From January 1, 2021, new Rules for the organized transportation of children will come into force

8. Drivers who meet the following requirements are allowed to drive buses carrying out organized transportation of groups of children:

  • having worked as a driver of a category “D” vehicle for at least one year as of the date of the start of organized transportation of a group of children from the last year and one month;
  • have not committed administrative offenses in the field of road traffic, for which administrative punishment is provided in the form of deprivation of the right to drive a vehicle or administrative arrest, during the last year;
  • who have undergone pre-trip instruction on the safety of transporting children in accordance with the rules for ensuring the safety of transportation of passengers and cargo by road and urban ground electric transport, approved by the Ministry of Transport of the Russian Federation;
  • have undergone a pre-trip medical examination in the manner established by the Ministry of Health of the Russian Federation.

17. The following drivers are allowed to drive buses carrying out organized transportation of groups of children:

a) who, on the date of the start of organized transportation of a group of children, have worked as a driver of a category “D” vehicle for at least one year out of the last 2 years;

b) who have undergone pre-trip instruction in accordance with the rules for ensuring the safety of transportation by road and urban ground electric transport, approved by the Ministry of Transport of the Russian Federation in accordance with paragraph two of paragraph 2 of Article 20 of the Federal Law “On Road Traffic Safety”;

c) who, within one year before the start of organized transportation of a group of children, were not brought to administrative responsibility in the form of deprivation of the right to drive a vehicle or administrative arrest for administrative offenses in the field of road traffic.

Bus driver experience appears to be the most challenging requirement, one that lawmakers have been grappling with for years. Therefore, the required experience is constantly changing. Either up or down.

41. To carry out the organized transportation of a group of children, the person responsible or senior responsible for the organized transportation of a group of children and coordinating the actions of drivers during multi-day trips must have with him a list of places of accommodation for children on vacation at night, which also contains the name of the legal entity or last name, first name and patronymic (if availability) of an individual entrepreneur who places children on vacation at night or operates in the field of providing hotel services, or the register number of a tour operator organizing transportation in the unified federal register of tour operators.

From January 1, 2021, the requirement to have a list of hotels where children will be accommodated in the event of a multi-day trip is also canceled.

12. When organizing transportation of a group of children in intercity traffic by an organized transport convoy for more than 12 hours according to the traffic schedule, the head or official responsible for ensuring road safety, the organization, and in the case of organized transportation of a group of children under a charter agreement - the charterer or charterer (by mutual agreement ) ensures that such a group of children is accompanied by a medical worker who has a copy of the license to carry out medical activities or a copy of the agreement with a medical organization or individual entrepreneur who has the appropriate license.

Organized transportation of a group of children in the case specified in paragraph one of this paragraph without a medical professional is not allowed.

11. If the duration of the organized transportation of a group of children exceeds 12 hours and 3 or more buses are used for its implementation, the organizer of the transportation ensures that such a group of children is accompanied by a medical worker. In this case, organized transportation of a group of children without a medical worker is not allowed.

This is not the first time that requirements for the presence of a medical worker on a bus have changed. From January 1, 2021, a health worker is required only if two conditions are simultaneously met :

  • the duration of the trip exceeds 12 hours;
  • 3 or more buses traveling in a convoy .

In this case, the requirements have become simpler; on trips using 1 or 2 buses, a medical worker will not be required in 2021.

1. These Rules define the requirements for the organization and implementation of organized transportation of a group of children by buses in urban, suburban and intercity traffic.

2. For the purposes of these Rules:

the concepts of “charterer”, “charterer” and “chartering agreement” are used in the meanings provided for by the Federal Law “Charter of Road Transport and Urban Ground Electric Transport”;

the concept of “organized transportation of a group of children” is used in the meaning provided for by the Traffic Rules of the Russian Federation, approved by Resolution of the Council of Ministers of the Government of the Russian Federation of October 23, 1993 N 1090 “On Traffic Rules”;

the concept of “medical worker” is used in the meaning provided for by the Federal Law “On the Fundamentals of Protecting the Health of Citizens in the Russian Federation” in relation to medical workers with higher and secondary vocational (medical) education.

