How to restore rights if lost in 2021

Good afternoon, dear reader.

This article will talk about the unpleasant situation that some car owners have to face, namely the loss of their driver’s license. At the same time, the mood is spoiled both by the loss of the document itself and by the recovery procedures that need to be done in the future.

In this case, it does not matter what happened to the old ID: whether it was lost due to negligence, stolen by your ill-wishers, or lost due to a natural disaster.

The main task of the driver in any case is the timely restoration of lost rights, because Without this document, driving vehicles is impossible.

Let's consider the actions that need to be taken in 2021 to restore a driver's license if lost:

  • What to do if you lose your driver's license?
  • Obtaining a temporary permit to drive a car.
  • Driver's license restoration: Where to go?
  • What documents are needed?
  • What is the price?
  • Receiving a discount.
  • Exams passage.
  • For how long is a new certificate issued?
  • Penalty for loss of ID.
  • To begin with, I would like to note that a driver’s license, like all other personal documents, must be stored in a sufficiently secure place to minimize the possibility of its loss or theft. However, this phrase is little consolation for a person who has already lost his rights and does not know what to do.

    What to do if you lose your driver's license?

    The first action that needs to be taken in the absence of a driver’s license, no matter how paradoxical it may sound, is that you need to make sure whether the license is really missing .

    Try to remember where and under what conditions you last saw or could use a document, examine the relevant places:

    • clothing pockets;
    • bags and wallets;
    • vehicle interior;
    • shelves and bedside tables where documents, keys, phones, etc. are usually stored.

    Don’t be surprised, but I know of dozens of cases where a driver’s license simply fell under a car seat or behind a sofa, and was found only after receiving a duplicate from the traffic police.

    If the driver can find the license on his own, he will save on paying the state fee and will not lose at least one day of time. In general, it will be much more effective to “rummage” through the entire apartment than to immediately contact the examination department of the traffic police.

    Naturally, it makes sense to search for rights only if you have lost them. If the document is stolen and you are sure of it, then there is no point in looking for it under the chest of drawers.

    If your driver's license is stolen, you can contact the nearest police station with a corresponding statement. Whether to do this or not is up to you. In this case, I can only say that such an appeal will take up your time, and whether it will lead to any results is a big question.

    If the lost license was not found on your own, you must contact the traffic police to obtain a new document.

    Obtaining a temporary permit to drive a car

    Just a few years ago, when reinstating a lost driver's license, a temporary permit was required for 1 or 2 months. Moreover, for issuing a permit it was necessary to pay a fee of 800 rubles.

    In 2021, this fee was abolished, and all references to the permit were excluded from regulatory documents. Therefore, no temporary permit will be issued .

    If your driver's license or car documents are stolen, you need to immediately contact the traffic police. If attackers use the “book” and violate traffic rules, fines and sanctions will be imposed on the direct owner of the license.

    As a rule, the process of restoring a lost ID begins with a visit to the nearest police station and filing a report of theft. It must contain the following information:

    1. Full name of the driver's license holder;
    2. registration address;
    3. circumstances of the theft;
    4. the identities of the suspects;
    5. a complete list of stolen valuables.

    Describe the situation without emotion and in as much detail as possible: this will help the investigation. When the application is assigned an incoming number, ask the authorities for a copy.

    After studying the details of the case, law enforcement agencies make one of two decisions. You may be refused to initiate a criminal case because your rights are not recognized as material value, or an investigation may be launched. Both answers allow you to begin the procedure for restoring rights.

    Be sure to get a resolution from the police to initiate a case or to refuse: this document must be presented to receive a new document.

    Where to contact?

    The first important question is where you can restore your driver’s license if it is lost. Currently, this can be done in any traffic police department in the country:

    3. Conducting examinations for persons permanently residing in the Russian Federation, issuing Russian national and international driver’s licenses and exchanging foreign driver’s licenses are carried out in the departments of the State Traffic Inspectorate at the place of application of these persons.

    Conducting examinations for persons temporarily residing or temporarily staying on the territory of the Russian Federation, issuing Russian national and international driver's licenses and exchanging foreign driver's licenses are carried out in departments of the State Traffic Inspectorate located within the constituent entity of the Russian Federation in which these persons temporarily reside or are temporarily staying.

