Is it possible without a policy?

If you stopped?

How to recover?

Refuse to restore

Loss or mechanical damage of any documents is an unpleasant occurrence. For a person, this means a lot of time spent tediously collecting documents and constant queues. In this hierarchy, car insurance is one of the most frequently forgotten documents. They explain that driving without this paper entails only administrative liability. However, drivers who have been involved in a traffic accident are unlikely to think so. In the article we will tell you what to do if an unpleasant situation does happen and you have lost your MTPL policy, because every motorist should know how to restore an insurance policy.

Is it possible to drive without a policy if you have lost it?

In real life, unplanned events often occur; failure to preserve documents is one of them. Anything can happen. You left the insurance in a public place without the possibility of return, got caught in the rain, which caused the paper to deteriorate or, conversely, faded after being in the sun. If the insurance is lost or damaged, there is little pleasure, but first of all you need to inform the traffic police and the insurance company about the loss, and then figure out how to restore it and what to do.

It often happens that you notice a loss at the last moment: when you need to go to work or when stopped by a traffic police officer. Is this a familiar story? The question immediately arises: is it possible to drive a car for some time without a policy? It is forbidden . Insurance is mandatory for every car owner. In theory, you can drive, but this is only until the first stop by the traffic police. Don’t forget that there is always a danger of getting into an accident. Then, if you do not have a policy and it is established that you are at fault, you will have to cover the costs of the other driver. It's up to you to decide whether to take risks or not. But we still recommend using a taxi or public transport to get to the insurance company and solve the problem.

Procedure

What to do if the driver has lost car insurance? If you lose your car insurance, you can restore it in a fairly short time.

To do this, the motorist needs to come to the nearest office of the insurance company where the MTPL policy was received and provide the necessary papers confirming the status of the owner of the car with an application for the issuance of a duplicate. The procedure is quite lengthy and requires a lot of time from the car enthusiast.

If a motorist has received a policy in electronic form, he can make a duplicate remotely, without leaving his home. You just need to go to the insurance company’s portal, find your insurance in your personal account and print out a new copy. This is not only very convenient, but also saves a little time.

Restoration of compulsory motor liability insurance in an insurance organization involves:

  1. Collection of necessary documents.
  2. Appearing at the insurer's office.
  3. Obtaining a copy of the MTPL policy.

Who will receive the duplicate?

A copy of the motor vehicle license is provided to the person in whose name the contract with the insurer was drawn up. Using passport data, an insurance agent can find information about a compulsory insurance policy in the database and make a duplicate.

IMPORTANT! The legal representative of the policyholder can also restore compulsory motor liability insurance. To do this, he must have a power of attorney from the person who drew up the contract with the insurance company. If the driver is only included in the vehicle registration, he does not have the right to receive a copy.

Drawing up an application

The document is prepared at the office of the insurance company:

  1. The header of the application indicates the insurer's data - the name of the organization with full name and the position of its head. The applicant’s full name should also be indicated here.
  2. Below you need to describe the request in which the car owner needs to restore car insurance and indicate the reason for issuing a duplicate.
  3. At the end of the document, you must sign the car owner and indicate the date the paper was issued.

Required documents

When visiting the insurer's office, the motorist must prepare the following list of documents:

  1. passport of a Russian citizen;
  2. driver's license;
  3. vehicle passport;
  4. vehicle registration certificate;
  5. diagnostic card.

Most likely, the car owner will only need a passport with a driver’s license: using these documents, a quick search is carried out in the database of the insurance organization. However, if possible, it is advisable to take the entire set of papers listed, since they may be needed in the case of an extremely picky insurance agent.

Receipt

Several days after writing a statement about the loss of a motor vehicle license, the insurance company issues a new OSAGO policy, which states either “Duplicate”. A copy of MTPL will be valid for exactly the same period as the original. For example, if the driver had 4 months left before the expiration of his compulsory insurance policy, the duplicate will have the same period.

Attention! If a motorist is reinstating insurance for the first time, the procedure is free of charge. However, the re-issuance of a duplicate occurs on a paid basis: in addition to filing a statement about the loss of the document, you must pay a receipt for the loss of the policy.

When they already stopped

If you are stopped by traffic police and it turns out that your MTPL policy is lost, you will face a fine, so you need to think in advance about how to restore it.