3. If the organized transportation of a group of children is carried out by 1 bus or 2 buses, before the start of such transportation to the unit of the State Road Safety Inspectorate of the territorial body of the Ministry of Internal Affairs of the Russian Federation (hereinafter referred to as the State Traffic Inspectorate unit) at the district level at the place where the organized transportation of the group of children begins notification is submitted about the organized transportation of a group of children.

If the specified transportation is carried out by 3 buses or more, before the start of such transportation, an application is submitted to escort the buses by a patrol car (patrol cars) of the State Traffic Inspectorate unit:

if it is necessary to organize escort on public roads located on the territory of several municipalities within a constituent entity of the Russian Federation, closed administrative-territorial entities, several constituent entities of the Russian Federation - to the State Traffic Inspectorate unit at the regional level at the place where the organized transportation of a group of children begins or to a Special Purpose Center in the field of ensuring road safety of the Ministry of Internal Affairs of the Russian Federation, the Main Directorate for Ensuring Road Safety of the Ministry of Internal Affairs of the Russian Federation;

if it is necessary to organize escort on public roads located within districts, cities and other municipalities, closed administrative-territorial entities, the Baikonur complex - to the State Traffic Inspectorate unit at the district level at the place where the organized transportation of a group of children begins.

4. The notification provided for in paragraph 3 of these Rules is submitted by the person planning the organized transportation of a group of children (hereinafter referred to as the organizer of transportation), including the charterer or charterer (if transportation is carried out under a charter agreement), in accordance with the form established by the Ministry of Internal Affairs of the Russian Federation, subject to the provisions of these Rules.

The application provided for in paragraph 3 of these Rules is submitted by the organizer of transportation, including the charterer or charterer (if transportation is carried out under a charter agreement), in accordance with the Regulations on the escort of vehicles by cars of the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation and the Military Automotive Inspectorate, approved Resolution of the Government of the Russian Federation dated January 17, 2007 N 20 “On approval of the Regulations on escorting vehicles by cars of the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation and the Military Automobile Inspectorate.”

5. Notification about the organized transportation of a group of children is submitted no later than 48 hours before the start of transportation in intercity traffic and no later than 24 hours before the start of transportation in urban and suburban traffic.

6. A notification about the organized transportation of a group of children may be submitted in relation to several planned organized transportations of a group of children along the same route, indicating the dates and times of such transportation.

Such notification is submitted before the start of the first of the transportations specified in it.

7. If, according to the schedule, the travel time of a bus during the organized transportation of a group of children exceeds 4 hours, children under 7 years of age are not allowed to be included in this group.

The concept of transporting children in groups is given in paragraph 1.2 of the Traffic Rules:

Organized transportation of a group of children is transportation on a bus, not related to a route vehicle, of a group of children of eight or more people, carried out without their parents or other legal representatives

Such an event is subject to a number of requirements enshrined in the regulatory document approved by the Government of the Russian Federation dated September 23, 2020 No. 1527.

The requirements for a bus permitted to transport minor children are established by the standard.

Previously, GOST R 51160-98 was in force in this regard, but from July 1, 2017, GOST 33552-2015 came into force instead.

Its scope applies to all vehicles for transporting passengers under 16 years of age, for their maximum safety.

New rules for transporting groups of children by bus

Night time for children's transportation is usually considered to be the hours from 23 to 6 am. Driving at this time is permitted only in exceptional cases and no more than 100 km after 23:00:

  • to train stations and airports and back;
  • at the end of the trip (to the place of overnight stay or final destination);
  • related to schedule violations and delays;
  • when carrying out transportation within the framework of legal acts of state bodies of the constituent entities of the Federation.

The requirements for transporting children on organized trips are mandatory and violation of them entails liability. Not only the driver of the vehicle, but also the organizers of the trip are subject to punishment.

Requirements for transporting children

In accordance with No. 99-FZ “On licensing of certain types of activities”, Decree of the Government of the Russian Federation of December 17, 2013 N 1177, Decree of the Government of the Russian Federation No. 652 of 2015, to transport children aged 1.5 to 16 years, the bus must be equipped in accordance with GOST 33552-2015 standards:

  • transport must be no older than 10 years and equipped with the Glonass system;
  • Before departure on each flight, a technical inspection must be completed;
  • The driver must have a first aid kit, a tachograph, a “children” sign, a warning triangle and wheel chocks.