    In this case, it does not matter whether you have registration at your place of residence (propiska) in the selected subject of the Federation. Rights will be restored in any case.

    First of all, the driver should report the theft to the local or district traffic police department. In practice, there are cases when a stolen document is used by another person. And while committing violations

    If the fraudster is stopped by unsuspecting traffic police officers and fines him, then the driver whose license was stolen will have to pay for it.

    Therefore, you need to notify traffic police officers about the theft of this document as soon as possible.

    The notification is a corresponding statement in writing describing the incident. You must indicate the place and date of the theft.

    If the driver does not know the exact location of the theft, then tentative data should be provided. If any other things were stolen with the ID, then this fact should also be recorded.

    If a specific person is suspected of theft, the statement shall indicate the facts known about him. This is necessary to make it easier for the police to find the attacker.

    Sometimes victims, due to their confusion, cannot find the words themselves and write a statement. In this case, you should contact the duty station of the district police department with a request to write this document.

    The officer on duty is required to register the citizen’s appeal and forward it to the responsible officer. The investigator will already file a theft case and other related documents.

    It is worth remembering that the outcome of the application will depend on the testimony of the victim. As a result, either a criminal case will be initiated, or the initiation of such a case will be refused.

    It is necessary to clearly formulate the situation that occurred. However, in order to obtain a duplicate driver's license, the investigator's conclusion will not have any significance.

    Contacting the police

    If you discover that your driver's license is missing, you should contact the police department at your location. However, this can only be done if you are clearly sure that your documents have been stolen. Try to leave the car where it is and not touch anything: the Ministry of Internal Affairs may need to take fingerprints if the theft was committed by breaking into the car.

    Let's take a step-by-step look at how to contact the police:

    1. Leave the car where it is if you suspect or there is direct evidence of a break-in followed by theft of documents.
    2. Find out where the nearest police department is located in your area. You can get information through the online services of the Ministry of Internal Affairs or by calling 102.
    3. Come to the police department and write a statement. You need to take your passport with you, but if you don’t have it with you, you can bring it in later. The most important thing is to report the crime as quickly as possible.

    Further actions depend on the police officers and the specific situation. They may “forget” about the matter and simply not deal with it. If you find a responsible investigator, you will have to go to interrogations and participate in other investigative activities as a victim.

    If you contact the police, you will not be issued a temporary license during the investigation. They have been abolished since 2014, and now citizens whose documents were stolen must restore them through the traffic police themselves.

    How to write an application?

    The application must contain complete information about what happened and comply with the requirements established by the Code of Criminal Procedure of the Russian Federation and other legislative acts.

    What information will he need:

    • Full name, position and title of the person to whom it is sent;
    • Full name, actual residence address, telephone number of the applicant;
    • Date and place of discovery of the loss, preferably details of the driver’s license (if available);
    • When was the last time you saw the document;
    • Signs of the criminal (if you saw the kidnapping).

    The victim's signature is placed at the end of the application. It must be handed over to the investigator or inquiry officer who will be involved in the case.

    In order to continue operating the vehicle, the driver must restore the stolen document.

    To do this, he needs to contact the traffic police department located at the place of registration of this citizen. Traffic police officers usually provide a sample for drawing up this document.

    However, if there is no such sample, then the application should indicate:

    • details of the victim (full name, date and place of birth, legal address and personal passport details). This information should be located in the header of the application along with the appeal to the responsible authorities;
    • details of the stolen driver's license (series, number). This information can be found on your vehicle insurance policy;
    • reason for replacing the document (theft);
    • list of attached documents. This describes the documents that are needed to restore your driver's license. Typically, they are a passport and a receipt for payment of state duty.

    At the very end of the application, the place and date of document theft (alleged or exact) and the circumstances of the incident are stated.

    Errors and corrections must not be made in an application for theft of a driver's document; this may serve as a basis for refusing to issue a duplicate driver's license.

    The final part of the application will be the date and signature with a transcript of the victim. The date must coincide with the date the document was written.

    How to fill out an application correctly

    In general, writing an application to the traffic police department is not difficult, because the authority provides a sample to fill out. But we will look at what information you will need to provide to receive a new ID. It is important to write only reliable information, because all data will be double-checked by traffic police officers.