As a standard, 800 rubles are charged for the absence of a document. In a lighter version, you will be asked to pay 500 rubles: such a fine is provided for a policy forgotten at home. The good news is that they don’t take away your license, tow your car, or remove license plates for this. In addition, if you stop again, there are no additional sanctions, the same 800 rubles.

It is also important to distinguish when the policy is lost or damaged, and when it is expired or does not exist at all. In the first case, traffic police officers can enter your insurance number into the database and, under favorable circumstances, release you without a fine. In the second, you will have to give the money.

Step-by-step instructions for actions in case of loss of an MTPL policy

If the insurance policy has been lost or damaged, the owner will need to follow a specific sequence of actions to restore the compulsory insurance policy:

  1. Collect the documents described above and write an application according to the established template.
  2. Visit the branch of the insurance company where the contract was concluded. If you have problems clarifying the name and address of an institution, you can use the functionality of the official website of the RSA. This service allows you to obtain key information on the policy using the state number and VIN of the vehicle.
  3. Wait for the documents to be verified.
  4. Get a new OSAGO policy.

Additional information
Refusal to satisfy a request is a very rare action in the insurance restoration procedure, since practically nothing is required from the applicant. The only thing he must do is provide a package of required documents.

How to restore your MTPL insurance policy?

Now let's look at the procedure when you have to get a new policy. There is no need to purchase a new one, because last time you were included in a special unified database of insurers. No additional financial resources are required.

First of all, you should go to the insurance company where it was issued to you. To restore a lost MTPL insurance policy, you need the following documents:

  • Passport
  • Driver's license
  • Vehicle ownership document
  • Receipt for payment of the policy (if available)

You also need to write an application to have your car license reinstated. In a week you will be able to receive a duplicate of your MTPL insurance policy.

You can apply for policy restoration here.

If you don't remember your insurer...

Imagine that you forgot which insurance company gave you the insurance form. What to do in this case? You should:

  • go to the website of the Russian Union of Auto Insurers (RUA);
  • provide information about yourself and your car in the online form;
  • receive a report on the search for your policy indicating the insurance company's contract number, etc.

Please keep in mind that a duplicate of the insurance contract will only be issued to the person whose signature appears on the original document. The form is not handed over to any authorized persons.

If for some reason the insurer’s office refuses to issue you a repeat policy, they are required to issue the refusal in writing with a detailed explanation of the reasons for the refusal. With this document, you can then contact the RSA and demand a trial (the application can be submitted electronically on the Union’s website).

In conclusion, we note that the loss of a car insurance policy is a problem only if your compulsory motor liability insurance has disappeared - it should always be with you when you are driving. To avoid traffic police fines for missing a document, it is better to immediately begin restoring it.

If you have a minimum package of documents, and if there is no delay, you can receive a duplicate of the insurance policy within one day and completely free of charge. Just provide the necessary data to the insurance company’s office and write a statement about the loss of the contract.

Digital copy

Today, many motorists use an electronic copy of insurance rather than a traditional one. This is convenient - you can buy it online and restore it more easily. However, the owner of the car is required to have a printout of it with him.

The convenience is that it is impossible to lose insurance purchased online. All data is saved in the database. If a printout of your MTPL policy is lost, it’s easy to restore it. All you need to do is log in to your personal account on the insurance company’s website. You can also print a new form there. We remind you that all drivers are required to have it with them.

There may be situations when everything happens exactly the opposite. There is an electronic policy, but its paper version has disappeared. Here you need to contact your insurance company with a printed document and ask to issue a policy, previously drawn up on a strict reporting form.

Step-by-step guide to restoring compulsory motor liability insurance

To obtain a duplicate, just contact the insurer’s office. The organization’s employees will tell you how to carry out all stages of the procedure. Typically, the procedure for restoring a lost MTPL policy is as follows:

  1. Prepare a package of documents. In most cases, a passport will be sufficient. If the client doubts that the insurance company will identify him using his general passport alone, it is recommended to call the branch and clarify this point.
  2. Contact the insurance company and write an application with a request to issue a duplicate insurance. The application is provided at the company’s office, and can also be downloaded from the insurer’s official website. It is not necessary to indicate the reason for issuing a duplicate. If such an item is still indicated in the questionnaire, you can safely write the truth, even if the policy became invalid due to the fault of the insurer (torn, wet, burned). The reason for the loss does not affect the recovery process.
  3. Wait for the request to be processed. If the package of documents is in order, and the company employees do not have problems checking the database, a duplicate can be issued on the same day. Sometimes the wait lasts for 2-3 days, especially during public holidays.
  4. Pick up a duplicate.

