What could be a fine of 1,500 rubles for 2021?

For speeding

In some cases of speeding, the Code of Administrative Offenses establishes fines of 1,500 rubles. In our case, Part 3 of Article 12.9 provides for such a fine for exceeding the speed by 40 to 60 km/h. For example, you were driving at a speed of 95 km/h when the speed limit was 40 km/h. The range of fines here ranges from 1000 to 1500 rubles.

It is worth noting, however, that if such an excess is recorded on an automatic photo recording camera, a letter with the decision will most likely arrive with the maximum amount of this fork. This is the practice.

For violating traffic rules

Part 1 of Article 12.15 of the Code of Administrative Offenses also provides for a fine of 1,500 rubles. At the same time, the interpretation of the violation is quite general, and it includes violations of an entire section of the traffic rules. Namely:

  • driving on the side of the road;
  • “wedging” into an organized transport or foot column;
  • driving around an obstacle in violation of traffic rules;
  • turning at an intersection from the second and further rows, if this is prohibited by traffic regulations;
  • if the driver did not occupy the outer lane to exit the road in advance;
  • violation of oncoming passing (from the Rules of the Road we must remember that, for example, if when going uphill there is an obstacle near the oncoming lane that makes it difficult for you to pass with oncoming cars, then you, as a person going downhill, are obliged to give way to the oncoming car).

For all these violations, except for turning from the second lane, fines are not received from the cameras, therefore, if the traffic police fine of 1,500 rubles was issued to you, then you simply could have forgotten when and under what circumstances it was issued to you.

For not allowing a slow-moving vehicle to pass other vehicles

Part 2 of the same article establishes a fine of 1,000 to 1,500 rubles for failure to allow a slow-moving vehicle or a vehicle with large cargo or a vehicle moving at a speed of less than 30 km/h to allow cars and motorcycles that it interferes with.

Such fines also do not come from cameras in 2021, but are issued by traffic police officers.

For prohibited left turn or U-turn

Part 2 of Article 12.16 provides for a fine of one thousand to one and a half thousand rubles for turning left or making a U-turn in violation of road signs or roadway markings.

For stopping or parking

A fine of 1,500 rubles without any forks is issued for stopping or parking in places where such is prohibited. The list of such places is quite extensive - from the highway to intersections and sidewalks.

A fine for stopping can come either from a photo/video camera recording violations by mail to the registration address, or it can be issued by an inspector. Discharged under Articles 12.16 and 12.19 of the Administrative Code.

For driving in the bus lane

More precisely, it is more correct to call it a lane for route vehicles, since not only buses move along it. The fine is issued when driving or stopping in such a lane and is a fixed amount of 1,500 rubles. But in Moscow and St. Petersburg, people are fined 3,000 rubles for this violation.

This is also one of the most common fines that come from cameras. It is provided for by Part 1.1 of Article 12.17 of the Administrative Code.

For not allowing a pedestrian to pass

...And a cyclist. Such failure to provide an advantage will cost 1,500 rubles, according to Part 1 of Article 12.18 of the Administrative Code. Such a fine also often comes from cameras recording violations, including portable ones.

Very often, the failure to provide an advantage, however, does not take place, and here it is good to see with your own eyes a snapshot of the violation being recorded. After all, failure to provide an advantage means that you forced the pedestrian or cyclist to change their trajectory or speed.   • in accordance with Part 1.3. Art. 32.2. Code of Administrative Offences, you can pay a traffic police fine (except for those that cannot be paid at a discount) at half of its cost if you do this within 20 days from the date of the decision (not coming into force!);
  • if a citizen is granted a deferment or installment plan in accordance with the norms presented in Art. 31.5. Code, you must pay within the deferment or installment periods specified by the court.

Deadline for payment of fine

How long. The driver, by law, pays the fine within 70 days from the date of the decision. The first 10 days are given to challenge the document; if this is not done, a fine must be paid in the next 60 days.

Discount on a traffic police fine in the amount of 1,500 rubles. All listed fines can be paid with a 50% discount in the first 20 days. This means that instead of 1,500, the driver pays only 750 rubles.

When does the discount apply? It is valid for the first 20 days.

Methods of paying the traffic police fine 1500 rubles

Based on Part 3 of Art. 32.2. Administrative Offenses Code, payment of a traffic police fine of 1,500 rubles in 2021 should be made:

  • to a credit institution (including through bank payment agents or subagents operating in accordance with Federal Law No. 161 of June 27, 2011);
  • via Russian Post;
  • through payment agents operating in accordance with Federal Law No. 103 of June 3, 2009.

Consequences of non-payment

In part 5 stat. 32.2. The Code of Administrative Offenses states two consequences that will occur if a traffic fine is not paid within the 60-day period established by law (if non-payment is made within the first 20 days after the resolution is issued, the right to a discount is simply lost, no further sanctions are provided):

  • The traffic police official, within 10 days, prepares a second copy of the resolution and sends it to the bailiffs for the purpose of forced collection of debt on the terms and in the manner provided for by Federal Law No. 229 of October 2. 2007;
  • At the same time, a protocol on an administrative offense is drawn up, liability for the commission of which is provided for in Part 1 of Art. 20.25. Code.

Note No. 1. Acts of officials in cases of administrative offenses in 2021 are equated to executive documents (clause 6, part 1, article 12 of Federal Law No. 229) and serve as a reason for initiating enforcement proceedings (Article 30 of Federal Law No. 229).