    Filling principle:

    1. First, you must provide information about the applicant. Enter your last name, first name and patronymic, date and city of birth, place of residence, passport details.
    2. It is necessary to enter information about the stolen rights, that is, the series and number. If necessary, you can find information in your car insurance.
    3. Reason for replacement. In this case, theft (or loss).
    4. List of official documents that are attached to the application.
    5. Place and date of document theft, as well as the circumstances of the incident.
    6. The date the application was submitted, as well as the person’s signature.

    After this, the completed application should be submitted to the traffic police along with other official papers. The employee will review the documents and accept them. After this, you just have to wait until the new rights are issued.

    Where to submit

    Today, it is believed that the place of registration does not matter when applying to the State Traffic Inspectorate.

    It turns out that the victim can apply for a duplicate driver’s license to any nearest traffic police department, even if the driver is currently in a completely different city.

    However, persons with temporary registration are required to apply to the traffic police department that provides services directly to citizens with such registration.

    What is the price?

    In addition to the documents listed above, to obtain a new certificate you will need to pay the appropriate state fee:

    for the issuance of a national driver's license, including in replacement of a lost or unusable one:

    made from plastic-based consumables - 2,000 rubles;

    made from new generation plastic-based consumables – 3,000 rubles;

    In 2021, only plastic driver's licenses will be issued in the Russian Federation. At the same time, for issuing a new generation document (with a built-in storage medium) you will have to pay 3,000 rubles, for issuing ordinary plastic licenses - 2,000 rubles .

    Receiving a discount

    When restoring your ID through the government services portal, you can get a 30 percent discount on the state fee. Those. The production of a driver's license in this case will cost 1,400 rubles . The discount is valid from January 1, 2021 to January 1, 2021. You can find out more about it in this article.

    Please note that the document confirming payment of the state fee is not in the list above, but I recommend taking it with you. The fact is that before issuing a license, the traffic police inspector must receive information about the payment through the system of interdepartmental interaction. However, in practice, electronic failures are possible, the payment may not be processed in time, etc. This, in turn, may cause a delay in the restoration of the ID. So take your payment receipt with you, it's easy.

    Once all documents have been submitted, you must wait for the new driver's license to be issued.

    Exams

    you do not need to take qualifying exams , i.e. You can forget about traffic rules exam tickets at this stage with a clear conscience.

    What documents are needed?

    To restore a driver’s license to replace a lost one, you must provide the traffic police with the documents listed in paragraph 30 of the rules for conducting examinations for the right to drive vehicles and issuing driver’s licenses:

    30. To issue a Russian national driver's license to replace a previously issued Russian national driver's license, the applicant provides the following documents:

    a) statement; b) passport or other identity document; c) medical report. In the cases provided for in subparagraphs “b” - “d” and “f” of paragraph 29 of these Rules and subparagraph “d” of this paragraph, a medical report is provided at the request of the applicant; d) Russian national driver's license (if available); e) diplomatic, consular, service cards or certificates issued by the Ministry of Foreign Affairs of the Russian Federation - in the case where the applicants are employees of diplomatic missions and consular offices of foreign states in the Russian Federation and members of their families, employees of international organizations and their representative offices accredited with the Ministry of Foreign Affairs of the Russian Federation, and members of their families; f) a document confirming the availability of a benefit for paying state duty - for persons who, in accordance with the Tax Code of the Russian Federation, have a benefit for paying state duty.

    Statement. In this case, the application must indicate that you are asking for a driver’s license to replace the lost/stolen one. Detailed information on completing the application is provided in this article.

    A passport is necessary so that employees can verify that it is the driver who is applying to obtain a license.

    A medical certificate currently not required . You can find out more about this in the article “Cancellation of a medical certificate when replacing rights.”

    However, the certificate can be provided to the traffic police at the driver's request . If there is a certificate, new rights are issued for the full term, i.e. for 10 years.

    Driver's license. It will not be possible to provide this document to the traffic police, as it is lost.

    A document confirming completion of training in 2021 is not required, because... all information about issued rights is contained in the traffic police database. However, if the license was issued a long time ago, it makes sense to take your driver’s card with you.

    In this case, we are talking about the loss of rights issued 20 or more years ago, when the traffic police did not yet use databases.

    Such cases are quite rare, because licenses are valid for 10 years and 99 percent of drivers make changes in a timely manner.