The duplicate is absolutely identical in its effect to the original. It has the same legal effect. The only difference is that the paper is marked “duplicate” or “issued to replace a lost one.”

The insurance company refuses to reinstate the policy

You did everything right, but insurers refuse to reinstate your policy. Unfortunately, such moments also happen in a driver’s life. What to do in such cases?

To begin with, contact directly the official who refuses to restore it. He must write a written notice detailing the reasons for his refusal. After this, you need to act in accordance with what he answered.

As a last resort, contact the Russian Union of Auto Insurers. They will tell you how to act in such situations.

According to regulatory documents, driving without a compulsory motor liability insurance policy is prohibited. This creates additional difficulties for traffic police officers and insurers. In the event of an accident, it will be difficult to determine whether the driver is entitled to compensation if, for example, he is unconscious. To reduce the number of cases of driving without compulsory motor insurance, the state has established a rule: always take insurance with you when driving.

But what to do if the insurance is lost and you need to use the car? This may be necessary, for example, to get to the insurer’s office and restore the document. In this case, you can drive, but you need to prepare for legal penalties.

I forgot where I took out insurance

We have already found out that it is important to resolve all issues with insurers. But this knowledge can be broken by a not so rare problem: the car owner simply forgot where he took out the policy. This mainly applies to older people; they simply might not remember the name of the company. This is easy to solve. You need to go to the website of the Russian Union of Auto Insurers. There, enter the VIN number and registration plate of the car. The system will immediately provide information about which company issued the document to you. After this, you can contact her to reinstate the policy. If the policy was issued through an electronic broker, then you just need to go to your personal account, everything is saved there.

As you can see, it is possible to restore a lost vehicle license. However, the procedure requires time and effort, which not everyone has. The lack of insurance in the event of an accident can even provoke endless walking through the authorities with evidence of one’s innocence. To prevent this from happening, renew your policy on time and always keep a copy with you. Having an electronic copy makes life much easier; it can be restored much faster.

Good luck on the roads!

How to recover an electronic document

Issuing an electronic policy via remote access followed by printing the form significantly saves the car owner’s time, eliminating the need to visit the insurer’s office. But not everyone knows how to restore an MTPL policy if it is lost. The procedure consists of re-printing the file with the documents sent by the broker at the time of purchasing the e-contract.

Attention! If the original electronic information is lost, then a visit to specialists from the company that entered into the initial contract is inevitable. Brokers will not help with resolving the issue.

What to do if you lose your car insurance?

Regarding the fact of loss of a compulsory vehicle insurance policy, the law provides for 2 provisions:

  1. Part 2 of Article No. 12.3 of the Code of Administrative Offenses of the Russian Federation.
    This section of the document states that in the case of driving a vehicle with a lost compulsory motor liability insurance, a traffic police officer has the right to issue a warning or impose an administrative penalty in the form of a fine in the amount of 500 rubles.

    In practice, traffic police officers do not trust statements about a lost policy and in the vast majority of cases impose a fine.

  2. Paragraph 6, clause 1.4 of Bank of Russia Regulations No. 431-P of 2014. This document states that in the event of the loss of a motor vehicle license, each policyholder has the right to receive a free duplicate of the MTPL policy.

A motorist driving a vehicle must strictly have a compulsory insurance policy with him, and also provide it to the traffic police inspector upon request (clause 2.1.1 of the traffic rules). In the absence of a driver's license, administrative liability awaits the driver.

Article 12.3 of the Code of Administrative Violations of Russia in paragraph 2 states that when driving a car with a driver who does not have compulsory motor liability insurance, a protocol on the violation committed is drawn up with a warning, or it is punishable by a monetary penalty in the amount of 500 rubles.

Attention! Since 2014, traffic police officers have no right to apply any penalties other than a fine for lack of insurance. This means that taking a car to an impound lot or removing license plates from a car is illegal.

The worst situation is when a traffic accident occurs involving a driver who has lost his license. The insurer may refuse to pay compensation for the restoration of the vehicle.

