles, and the news was fake. Passing a “stop line” marking following a traffic controller’s gesture or near a traffic light from the 20th will be punishable not by 800 rubles (according to today’s standards), but by 1.2 thousand rubles more. Department officials also disagreed with this information and called it false.

Motorists online discussed increasing the fine for driving without the appropriate documents. In Russia, such a violation is punishable by 500 rubles, but from November 20, 2021, drivers are convinced that the fine will increase by 7.5 thousand rubles. Such figures are absurd, so ministry workers noted that materials about what new fines come into force, deadlines and changes to traffic rules are posted on official Internet resources, and other sites may provide false information.

The new fine, according to drivers, will be an increase in payments for driving without a mandatory insurance policy. Today, for violating the norm, the maximum a Russian will pay is 800 rubles, but the network says about 5 thousand rubles.

Inexperienced drivers began to panic and share fake data with other people, but experienced people saw a catch in the information. This is not the first time that it has been said on the Internet that changes to traffic rules will take place on November 20, according to which fines will be increased several times. So far, no changes have been provided regarding penalties.

Is it all true?

No. No corresponding federal laws on changes to the Administrative Code have been adopted and are not planned.

New fines from November 20, 2021 are not true, a fake that appears almost every year with the same date.

What kind of fake are we talking about?! It’s all very simple - last year we already wrote a corresponding article about the increase in fines from November 20, 2017 against the background of the same excitement and mass indignation of drivers about the sudden and significantly increased sanctions.

We have no idea who is distributing this information as the primary source, but the fact remains that every year a wave of such posts sweep across the Internet on social networks, on forums and in chats and messenger groups:

  • new fines will appear on November 20 and will increase several times,
  • Amendments are being made to the Code of Administrative Offenses to approve these sanctions.

Will traffic police fines increase from November 20, 2021 or not?

A few months ago, news resources claimed that traffic police fines would be increased starting November 20, 2021. Now they don’t talk about this so confidently.

The whole point is that motorists themselves realized that, in principle, such high fines cannot exist. Moreover, there is no official information about such an increase on the Internet. And most importantly, the traffic police have already stated that they know nothing about the new fines. All this suggests that the information about new fines is fake.

Drivers can sleep peacefully. Nothing will change from November 20th. If you do not have a driver's license, there will still be a fine of 500 rubles. For exceeding the permitted speed of 60 km/h, the fine is from 2 thousand to 2.5 thousand rubles, and not 10 thousand as indicated in the table of supposedly new fines.

But we need proofs!

Of course, you don’t have to trust us either. Therefore, the false information about the entry into force of new fines in November 2021 must be proven. This can be done quite simply if you know the main thing - how changes to the Code of Administrative Violations officially come into force - and only it regulates penalties for traffic violations.

So, the procedure for amending the Code of Administrative Offenses is as follows:

  1. first, deputies develop a draft law, which is submitted for discussion to the State Duma,
  2. then the new law must undergo as many as 3 readings in the State Duma, during which the feasibility of the project is actively discussed at hearings; an indefinite but considerable time always passes between readings,
  3. if the draft law is not rejected at all 3 stages of readings - that is, the majority of deputies vote for the bill, then it is adopted by the Duma,
  4. then the law, which has already been assigned its own number, is signed by the President of Russia,
  5. now it must be published on the official portal of legal information,
  6. after 10 days or after a longer time specified in the text of the project itself, the Federal Law on Amendments comes into force, and only then new traffic police fines begin to apply.

And now the main thing! You will not find any draft laws of this kind anywhere: neither on the Government portal in the proposed drafts, nor on the official publication portal (clause 5 of the order of entry into force above), nor anywhere else.

According to the Administrative Code, the fines will be as follows:

  1. If you exceed the permitted speed by more than 20 km/h and up to 40 km/h - a fine of 500 rubles.
  2. If you exceed the permitted speed by more than 40 km/h and up to 60 km/h - a fine of 1000-1500 rubles. Repeated violation - a fine of 2000-2500 rubles.
  3. If you exceed the permitted speed by more than 60 km/h and up to 80 km/h - a fine of 2000-2500 rubles. An alternative may be deprivation of a driver's license for a period of 4-6 months. Repeated violation threatens with deprivation of rights for 1 year or a fine of 5,000 rubles in case of photo and video recording.
  4. If you exceed the permitted speed by more than 80 km/h - a fine of 5,000 rubles or deprivation of rights for 6 months. Repeated violation - a fine of 5,000 in the case of photographic and video recording or deprivation of rights for 1 year.

In addition to the established fines relating to punishment for exceeding a certain speed limit, a penalty may be imposed for ignoring the corresponding road sign, which limits the maximum permissible speed. The amount of exceeding the speed limit is not important in this case, and for such a violation an administrative penalty of 500 rubles is imposed.

Current fines

So, the current fines are valid both until November 20, 2018, and after this date - that is, nothing changes.

Exceeding the established speed of a vehicle by more than 60 but not more than 80 kilometers per hour entails an administrative fine in the amount of two thousand to two thousand five hundred rubles or deprivation of the right to drive vehicles for a period of four to six months.
  • Article 12.12 1. Driving through a prohibiting traffic light signal or a traffic controller's prohibiting gesture, except for the cases provided for in Part 1 of Article 12.10 of this Code and Part 2 of this Article, entails an administrative fine in the amount of one thousand rubles. …. 3. Repeated commission of an administrative offense provided for in Part 1 of this article shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period of four to six months.
  • Article 12.12 2. Failure to comply with the requirement of the Traffic Rules to stop in front of a stop line indicated by road signs or road markings, when there is a prohibiting traffic light signal or a prohibiting gesture from a traffic controller, entails the imposition of an administrative fine in the amount of eight hundred rubles.
  • Article 12.15 4. Driving, in violation of the Traffic Rules, onto a lane intended for oncoming traffic, or onto tram tracks in the opposite direction, except for the cases provided for in Part 3 of this article, shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles. for a period of four to six months.
  • Article 12.37 2. Failure by the owner of a vehicle to fulfill the obligation established by federal law to insure his civil liability, as well as driving a vehicle if such compulsory insurance is known to be absent, entails the imposition of an administrative fine in the amount of eight hundred rubles.
