    1. Fill out the “To whom it is addressed” block. Here we mark the unit in whose territory the violation occurred.

    Mobile application for reporting violations

    There is a convenient alternative - a mobile application. You can upload a photo to it and it will automatically send an application to the traffic police. True, it is designed only for certain types of traffic violations:

    • Parking within the area of ​​prohibition signs
    • Parking at the pedestrian crossing
    • Parking on the sidewalk

    The “Moscow Assistant” application has been developed for Moscow residents; the SPOT application is available for other cities.

    How to properly file a complaint

    In the application you indicate:

    1. Region and locality of appeal.
    2. Select the name of the department to which the complaint is sent.
    3. Personal data of the applicant: full name, address, e-mail, telephone.
    4. Were there any appeals on this issue, when and where?
    5. The exact date, time and place of the recorded violation.
    6. Detailed description of the situation.
    7. Grounds for initiating a case: articles of the Code of Administrative Offenses or the Criminal Code, paragraphs of traffic rules.

    You attach files to your online application and submit the form by entering the digital code on the website.

    If you contact the traffic police department in person, print out the photos or bring the files on a flash drive.

    Grounds for refusal to consider a complaint

    Your application may not be accepted if:

    1. The provided files are of insufficient quality, the license plate number of the offender is not readable or is not captured.
    2. Photo and video evidence is not presented at all.
    3. The grounds for the complaint are unclear or missing.
    4. There are errors in the applicant's personal data.
    5. The text contains insults and obscene language.
    6. There are no specifics, the situation is not described in sufficient detail or is described incorrectly.

    Also, for each case, the traffic police accepts only one complaint.

    You can apply again if you received an official refusal based on your previous application or the problem was resolved, but another violation occurred later.

    When the offender is not punished

    But there are situations when the violator will not be punished even if there is reliable evidence of his guilt, recorded in a photo or video. This is possible in two cases:

    • Violation of the statute of limitations
    • Anonymous requests

    Violation of the statute of limitations

    According to paragraph 1 of Article 4.5 of the Code of Administrative Offenses of the Russian Federation, it is possible to be held accountable for an offense only within a certain period of time. If time has passed and no decision has been made, the perpetrator can file a motion to dismiss the case due to the expiration of the statute of limitations and go unpunished. What you can expect:

    • For minor violations considered without the participation of a court, the statute of limitations is limited to 2 months
    • For cases in which the court makes a decision, the period is set at 3 months
    • For serious offenses, such as driving under the influence of alcohol or drugs, refusal to undergo an examination, causing minor or moderate harm as a result of an accident, a decision must be made within a year.

    The period may be extended if the consideration of the case is transferred to another territorial unit.

    Anonymous letters

    Also, appeals are not considered on their merits, even those recorded according to all the rules with photos and videos, if they are submitted anonymously. Each application submitted to the traffic police must contain the name, surname and, if available, patronymic of the applicant, as well as contact information for written communication with him.

    To use the program, you need to register in the system through government services of the city of Moscow.

    What to do if you don’t receive a response from the traffic police? Such questions can often be found on forums on the Internet. These questions are also asked during legal consultations.

    Indeed, what should you do if a motorist has filed a complaint (application, appeal, petition), but he does not receive a response for a long time?

    Indeed, if a response from the traffic police does not come for a long time, then you should not just sit and wait. After all, the law clearly states which appeal from a motorist is considered and in what order. If the period for consideration of the appeal has already expired and the deadline for sending the car enthusiast’s response has expired, then what is the point of “waiting by the sea for weather”?

    “If the palm tree doesn’t come to me, then I go to it.” So said one smart man, and he was right. In this case, you should not even wait until all the deadlines for considering and sending a response to the appeal (complaint, petition, proposals, applications) have expired, but you can find out in advance about the results of considering the appeal.

    To get an answer (if it is ready, of course), you need to come to the traffic police and ask to be given this answer. If they don’t give you an answer, but start citing some circumstances that do not allow this to be done (the answer has already been sent by mail, the case materials have been sent somewhere, the traffic police officer involved in the case is on vacation, we don’t know where the case is, etc. ), then you need to record your appeal in writing. Otherwise, you may wait a long time for a response (for example, by mail), but still not receive it.

    It is very simple to record your arrival at the traffic police and request a response. To do this, you need to take two blank sheets of paper and write in any form a statement about familiarization with the materials of a particular case and delivery of a copy of such and such an answer. Naturally, from the content of this statement (petition) it should be clear what kind of case we are talking about.

