A license plate with a “foreign” region, should it be changed in 2021?

New law on license plates and region codes.

Regulatory acts that began to regulate the new rules for state registration of cars in Russia:

-Federal Law “On State Registration of Vehicles” dated August 3, 2018 N 283-FZ;

-Order of the Ministry of Internal Affairs of Russia dated December 21, 2019 N 950 “On approval of the Administrative Regulations of the Ministry of Internal Affairs of the Russian Federation for the provision of state services for vehicle registration”;

-Resolution of the Government of the Russian Federation dated December 21, 2019 N 1764 “On the state registration of vehicles in the registration departments of the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation” - this is where the answers to all questions lie.

Now you should understand the main innovation under the new laws. If previously registration marks were a single term

, then from January 1, 2021 they were divided:

- state number is an intangible set of letters and numbers that is assigned when registering a car by the traffic police department;

- a registration plate is a metal plate itself, which is issued to the owner of the vehicle after assigning a number.

So, is it necessary to change license plates if the region code does not match the registration address of the car owner? It all depends on the specific situation, so let's look at each case separately.

Car Re-registration Law 2021

So, what has changed, and what legislative norms should motorists henceforth refer to if inspectors charge them with registration license plates that do not correspond to their current registration? Paragraphs 8-12 of Government Decree No. 1764 of December 21, 2021 come to the rescue, according to which:

  1. Now, when registering a car registered in another state region, the code that corresponds to the place of residence of the new owner will be assigned.
  2. In accordance with Article 13 of Federal Law No. 283-FZ, which comes into force this July, a registration plate, which means a unique car number, will be assigned upon request in any subject of the Russian Federation.
  3. According to paragraph 42 of the same legislative norm, a license plate will be issued only at the place of registration of the owner, and not only at the traffic police, but also on order from any licensed company.


Thus, registration of a car in a new region will be possible, but without issuing license plates and only with the mandatory assignment of the code of this state entity.
And despite the obvious contradiction, it is now automatically possible to refuse to obtain other license plates, unless, of course, officials reconsider their decision over time.

What will be the region when registering a new vehicle without registration?

Typical situation - you purchase a new car at a dealership and want to register it. What if you are registered in Moscow, but apply for a government service, for example, in St. Petersburg?

The answer is contained in paragraph 39 of PPRF No. 1764

. In this case, your car has not yet been assigned a number by the State Traffic Inspectorate. With this assignment procedure, you will be given a license plate with the Moscow code.

clause 39. The state registration number of a vehicle is assigned in accordance with the digital code of the region of the place of registration of the owner of the vehicle.

What documents are required for registration in another region?

To register a car with the MREO in any region, you will need:

  • application for registration;
  • PTS;
  • issued MTPL policy
  • car purchase and sale agreement;
  • identification document;
  • a power of attorney certified by a notary (if the car is registered by someone other than the owner indicated in the purchase and sale agreement).

Next, you need to come to the selected department of MREO traffic police with the car for inspection and submit an application with all these necessary documents.

In paragraph 39 of PPRF No. 1764, we are talking specifically about the mandatory assignment of a number according to the region code of the new owner of the car.

At the same time, none of the above 3 regulations states that when purchasing a used car, the procedure for replacing state registration plates with new ones according to the region of registration of the new owner is mandatory.

That is, in this situation the choice is yours

:

-you can leave the same numbers already assigned by the state, even if they have a different region code;

-voluntarily replace the numbers (the state fee for this will be 2,000 rubles, 1,400 through the State Services portal).

Thus, if you bought a car in another region

, different from your registration, and driven to your city, then there

is no
obligation to change the already assigned license plates
even after the January 2021 changes .

However, there are a number of nuances in this issue, which we will consider below.

The car is deregistered

If you bought a car that was deregistered by the traffic police by the previous owner, then this is accompanied by the mandatory submission of the license plate number to the MREO department.

Therefore, the purchased car goes to you without assigned numbers, even if the registration plates are actually on the vehicle.

If the seller stops registering

After the sale of the vehicle, the previous owner has the right to terminate the registration of the vehicle on the 11th day after the date specified in the purchase and sale agreement.

That is, if you do not register the car with the traffic police within the 10 days allotted by law, and the seller deregisters it, then the plates will be invalidated, and you will have to get new ones with the region code of your registration.

You can save or retain your license plate number only in that case. If your registration or temporary registration matches the region of the number. The one you want to keep. Otherwise, saving, leaving, replacing, or restoring will not work. Important! Temporary registration is not valid if you have permanent registration. Therefore, during registration actions, priority will be given to permanent registration using a passport. They’ll simply pick it up and drop it off in your region!

Therefore, the surest way to have numbers with the desired region is to register in this region.

  2. Registration of movable property received by inheritance.
  3. Replacement of car documents due to loss, re-registration and other circumstances.

As you can see, all of the listed points are in one way or another related to documents, so this can also include the purchase of a car with license plates registered in another subject of the Russian Federation. At least, this was the case until the new year, and to be more precise, before amendments were made to the law, after which traffic police inspectors lost the ability to demand the replacement of license plates that do not correspond to the place of registration of the car owner.