According to clause 2 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation, the absence of compulsory motor liability insurance does not mean its cancellation and termination. However, if the vehicle is stopped by road service employees, if the insurance policy is not provided upon request, this will result in a fine. A protocol is drawn up regarding the commission of an administrative offense and a warning is issued.

Having lost car insurance, the first thing a motorist will ask is how to restore the MTPL policy if it is lost. After the final decision, you may be wondering: what to do if you lost your car insurance? Unfortunately or fortunately, this is not the first time the problem has appeared; experienced drivers immediately know where to turn, but beginners will have to fray their nerves.

In the rules for obtaining an MTPL policy, each driver has the right to receive a free duplicate. It is worth noting that there are no restrictions in the insurance rules and you can get a free duplicate, even if this is not the first time an unpleasant situation has happened to you. You don’t need to be a candidate of legal sciences to understand that you need to contact the insurance company where you once took out a policy. For electronic registrations, it is possible to reprint the policy.

The first step during the restoration of the MTPL policy will be the collection of the necessary documents.

To successfully recover lost papers you need to collect the following:

  1. Passport of the Russian Federation and driver's license.
  2. Registration of the vehicle for which the lost insurance was issued.
  3. Expenses that were incurred by you during the registration of the policy (or a diagnostic card, if it is not lost).

Step 2: If you have collected all the above documents, then the next step is to take them to the company. At the company’s office you will be asked to write a statement about the loss and restoration of documents. To ensure quick execution of your application, you should contact the administrator at the main office. This action will significantly speed up the process of restoring your data.

And already at the third stage you can pick up your duplicate.

Article 12.37 of the Code of Administrative Offenses of the Russian Federation states that if there is a known lack of insurance, the driver of the vehicle will be fined. The responsibilities of the insurer in the event of loss of the policy are specified in the Federal Law “On Compulsory Motor Liability Insurance”. It states that the owner will not be charged a fee to replace a lost auto liability insurance policy if the replacement is being made for the first time. In the second and subsequent cases, the costs of the insurance company are paid by the driver. Usually, this amount does not exceed 300-400 rubles.

There are no special difficulties or subtleties in the process of restoring lost documents. The main thing is that if you discover the absence (damage or theft) of a compulsory motor liability insurance policy, immediately contact the insurance company where the contract was concluded. It is enough to have a passport and driver’s license with you, however, particularly zealous agents may require other documents for verification. So it won’t hurt to take them with you.

You can obtain a duplicate at both the central and territorial offices of the insurance company. In this case, the policyholder himself must appear here. If this is not possible for any reason, a notarized power of attorney will be required. To be reinstated, you need to write an application addressed to the director. Here you can also indicate the number of the lost document, if it has been preserved.

Usually, a new MTPL policy can be obtained on the same day of application. However, there are exceptions here too.

  • If the contract was concluded less than 5 days before contacting about the loss, the procedure will be lengthened. The fact is that by law the insurer is obliged to enter the necessary data into a single database within 5 days after registration. Therefore, if the policyholder has lost the policy immediately, then obtaining a duplicate may be delayed.
  • OSAGO policies with an expired validity period cannot be restored. In some cases, it may be necessary to obtain a duplicate of an outdated policy (for example, for legal proceedings with the insurance company). Unfortunately, they will not be able to issue him. However, in this situation, a certified copy of the document may be issued. It takes no more than 5 days to complete.

In addition to directly contacting the insurance company’s office, there are also several alternative ways to obtain a duplicate of the compulsory motor liability insurance policy. To save time, you can send a registered letter to the insurer. Here you will need to attach a package of necessary documents, as well as an application for restoration. After preparing the necessary documents, the policyholder will be contacted and invited to receive a duplicate at a convenient time. You can also send documents with your application through the official website of the Investigative Committee.

If you lose CASCO insurance, the procedure does not change that much. The difference is that obtaining such insurance is not mandatory. This means that driving a vehicle without it is acceptable. In addition, the procedure is not regulated at the legislative level. Some companies may refuse to issue a duplicate, denying the fact of insurance.

In this case, it is advisable to have a copy of the document in order to find out the number, if necessary. To obtain CASCO insurance, you need to come to the insurance company office (taking with you your passport, license and, if available, a copy of insurance or a receipt), write a corresponding application and wait for registration. As in the case of compulsory motor liability insurance, the first appeal will be considered free of charge.