Note No. 2. The case according to stat. 20.25. The Code of Administrative Offenses will already be taken up by the court and will decide exactly how to punish the violator who is late in paying the traffic police fine in 2021:

  • impose a financial penalty in double the amount originally imposed (but not less than 1 thousand rubles);
  • arrest a citizen for up to 15 calendar days;
  • or assign compulsory work with a total duration of up to 50 hours.

Appealing a traffic police fine of 1.5 thousand rubles

Any decision imposing a monetary penalty (including in the amount of 1500) may be appealed in the manner established by Chapter 30 of the Code.

Since most penalties are imposed by an employee of the State Traffic Inspectorate right at the scene of the offense, you should file a protest:

  • or directly to this inspector, who within 3 days will be obliged to transfer the complaint and the rest of the case materials to a higher official (Part 1 of Article 30.2 of the Code of Administrative Offenses);
  • or immediately to a higher official or to the district court at the place of residence (Part 3 of Article 30.2 of the Code).

By the way, if you file a protest both here and there, then the judicial body will deal with the consideration (Part 2 of Article 30.1 of the Administrative Code).

In any case, it is difficult to “make a mistake” with the determination of the person authorized to consider - in any case, the protest will be transferred to the jurisdiction within 3 days (Part 4 of Article 30.2 of the Code).

The most important thing is to comply with the deadlines allotted for appealing (10 days from the date of the decision - Part 1 of Article 30.3 of the Code). However, if this period is missed, it can still be restored (subject to extenuating circumstances, for example, serious illness).

You will not have to bear any costs associated with filing an application to appeal a traffic police fine in 2021 - in accordance with Part 5 of Art. 30.2. Code of Administrative Offences, no state duty is charged.

The time frame for consideration of a protest depends on who will consider it:

  • 10 days – if a traffic police inspector;
  • 2 months – if the court (Part 1.1, Article 30.5 of the Code).

Based on the results of a single (Part 1 of Article 30.6 of the Code of Administrative Offences) consideration of the protest, one of the decisions specified in Part 1 of Art. 30.7. Code, which will be announced immediately. A copy of the decision is sent by mail or delivered directly to the traffic violator within 3 days.

Consequences of non-payment


In part 5 stat. 32.2. The Code of Administrative Offenses states two consequences that will occur if a traffic fine is not paid within the 60-day period established by law (if non-payment is made within the first 20 days after the resolution is issued, the right to a discount is simply lost, no further sanctions are provided):

  • The traffic police official, within 10 days, prepares a second copy of the resolution and sends it to the bailiffs for the purpose of forced collection of debt on the terms and in the manner provided for by Federal Law No. 229 of October 2. 2007;
  • At the same time, a protocol on an administrative offense is drawn up, liability for the commission of which is provided for in Part 1 of Art. 20.25. Code.

Note No. 1. Acts of officials in cases of administrative offenses in 2021 are equated to executive documents (clause 6, part 1, article 12 of Federal Law No. 229) and serve as a reason for initiating enforcement proceedings (Article 30 of Federal Law No. 229).

Note No. 2. The case according to stat. 20.25. The Code of Administrative Offenses will already be taken up by the court and will decide exactly how to punish the violator who is late in paying the traffic police fine in 2021:

  • impose a financial penalty in double the amount originally imposed (but not less than 1 thousand rubles);
  • arrest a citizen for up to 15 calendar days;
  • or assign compulsory work with a total duration of up to 50 hours.

Appealing a traffic police fine of 1.5 thousand rubles

Any decision imposing a monetary penalty (including in the amount of 1500) may be appealed in the manner established by Chapter 30 of the Code.

Since most penalties are imposed by an employee of the State Traffic Inspectorate right at the scene of the offense, you should file a protest:

  • or directly to this inspector, who within 3 days will be obliged to transfer the complaint and the rest of the case materials to a higher official (Part 1 of Article 30.2 of the Code of Administrative Offenses);
  • or immediately to a higher official or to the district court at the place of residence (Part 3 of Article 30.2 of the Code).

By the way, if you file a protest both here and there, then the judicial body will deal with the consideration (Part 2 of Article 30.1 of the Administrative Code).

In any case, it is difficult to “make a mistake” with the determination of the person authorized to consider - in any case, the protest will be transferred to the jurisdiction within 3 days (Part 4 of Article 30.2 of the Code).

Attention

The most important thing is to comply with the deadlines allotted for appealing (10 days from the date of the decision - Part 1 of Article 30.3 of the Code). However, if this period is missed, it can still be restored (subject to extenuating circumstances, for example, serious illness).

You will not have to bear any costs associated with filing an application to appeal a traffic police fine in 2021 - in accordance with Part 5 of Art. 30.2. Code of Administrative Offences, no state duty is charged.

The time frame for consideration of a protest depends on who will consider it:

  • 10 days – if a traffic police inspector;
  • 2 months – if the court (Part 1.1, Article 30.5 of the Code).

Based on the results of a single (Part 1 of Article 30.6 of the Code of Administrative Offences) consideration of the protest, one of the decisions specified in Part 1 of Art. 30.7. Code, which will be announced immediately. A copy of the decision is sent by mail or delivered directly to the traffic violator within 3 days.
