So, the law does not provide restrictions on driving an all-terrain vehicle on highways or city roads. However, manufacturers of such equipment prohibit this, stipulating it in the instructions. Changes to the Administrative Code: violators on ATVs will face increased fines
The bill, adopted by the State Duma of the Russian Federation in the first reading, covers ATVs, all-terrain vehicles, snowmobiles and other “off-road motor vehicles.” Such special equipment is not intended for driving on ordinary roads; its registration is handled by Gostekhnadzor, and owners are required to send the vehicle for inspection. To drive these vehicles you need to obtain a tractor driver's license. All these rules, prescribed in government decrees, are still in effect, but now they want to transfer them into a separate rule that will apply at the federal level.
As Kommersant reports, citing Gostekhnadzor data, by the beginning of this year, over 2.5 million different “self-propelled vehicles” were registered in Russia. Of these, various off-road special equipment (including snowmobiles, all-terrain vehicles and ATVs) account for 626 thousand units.
In accordance with the new law, they plan to include tractors, municipal and agricultural machinery, so-called “off-road motor vehicles” with an engine capacity exceeding 50 cm3 or with electric motors with a power of over 4 kW, to the list of “self-propelled vehicles”.
To obtain the tractor driver license required by law, you will need to complete a training course and pass the appropriate exams. At the same time, the procedure for conducting examinations, vehicle registration and technical inspection must be approved by the government in a separate document. Persons over 16 years of age will be able to register self-propelled vehicles (it is assumed that the passport may also be electronic, like new cars today).
The new norm for owners of ATVs and other similar equipment promises to be a “prohibition of operation”: it is expected that such a measure will be used if the inspection engineer discovers some malfunctions during the inspection (their list must also be approved by a resolution of the Cabinet of Ministers). Another such prohibition will apply when driving an unregistered car, or when driving without a license. It is not yet clear how exactly the “prohibition of exploitation” will be implemented; it is only reported that the decision will be made in court at the request of the inspector.
Let us note that now violators of the rules driving ATVs and other self-propelled vehicles are punished in accordance with Article 9.3 of the Code of Administrative Offenses; the punishment can be deprivation of rights for a period of 3 to 6 months, or a fine of 100-300 rubles. Very soon, on April 16, amendments will come into force, according to which the amount will be increased to 1 thousand rubles (the State Duma of the Russian Federation adopted the changes back in 2021).
To register a self-propelled vehicle, you will need a compulsory motor liability insurance policy (we are talking about cases where the presence of a document is provided for by current rules). The RSA explained that the “autocitizen” is not needed on vehicles that do not accelerate more than 20 km/h and do not have wheels, but instead use, for example, tracks.
In the meantime, an updated version of the Code of Administrative Offenses is still in the preparation stage, which should change a lot in the lives of Russian motorists. The authorities have not yet announced exactly when the new norms will come into force.
