Is it possible to apply for compulsory motor liability insurance in another region?

Today, there are two ways to register compulsory motor liability insurance in another region:

  2. Carry out the procedure for drawing up a contract via the Internet and receive a motor vehicle liability policy in electronic format.

Keep in mind that any citizen has the right to draw up an MTPL agreement , and it does not matter at all whether he is the owner of the car or represents the interests of the owner under a power of attorney issued to him.

That is why, in the case when a person acting on the basis of a power of attorney draws up a civil liability contract, no matter in what region, the presence of the car owner at the conclusion of the transaction is not mandatory. In order to carry out compulsory vehicle insurance in another region, the policyholder must present to the insurance company employees a standard package of documents that are necessary to conclude this agreement.

Features of the procedure

Federal Law No. 40 of 2021 “On Compulsory Insurance” defines how to issue compulsory motor liability insurance for another region.   • unreasonable refusal to sell the policy.

The fines under this article are impressive - up to 300 thousand rubles per legal entity. You can attract an insurer by filing an application with the prosecutor's office. But again, for this you must have proof of an unjustified refusal. If an employee of an insurance company directly told you on video that he refuses to sell compulsory motor liability insurance because you are registered in another city or region, then you can bring him and his entire company to a fine, and also oblige you to conclude an insurance contract. If another reason is given, then, alas.

What the law says

According to the current legislation and Law No. 40 Federal Law dated April 28, 2017 “On compulsory civil liability insurance of vehicle owners,” a car owner has the right to receive an MTPL insurance contract in any place convenient for him throughout the country, without any obstacles or restrictions from insurance companies. companies. Lack of registration in the region where the contract is to be concluded does not give insurers the right to refuse to purchase a car insurance policy from them.

The Law on Compulsory Motor Liability Insurance establishes the basics that relate to compulsory insurance of motor vehicle owners.

The purpose of such relations is to provide protection to victims and compensate them for damage that was caused during the use of the vehicle (participation in road traffic and adjacent areas).

The law specifies the persons who may participate in these relations:

  • the owner of the vehicle, or the one who has a power of attorney to drive it. The person who operates the vehicle while on duty is not the owner;
  • driver. A person who drives a vehicle, but if he is trained, then the driver is a trainer;
  • victim. The person who was harmed.

Civil liability arises as a result of an insured event (causing harm to the victim) and obliges the insurer to pay the insurance.

The articles of the law consist of six chapters:

  • the first is the general position;
  • the second reveals in detail the procedure for compulsory insurance;
  • the third deals with payments;
  • the fourth describes the features and imposes requirements on insurers;
  • the fifth reveals the functions and powers of insurers;
  • The sixth chapter includes questions about the interaction of insurers with the relevant authorities, the procedure for international insurance, and the procedure for control that the owner of the vehicle bears under insurance.

Recently, changes have been made to the MTPL Law.

All vehicle owners must take out insurance, but there are exceptions for some vehicles:

  • whose speed is less than 20 km/h;
  • vehicles of the military and intended for military service in the authorities. Transport for business needs is not included in this category;
  • vehicles from abroad, provided that the owners are insured within the framework of international systems;
  • trailers for passenger cars.

The law considers in detail the procedure and amount of insurance payments. The amount of payments depends on the harm caused: to a person’s life, his health, or property.

The victim must document the harm that was caused to him or provide the damaged property for inspection. The insurer is obliged to pay the insurance within one month.

Do I need a diagnostic card for a new car?

A diagnostic card is not required for a new car. What is KBM?

BMC is an abbreviation for Bonus Malus Ratio. To put it simply, this is the break-even coefficient, which is assigned to each driver, information about which is stored in the RSA database. What to do if an insured event occurs under MTPL?

When an insured event occurs, you must:

  1. Make sure that no one is hurt, and if you are, call an ambulance and the police by calling the short number 112
  2. Do not remove the vehicle from the accident scene, and if it interferes with the movement of public transport, then first take video and photos of the accident site from different angles so that road markings, the position of the vehicles relative to each other and the road, as well as relative to the adjacent infrastructure are visible.
  3. Call the short number 112, inform the operator about the incident and call traffic police officers or other authorized services to the scene of the accident.
  4. If there are two participants in an accident and one of you admits his guilt, and the damage does not exceed 100,000 rubles (4,400,000 if the vehicle is equipped with DVRs and has a GLONASS system), then you do not need to call the traffic police officers, but use the EUROPROTOCOL.
  5. Obtain from traffic police officers or another authorized service a protocol or resolution on an administrative offense or a refusal to initiate a case. It is this document that is now the main one for the insurance company; a certificate of an accident is no longer issued.
  6. Call your insurance company and notify about the occurrence of an insured event. The insurance company operator will also advise on further actions.

What is EUROPROTOCOL?

EUROPROTOCOL is a procedure that allows participants to register an accident in a simplified form and without the presence of employees of the competent authorities. There are conditions for the possibility of applying the Europrotocol:

  • There were two participants in the accident and no harm was caused to the life or health of the participants;
  • One of the participants fully admits his guilt in the accident;
  • The damage to the victim, according to the preliminary and subjective assessment of the participants, does not exceed 100,000 rubles (400,000 if the vehicle is equipped with DVRs and has a GLONASS system);

The European protocol is drawn up by filling out a special form - notification of an accident - by both participants in the accident. Next, the injured party contacts their insurance company. It is important to note that both participants in the accident must notify their insurance company within 5 working days from the date of the insured event and, most importantly, not only the injured party, who plans to receive insurance compensation, but also the guilty party, who must contact their company and inform about the details of the insured event and send your copy of the accident notice. Otherwise, the insurance company, with one hundred percent probability, after settling the insured event, will present a claim for compensation for the culprit of the accident who failed to notify them.