While driving along a given route, you need to drive at a speed of no more than 60 km/h, preferably during daylight hours. If the duration of one trip is no more than 12 hours, there can be one driver behind the wheel, if up to 16 hours - at least two. The rest of the second driver must be at least 8 hours. The driver cannot leave the bus if there are children on board. Only personal items should be kept in the cabin. If the flight duration is more than 4 hours, then children under 7 years old are not allowed on it.

Requirements for a vehicle driver

The driver, in addition to a category D driver’s license, a license for transporting children by bus and a license card must:

  • continuously work as a bus driver for at least 12 months over the past three years;
  • not violate traffic rules, not be at fault for an accident and not lose your license during the last 12 months;
  • have a medical certificate confirming proper health status;
  • have a note on the waybill about pre-trip briefing.

Rules for picking up and dropping off children

Along with children, there must be accompanying persons on the bus who ensure order during movement, stops, boarding and disembarking. Before boarding begins, they are required to mark those present according to the list, and then gather the children for boarding in a safe place. After loading bags into the luggage compartment, you need to instruct children about the rules of conduct on the road. If mass transportation of children is carried out, boarding must be done under the supervision of the driver when the bus is completely stopped and only through the front door.

Nuances

If it is planned to transport more than 8 children at the same time in a vehicle, we are talking about organized transportation. The rules for transporting a group of minors are more stringent. The process is regulated by Decree of the Government of the Russian Federation No. 1177 of December 17, 2013.

For transportation, it is permissible to use only a bus that meets the established requirements. If the movement is carried out in the dark, children can travel no more than 100 km at a speed of 50 km/h. If there are minors under 7 years of age on the bus, continuous movement for more than 4 hours is not allowed.

There will be no age limit for operating buses for transporting children.

The Government of the Russian Federation adopted Resolution No. 1527 dated September 23, 2020 “On approval of the Rules for the organized transportation of a group of children by bus.”

When to apply

The rules are valid from January 1, 2021 to January 1, 2027.

Traffic police escort

According to the rules, the organizer is obliged to inform the unit of the State Road Safety Inspectorate about transportation by one or two buses.

If transportation is carried out by 3 buses or more, an application is submitted for the buses to be escorted by a traffic police patrol car.

The following drivers are allowed to transport children:

  • having worked as a driver of a category “D” vehicle for at least one year out of the last 2 years;
  • who have not been brought to administrative liability within one year before the start of the trip in the form of deprivation of the right to drive a vehicle or administrative arrest for administrative offenses in the field of road traffic;
  • have undergone pre-trip briefing.

If the duration of transportation of a group of children exceeds 12 hours and 3 or more buses are used for its implementation, then the presence of at least one medical worker is necessary.

Age limit for children

Children under 7 years old cannot be transported if the duration of the trip exceeds 4 hours.

Educational, medical, sports and other organizations can organize the transportation of children. A special feature of such routes is the absence of parents or other legal representatives.

The trip organizer is obliged to ensure the safety of children throughout the entire route, the proper technical condition of the vehicle and its provision of protective equipment. The rules for transporting children on a bus are approved by the Traffic Regulations, Resolution No. 1177.

For what?

The head of the traffic police himself says that allegedly exceeding the speed limit for every kilometer per hour increases the severity of the consequences of an accident by 3% on average. Unfortunately, we did not find any proof of this information.

But there are statistics from the WHO Road Safety Guidelines and the European organization Global Road Safety Partnership.

According to their study, higher driving speed increases all negative factors:

  • as the risk of an accident,
  • and injuries from the results of such an incident,
  • the risk of death of the driver and passengers also increases - and in the case of children this plays a much more important role.

The document states (paragraph 1.1.2 of the study) that an increase in speed of just 5% increases the chances of an accident with injured people by 10%, and with a fatal outcome by 20%.

Another interesting study (page 6 of the Guide) suggests that if a car’s speed exceeds the established threshold of 60 km/h by just 5 km/h in the city and 10 km/h on the highway, then this is enough to increase the risk of getting into an accident. increased by as much as 2 times. This is equivalent to a blood alcohol concentration of 0.5 mg per liter (ethyl alcohol). Let us recall that in Russia the permissible concentration threshold is 0.3 g/1 liter of blood.