    One copy of such an application is given to a traffic police officer (to the office, the company commander, a specific traffic police officer), and on the second they sign for you to receive this document. The second copy of the application remains with you and confirms that on such and such a date you asked to receive an answer from the traffic police.

    A petition in a case of an administrative offense is considered immediately, while other appeals (applications) may be considered over a longer period. A day later (depending on the urgency of your case) after registering the application, you can come to the traffic police again and ask about the results of consideration of your application, delivery of a response from the traffic police (to the initial appeal). If you are not given anything again, then you need to again record in writing the fact of coming to the traffic police using a similar statement (petition).

    If all the deadlines have passed, and the answer from the traffic police still does not come or is not delivered, then there is a violation of your rights, which means it’s time to file a complaint against the actions (inaction) of the traffic police officers. Of course, you can do this earlier if you don’t want to deal with the above-mentioned hassle.

    Is it possible to submit a complaint anonymously?

    As of 2021, it is not possible to file a complaint about traffic violations anonymously.

    This applies to a personal visit to the site, and filling out an electronic application form on the traffic police website, and sending it through other services.

    Human rights activists fear that anonymity will trigger a surge in fabricated statements driven by revenge or other interpersonal motives.

    In addition, in some cases additional evidence is required regarding the situation that has arisen.

    All this makes it impossible for applicants to remain anonymous.

    How to compose and direct?

    The specifics of drawing up a request are regulated by Article 7 of the Federal Law “On the Procedure for Considering Citizens’ Appeals.” Thus, the first paragraph of this article states that the appeal must contain the full name of the government body to which the request is submitted, and (or) the last name, first name, patronymic and position of the responsible person. It is also necessary to indicate the applicant’s full name, his postal address, then state the essence of the issue, sign and date. In general, the request should consist of 3 parts, in accordance with the template:

    1. A header indicating the full name of the organization and (or) the position of the responsible person, his full name, as well as the applicant’s full name, his address and contact phone number.
    2. The main body, which sets out the essence of the request in the form: “Please provide me with information from the traffic police MREO database about the availability of vehicles registered in my name. The certificate is required to be submitted to the tax authority.” If the applicant wishes to have the application sent to him by mail or e-mail, he must additionally indicate “Please send a response to my email inbox...”.
    3. The conclusion, where the attachments (list of documents attached to the request) are indicated, dated, signed and decrypted.

    Instead of an email address, a regular address may be provided so that the applicant can receive a response by regular mail. In any of the cases, the document will have legal force, and it can be used to provide it at the place of request (to the tax office, prosecutor, investigator, and so on).

    Request to the traffic police for information about the owner of the car

    There are several ways to submit a written request:

    • Personal visit to the traffic police department;
    • Sending an application by registered mail;
    • Sending an application by email;
    • Contact via the electronic communication form on the official website of the State Traffic Safety Inspectorate.

    The easiest way to contact is through the electronic communication form on the traffic police website. To do this, you need to go to the official website of the State Traffic Safety Inspectorate of Russia (or the State Traffic Safety Inspectorate of a specific region) and under the “Contacts” section, select the “Submit a request” tab. A window will open where the system will prompt you to familiarize yourself with the conditions for submitting an electronic appeal, after reading which you must check the box next to the item “I have read the conditions” and click “Submit an appeal.”

    Good to know: Not all vehicles are included in the traffic police database. For example, scooters up to 50 cubic meters are not subject to registration, which means it will not be possible to obtain information about their owner.

    A window will open with a form for filling out data. The form is no different from the written one; here you will also need to indicate the full name of the department (select from the list provided), indicate the full name and position of the person to whom the request is being submitted, indicate your personal data, and so on.

    According to paragraph 1 of Article 12 of the Federal Law “On the Procedure for Considering Citizens’ Appeals,” the state body (in this case, the traffic police) is obliged to provide a written response no later than 30 calendar days from the date of registration of the application. In turn, registration of the application must be carried out within 3 calendar days from the date of its submission. The above applies to all types of applications, regardless of how they were submitted to the traffic police.

    Briefly about the main thing

    Let us briefly summarize the main points of filing complaints regarding traffic violations:

    1. To report illegal parking or other traffic violations, you need high-quality and detailed photo and video files. It should be clear who did what.
    2. The period for consideration of the complaint is 30 days.

    4. When using online application services, you may be called to the traffic police department to give evidence or present original documents.
    5. You cannot submit an anonymous complaint.
