Meaning and coverage area of ​​the “No Stopping” sign

A sign prohibiting stopping of vehicles is presented in the traffic regulations under number 3.27 “Stopping is prohibited.” It looks like a blue circle with red edges, crossed out by a red cross.

In the area covered by the “No Stopping” sign, even temporary leaving of vehicles is prohibited, regardless of its category. Passengers and cargo cannot be boarded or disembarked. Only movement is possible. The essence of the restriction is simple - if the vehicle remains in place for even a short period of time, difficulties will arise for other vehicles. The designation is valid until it is directly canceled or until the next intersection, as well as until the beginning or end of a populated area or sign 3.31 “End of all restrictions.”

The restriction can be set in conjunction with various signs that make it more focused.

Thus, plates 8.4.1-8.4.8 determine the type of transport that is not allowed to stop in the area of ​​the sign. For example, 8.4.2. indicates that you cannot slow down when there is a trailer. This is most likely caused by a significant restriction of traffic flow in a particular lane or other circumstances that may interfere with other traffic.

The restriction is not always set due to problems with other vehicles. Sometimes stopping can be dangerous for the driver. If, for example, there is a sign 8.4.7, then, most likely, the danger is created for the cyclist, and not for those passing by.

Table 8.18 determines that a fine for stopping under a “No Stopping” sign will be assigned to everyone except drivers who are disabled. Additional guarantees for drivers with disabilities are established due to the availability of special social support from the state. It is more difficult for a disabled person to stop the car somewhere further and walk the extra distance; he may not have such an opportunity at all.

Table 8.2.4 defines the limitation area, as does 8.2.3. However, 8.2.3 states that the effect applies only to the part of the roadway in front of the sign, while 8.2.4 states that it applies both before and after.

When is a fine not imposed for stopping under a “No Stopping” sign?

A car is a technical device that can break down at any time. No matter how good the condition of the car, a malfunction can occur at any time, regardless of the driver. Accordingly, in 2021, vehicles can be left under the “No Stopping” sign without a fine in the event of the following malfunctions:

  • Braking system. Using a car with such a breakdown can create danger not only for the driver himself, but also for others, as well as for property. Accordingly, operation seems impossible.
  • Control, that is, the steering system. Similar to braking, driving a vehicle that has problems in this system seems very dangerous.
  • Headlights and tail lights. This especially applies to situations where visibility is difficult, for example, at night, during fog, rain, and so on.
  • Window cleaning system if there is precipitation or visibility is difficult without cleaning.

These violations allow you to stop where the law may prohibit. Continuing to drive with such malfunctions entails the creation of emergency situations, which is why the legislator allows forced abandonment until the problems are fixed or the vehicle is evacuated.

The concept of a forced stop is given in paragraph 1.2 of the traffic rules. The standards also provide for a certain procedure that the driver must perform in this case in order not to receive a fine for stopping under a “Stopping is prohibited” sign:

  • Turning on the alarm (clause 7.1 of the traffic rules). The action is performed by pressing a special button. Most often it looks like a circle on which a triangle is located and is done in red or orange.
  • Displaying an emergency stop sign (clause 7.2 of the traffic regulations). It must be available to drivers at all times. Its absence may result in the application of additional penalties. It looks like a triangle with red fields.
  • Taking all possible measures to eliminate the malfunction and clear the roadway (clause 12.6 of the traffic rules). The driver must remove the car from the road as quickly as possible. Amounts of fines for stopping and parking under a “No Stopping” sign in 2021

Violation of the rules provides for bringing the perpetrator to administrative liability on the basis of Article 12.19 of the Code of Administrative Offenses of the Russian Federation. The amount of the fine for stopping under a “No Stopping” sign in 2021 depends on the specific situation:

  • Violation of the rules, including leaving the car under sign 3.27 “Stopping is prohibited” - a fine of 500 rubles or a warning (part 1). It is considered a less severe offense, and therefore the amount of the fine seems less significant.
  • The same violation, if it entailed the creation of obstacles to other transport - a fine of 2,000 rubles (part 4). The violation is more serious because there is an additional person who is inconvenienced. Accordingly, the amount of recovery increases.

Theoretically, a person who was obstructed by an illegal stop can file a claim for damages if any were caused. However, there is practically no practice on such issues; it is very difficult to prove your position in such a situation.