Transporting children by bus according to new rules in 2021

As mentioned above, organized transportation of children is one of the special options for traveling according to traffic rules (approved by Decree of the Government of the Russian Federation No. 1090). In addition to this regulatory act, Resolution No. 1177 was adopted in 2013.

It is this guidance document that defines:

  • requirements for the technical condition of buses and other vehicles;
  • features of coordinating the route with the traffic police and assigning an accompanying vehicle;
  • list of documents required to coordinate the trip and route;
  • additional protective measures that must be observed when transporting children.

This Resolution applies when traveling within the territory of the Russian Federation. If the bus travels outside the country, you need to take into account the laws of the foreign country.

For traffic violations, the driver or owner of the bus will bear standard liability under the Code of Administrative Offenses of the Russian Federation. But Article 12.23 of the Code of Administrative Offenses of the Russian Federation contains a number of special offenses that entail punishment for offenses during organized trips for children:

  • for failure to comply with general traffic regulations in the transportation of people, a fine of 3,000 rubles will be imposed. (per driver), 25,000 rub. (per official), 100,000 rubles. (per organization);
  • for poor technical condition of the bus, for the absence of a list of children or an agreed route, fines in similar amounts are imposed;
  • If the rules for transporting children at night are not followed, the driver faces a fine of 5,000 rubles. or deprivation of rights for a period of 4 to 6 months.

Traffic police inspectors can draw up protocols on the listed violations both during the trip and after its completion. For harm to children's health or life, responsibility may lie with the driver, the organizer of the trip, or the accompanying persons. The transportation organizer and the transport company are required to store all documents related to the trip for three years.

Now all buses must be equipped with seat belts. The remaining requirements remain unchanged: the presence of a tachograph, GLONASS or GLONASS/GPS satellite navigation equipment.

The experience of a category D driver on the day of departure must be at least 12 months out of the last 13 months instead of a continuous experience of 1 year, as was previously the case. This means that even if the driver had a break from work for several days (for example, he changed jobs), he still has the right to transport children's groups.

  1. The trip is impossible without accompanying persons. It used to be the same, but it was not clearly stated (it was just implied).
  2. The number of accompanying persons should now be the same as the number of doors on the bus intended for passengers to enter/exit.
    The remaining doors are no longer taken into account (for example, rear hinged doors).
  3. One of the accompanying persons is appointed as the person in charge of the bus and is responsible for the actions of the other accompanying persons and the driver.
  4. The attendant's tasks include monitoring seat belts.
    He must follow:
  • that children are restrained before the vehicle starts moving;
  • that all children are buckled up while driving;
  • so that children do not get up from their seats during the trip and do not move around the cabin;
  • keeping order in the cabin;
  • for fulfilling the requirements of the charterer, which were communicated to him during the briefing carried out before the trip.

In cases of long, multi-day trips, the responsible person must prepare in advance and have a list of accommodation places for children to rest at night. As an alternative, the register number of the tour operator (in the unified federal register of tour operators) that organized the transportation can be used.

Now a notification to the traffic police about organized transportation is submitted by the charterer or the charterer. Individuals (parents, teachers, etc.) do not have the right to submit a notification.

  • The charterer can submit documents only if he is an individual entrepreneur, an authorized representative of an individual entrepreneur or legal entity.
  • The charterer always submits documents when the charterer is an individual, in other cases - by agreement with the charterer.

Fine for leaving a child in a car in 2021

If a parent neglects the rules and leaves the child alone in the car, the violator will face a monetary penalty. Its size is reflected in Article 12.19 of the Code of Administrative Offenses of the Russian Federation. It says here that violating the rules of stopping or parking vehicles entails a fine of 500 rubles. The rule is relevant if the situation arose in the regions. When it comes to Moscow or St. Petersburg, the amount of the penalty increases. Its value is fixed by part 5 of article 12.19 of the Code of Administrative Offenses of the Russian Federation. For violation you will have to pay 2,500 rubles.