    Possible difficulties in obtaining a new certificate

    If your license has been stolen, be prepared that the process of issuing new ones will be delayed for two months or more. If you do not present the traffic police with any of the documents listed in the list, the duration of the procedure will increase.

    Traffic inspectors proceed from the assumption that the driver’s license was not stolen, but was confiscated for traffic violations. They will not issue new licenses until they have checked the owner’s background against all existing databases and are convinced of his integrity.

    Experienced drivers are advised to make sure that you have no outstanding fines before applying for a duplicate license. If you have not paid your obligations in full, you will have to do so to obtain a new certificate.

    Driving without a license is considered an administrative offense in accordance with Article 12.3 of the Code of Administrative Offenses of the Russian Federation. It is punishable by a fine for the citizen who is driving, and the car is sent to a parking lot. If you do not want to switch to using public transport exclusively, take care of obtaining a temporary permit to drive a vehicle in advance.

    To receive it, you must submit to the MREO employees an application for the issuance of documents and a receipt confirming the transfer of the state duty. A temporary permit has the same legal effect as a permanent license. It must be presented to the traffic inspectors along with your passport. The only exception is that it does not give the right to drive abroad.

    Driver's license restoration:

    Exams

    you do not need to take qualifying exams , i.e. You can forget about traffic rules exam tickets at this stage with a clear conscience.

    What to do if you lost your driver's license, and is it possible to drive?

    1. How to restore a driver’s license if lost?

    Restoring a driver's license if it is lost is a standard procedure, equivalent, for example, to replacing it before it expires. New rights can be obtained in two ways: by personally contacting the traffic police department or by submitting an application through the State Services portal.

    In case of personal application, you will first need to pay a fee of 2,000 rubles for issuing a new license, and then visit a traffic police department convenient for you, having with you a passport and a receipt for payment of the fee. When applying, you will need to fill out an application for a new driver's license (the form is issued on site) and attach a passport and receipt to it - the certificate will be issued to you on the same day.

    If your rights are restored through State Services, you will need to submit an application for a driving license electronically and choose a date and time convenient for you to visit the traffic police. Before visiting, you will also need to pay a fee, and when visiting the traffic police, have your passport and payment receipt with you.

    2. How to save money when renewing your driver’s license?

    When submitting an application for a new license through the State Services portal and paying the state fee non-cash, you can get a 30% discount: in this case, the certificate will cost you not 2,000, but 1,400 rubles.

    3. Is it possible to drive a car if you have lost your license, and what is the fine for this?

    Driving a car without a license is, of course, a violation, but not a very serious one. Part 2 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation states that “ driving a vehicle by a driver who does not have documents for the right to drive it entails a warning or the imposition of an administrative fine in the amount of five hundred rubles .” Therefore, if you find that you do not have a license, then it is better to refuse to drive a car. But if you, for example, are moving along a country highway, then you can continue driving - you just have to remember that meeting with a traffic police inspector means a fine for you. At the same time, the received fine does not exclude the possibility of receiving it again - so you should not continue to use the car as usual until you are issued a new license.

    4. Can an inspector send a car to an impound lot if you don’t have your license?

    The previously existing practice, when, having found out that the driver did not have a license with him, the inspector could remove him from driving and place the car in an impound lot, is no longer relevant. This is evidenced by Part 1 of Article 27.13 of the Code of Administrative Offenses of the Russian Federation: “in order to suppress violations of the rules of operation, use of a vehicle and driving a vehicle of the appropriate type, provided for in Part 1 of Article 12.3, the vehicle is detained <...> and stored in a specialized parking lot until the cause of the detention is eliminated” . But part 1 is driving a car without registration documents, and driving a car without a license belongs to part 2, which is not covered by Article 27.13. That is, the inspector cannot send the car to the impound lot if you do not have your license with you .

    For how long is a new certificate issued?

    The new driver’s license will differ from the stolen one only in that the word “Duplicate” will be entered in the special notes column. The rights will be valid until exactly the same date as the previous ones. Those. restored rights are issued not for 10 years, but for a shorter period .

    Starting from April 4, 2021, it is possible to obtain a renewed certificate for the full term, i.e. for 10 years . To do this, you need to provide a medical certificate to the traffic police.
