What is the new law about the “Disabled” sign?

This is not the law. That's an order. Its official name is “On approval of the Procedure for issuing the identification badge “Disabled” for individual use.” Number 443N. This order was developed on August 24, 2021 and came into force on September 4 of the same year. The regulatory act appeared against the backdrop of changes in the Federal Law “On Social Protection of Disabled Persons,” which also underwent changes.

The full official text of Order No. 443-N, current for 2021, is given below, and now we will explain what’s new with the entry into force of this legal act.

Who can receive the badge?

Disabled people of groups I and II, as well as, in some cases, disabled people of group III with a confirmed disability can hang a corresponding sign on their car.

In this case, he can still receive a badge - the Order does not link the receipt of this identification badge to a specific vehicle, but only to a specific person.

In this case, the person can simply carry it with him and hang it on any car that transports it. The order, of course, takes into account the subtlety when the “Disabled Person” sign can be equipped not only with a car belonging to this person, but also with any car transporting a disabled person (clause 1 of the document). This is especially true, for example, for disabled children.

Where can I get a disabled sign?

To obtain a “disabled person” badge, you need to collect a package of documents. If it is not possible to personally provide documents, this can be done through a proxy. To do this, you need to contact a notary and draw up a power of attorney. Next, you should select the ITU office at a convenient address for you.

An application for a disability badge is sent to the bureau. The application will be registered and within 1 month a decision will be made on the submission of the mark. If the decision is positive, you will be notified in any way convenient for you. Notice may be sent by mail, given in person, or by other means. The sign is issued the next day after its production.

The sign is issued only if there is an opinion from ITU experts. Additionally, it is not necessary to undergo an examination to obtain the mark.

When a disabled person is given a badge, data on the transfer is recorded in a special journal. It can be presented in both electronic and paper form. When it is in electronic form, managers can easily check it. The paper version has numbering and stitching. For any document, regardless of form, a signature is required.

Where to get it?

In a special institution called the “Bureau of Medical and Social Expertise” (hereinafter referred to as the ITU Bureau). The institution itself is presented in the form of 3 specific organizations:

  1. branches of the bureau in regions and cities, where on May 28, 2021 you can receive the identification badge “Disabled” in normal situations and where you should contact first,
  2. the main bureau - contact here when appealing decisions by branches and if additional examinations are required,
  3. Federal Bureau - here you can get a “Disabled Person” badge if you need to appeal the decision of the main branch of the institution, or in particularly difficult cases of establishing disability.

You can receive the badge at your place of residence - that is, at any branch, regardless of the place of registration.

How to get a “disabled person” badge

Similar signs are issued by the Bureau of Medical and Social Expertise (ITU). To obtain a disabled sign, you need to contact your local ITU branch. The ITU Public Bureau is contacted if there are complaints against the local branch and if additional examination is necessary.

The Federal Bureau of ITU of the Ministry of Labor and Social Protection should be contacted with questions that relate to the decisions of the main bureau.

To receive a disabled sign, you should submit an application to any of the above organizations. The registration address of the citizen submitting the application, as well as the address of his actual residence, do not matter.

How to get a?

To do this, as we mentioned above, you need to contact any branch of the ITU Bureau with a written application. The application contains all the standard information - from the full name of the disabled person and his residential address to the insurance policy number.

Also, when applying, a disabled person will need:

  • passport or birth certificate,
  • certificate of disability.

After submitting the application, a sign is produced and issued, according to the regulations, no more than within one month. But it also takes time to register the application itself.

How and where to get a badge

If previously the “Disabled” sign was available to buy on the open market and it did not have a registration number and did not contain any personal data, now, according to new regulatory documents, the provision of new stickers is the responsibility of the territorial representative office of the medical and social examination in Ryazan, which confirms and assigns disability groups.

The paperwork is completed at the place of permanent registration of a person with a disability; the entire process is allotted a period of up to one month from the date of registration of the submitted application. You can receive the sign directly within 1 business day from the date of registration of the permit.

The decision to remove the sign from retail outlets is intended to reduce the number of violations related to the misuse of the benefit.

What does the new “Disabled” sign look like?

Just like the old one, but with a number of changes. So, now the sign is written in handwriting on the front side:

  • sign number,
  • the date of expiration of the disability,
  • region of issue.

And on the back:

  • Full name of the disabled person to whom the badge was issued,
  • date of birth,
  • disability certificate number,
  • group,
  • period of disability,
  • date of issue of the sign.

If you lose your sign

Nothing will happen. The current legislation for 2021 does not provide for a penalty for loss. In this case, the bereaved person should contact the ITU Bureau for a duplicate of the “Disabled Person” sign. Then, in the corner of the new sign, replacing the lost one, the signature “Duplicate” is placed, and the old one is declared invalid.

Also, a new sign will have to be obtained if the disabled person changes his place of residence.

What other documents are required to obtain the “Disabled Person” badge, besides the application? In addition to the fact that you or your representative have completed the application, you must have other documents with you:

Worth knowing! A citizen must receive a special plate for a car within the period established by law, which cannot exceed 1 month after sending a written application.

You can apply for a “Disabled Person” badge through State Services, but to receive it, you will still have to appear at the MSEC office, which issues the certificate. Not only the applicant, but also his legal representative can do this, just like filling out an application.

Where and how can I get the “Disabled Person” identification badge now?

This sign confirms the right to free parking for vehicles driven by disabled people of groups I, II, as well as disabled people of group III (in the manner established by the Government of the Russian Federation), and vehicles transporting such disabled people and (or) disabled children.

Let us remind you that at each parking lot (stop) of vehicles, including near residential, public and industrial buildings, structures and structures, including those in which physical education and sports organizations, cultural organizations and other organizations, recreational facilities are located, at least 10% of spaces (but not less than one space) for free parking of vehicles driven by disabled people, which should not be occupied by other vehicles.

The specified sign will be personal; detailed information about the person to whom it is issued will be placed in its fields: last name, first name, patronymic of the disabled person (disabled child); date of his birth; series and number of the certificate confirming the fact of disability; its group and the period for which it is set. In addition, special identification details will be indicated in the margins of the mark, including the serial number of the mark, the code of the subject of the federation where it was issued and the year of its issue, the number of the ITU bureau that issued the mark, and a number of other information.

An application for registration of an identification badge “Disabled” must be submitted to the bureau of medical and social examination at the place of residence (place of stay, place of actual residence) of the disabled person (disabled child). The mark must be issued within a period not exceeding one month from the date of registration of the application. The sign will be issued within 1 business day from the date of its registration. At the request of the applicant, the completed sign may be sent to him by registered mail.

In the main bureau of medical and social examination, the registration of the sign will be carried out in case of an appeal against the decision of the bureau, as well as in the direction of the bureau in cases requiring special types of examination, and in the Federal Bureau - in the case of an appeal against the decision of the main bureau or in the direction of the main bureau in cases requiring particularly complex special types of examination.

When re-examining a disabled person (disabled child) at the end of the disability period, and establishing disability for the next period, at the request of the disabled person (disabled child) or the legal or authorized representative of the disabled person (disabled child), a new sign is issued.

There are requirements for the content of the application for registration of a mark, a list of documents submitted along with the application is provided, and the procedure for issuing a duplicate of the mark is established.

Information about the issuance of a badge (its duplicate) and the invalidation of a lost (damaged) badge will be posted in the federal state information system “Federal Register of Disabled Persons.”

The order came into force on September 4, 2021.