Changes in the rules for transporting children by bus in 2021

In addition to children under 18 years of age included in the list, only the following persons may be on a bus transporting a group of minors:

  • driver or drivers , information about which is indicated in a separate document;
  • accompanying persons listed in a separate list;
  • representatives of the tour operator officially present on its staff;
  • assigned medical worker , the legality of whose presence in transport must also be indicated in a specific document.

Persons not included in the above lists do not have the right to travel in a vehicle .

The driver must:

  • Work without interruption for a year (from the last two) on vehicles provided for category D. Age - from 21 years.
  • During the last year, do not commit any violations that would result in deprivation of rights or administrative arrest. If the driver was subject to one of these articles, but paid the fine imposed as an alternative, then he is not allowed to make such trips.
  • Before the flight, undergo a medical examination and instruction.

Liability for violations of organized transportation of children by bus from 2021 remains in force, since it is tied to the fourth part of Article 12.23 of the Code of the Russian Federation on Administrative Offenses.

All minor passengers on board the transport must be noted on the list. Unauthorized children (not on the list) are not allowed to be in the car. If there is at least one child under 7 years old in the car, then the total duration of the journey is no more than 4 hours. This point must be taken into account when planning a trip.

Accompanying

The minimum number of accompanying persons depends on the number of doors. Their largest number is not limited. One of them is responsible. If there are several vehicles, then the senior person in charge is determined, located in the last vehicle. If the total travel time is more than 12 hours, then there must be a medical worker in the car who has with him a document that confirms his qualifications, a license or a copy of the contract with the medical institution.

A vehicle planned for the organized transportation of minors with accompanying persons must meet the following conditions:

  • From the year of issue - no more than 10 years (effective from 06/30/2021).
  • The presence of a “Transportation of Children” sign installed on the front and rear of the vehicle.

From July 10, 2017, new rules for transporting children on a school bus came into force, covering vehicles intended for transporting minor passengers aged 6-16 years.

Basic requirements for school buses for transporting children:

  • no more than 10 years must have passed from the year of manufacture (from 06/30/2021);
  • The vehicle must comply with the technical requirements of GOST R 51160-98 for design and purpose;
  • the presence of a technical certificate indicating the complete serviceability of the vehicle;
  • availability of GLONASS satellite navigator (from 05/30/2021);
  • the presence of a tachograph, which allows you to determine the driving and rest mode;
  • setting the speed limiter to 60 km/h.

The 2021 regulation on transporting children by school bus states that “Transportation of Children” warning signs are attached to the front and rear of the vehicle, and the inscription “Children” is placed on the side, contrasting with the main color of the vehicle.

  1. Buckle up. Children under 12 years of age must wear seat belts. But, besides this, the driver must do the same action.
  2. Don't eat on the road. It is not recommended to give food to a child while driving a vehicle. This can easily cause problems with the stomach or respiratory system. If your baby really wants to eat, it’s better to stop and have a snack together.
  3. Take a first aid kit. Its mandatory components are antipyretics, painkillers, tablets for headaches and stomach cramps, medications for vomiting and nausea, and dressings. Anti-allergy tablets and ointments for burns are also useful. Important components are tools, i.e. tweezers, hemostatic tourniquet, bandage, office scissors, flashlight.
  4. Close the locks. This is especially true for the rear doors, because when driving at high speed or making sharp turns, the doors can open and the child can fall out. Another option is that if the door is not locked, the baby may play and accidentally open it (especially if the car is modern, where the doors open with a slight movement of the hand).
  5. Lock the power windows. A very unsafe car part. In Russia, there have even been cases of children dying due to poor locking of power windows. The worst option is that the baby presses and opens the window, sticks his head inside and suddenly, accidentally presses the button to open the doors.
  6. Do not leave your baby alone in the car. It doesn’t matter if there are adults or parents nearby, the child is fast asleep. Get out of the car and take your baby with you. If you leave your baby alone in the cabin, he may get scared and the process of developing mental disorders will begin.
  7. Maintain order and cleanliness in the salon. No leftover food, cigarettes, lighters, or cutlery around the baby. It is prohibited to transport large, bulky items in the same vehicle with a child. If possible, do not even place personal items in the rear seats. If heavy objects are carried (even in the front seat), they are secured with straps.