First, let's consider the amount of punishment for braking in the wrong place. Today the law provides for the following amounts of recovery for an unauthorized stop, namely:

  • On tram rails or in close proximity to them - 1,500 rubles.
  • Not in the first row - 1500 rubles.
  • Within a radius of 5 m from the crossing point for pedestrians or on the sidewalk - 1000 rubles.

Car evacuation

A car left on the roadway under sign 3.27 “No Stopping” can create significant obstacles to traffic, provoke a high accident rate or even block the passage.

Violations for which a car can be towed are presented in Article 27.13 of the Code of Administrative Offenses of the Russian Federation. In Part 1, among the violations, Article 12.19 is listed, that is, violation of the rules of stopping and parking. However, we are not talking about point 1. The car can be towed only if it interferes with the passage.

Evacuation is carried out only if the owner or driver does not appear before the start of the procedure. However, a fine for stopping under a “No Stopping” sign may still be issued. Is it possible to stop under sign 3.27 “No Stopping” to disembark passengers in 2021?

Sign 3.27 suggests that not only parking is prohibited, but also stopping vehicles.

Paragraph 1.2 of the traffic rules establishes that a stop is a cessation of movement for up to five minutes or more, if this is required for unloading, loading or boarding passengers.

Parking differs in that it requires a longer period, from five minutes, and is not associated with loading cargo or boarding/disembarking passengers.

Sign 3.27 “Stopping prohibited” does not allow you to stop, even for a short period of time. Accordingly, passengers cannot be dropped off in its coverage area, otherwise a sanction may be applied to the driver for violating stopping rules.

  • in time (for example, at night);
  • depending on the type of vehicle (only official vehicles are allowed to stop);
  • distribution zone (before, before or after the pointer).

In addition to the fact that the sign prohibits stopping in a certain area, traffic rules also contain other types of prohibitions:

  • when the distance between the stopped car and the solid line (or the opposite edge of the road) is less than 3 meters;
  • at public transport and taxi stops. They are usually equipped with a special sign or marking. In this case, you cannot stop closer than 15 meters from such objects;
  • on the bike path;
  • on road structures: bridges, overpasses, overpasses, tunnels;
  • in that part of the road (except for the side of the road) where there is poor visibility of the path (no further than 100 m);
  • on tram tracks or near them when creating interference during traffic;
  • closer than 5 meters from intersections, except intersections with a solid line in the shape of the letter “T”. In this case, it is allowed to stop opposite the side crossing;
  • at a railway crossing, in an exclusion zone marked by traffic lights and barriers;
  • on the territory of pedestrian crossings and closer than 5 meters before them;
  • when obstructing the movement of vehicles;
  • when blocking the view of other drivers.

Is it possible for disabled people to stop under a “No Stopping” sign?

The legislator provides for a number of concessions for people with disabilities regarding compliance with traffic rules. Some of them also concern leaving the car without moving.

Appendix 1, Section 3 of the Traffic Regulations contains exceptions. Thus, the effect of sign 3.28 does not apply to cars equipped with a special “disabled person” designation, that is, they can park the car where others are prohibited from doing so.

In 2021, the law does not allow citizens with disabilities to park their cars under sign 3.27 “Stopping is prohibited” and prescribes the imposition of a fine. The reason is simple - such abandonment may result in the creation of obstacles on the roadway. Allowing such an action would significantly infringe on the rights of other road users who would be hindered in their movement.

Appealing a fine and evacuation

The procedure for appealing a fine for stopping under a “No Stopping” sign in 2021 is as follows:

At the end, a list of applications is indicated, followed by a signature and date. The appendices must contain all the papers that in one way or another relate to the issue, including the resolution itself.

In accordance with Part 1 of Article 30.3 of the Code of Administrative Offenses of the Russian Federation, a complaint can be filed within a period not exceeding 10 days from the moment the decision was received. Nuances

Sign 3.27 “Stopping is prohibited” prohibits leaving vehicles in the coverage area. Its use may seem like an obvious procedure, but there are some peculiarities that need to be taken into account:

  • You cannot stop to pick up/drop off passengers or load/unload goods. Accordingly, parking is prohibited as a longer option for maneuver.
  • Some signs may indicate vehicles covered by the sign, meaning they are the only ones not allowed to stop. Others make exceptions, that is, they indicate that the sign applies to everyone except a certain type of transport.
