Customs tariffs for importing cars from third countries for legal entities will change from January 1, 2021. The State Revenue Committee (SRC) explained the formula by which customs clearance of vehicles will be carried out, taking into account the transition to tariffs operating within the framework of the Eurasian Economic Union (EAEU).

For example, if in 2021 a legal entity imports a car with a customs value of 7,800 euros, less than three years old and an engine capacity of 2,500 cubic centimeters, then, firstly, a tariff will be calculated at 15% of the cost of the car, that is, 1,170 euros. Then VAT will be added to the duty in the amount of 20% of the sum of the customs value and the amount of duty - 1794 euros ((7800€+1170€) x 20%=1794 euros).

Environmental tax will not be charged since the car is not more than 5 years old.

Thus, the legal entity will pay 2964 euros - customs duty plus VAT. When calculating the customs duty on cars older than three years, the engine displacement is also taken into account.

If a legal entity imports a vehicle with a customs value of 7,800 euros, an engine capacity of 2,500 cubic centimeters and an age of 6 years, then the tariff will be determined according to the following formulas: 7,800 € x 20% = 1,560 euros; 2500 cm3 x 0.44 € = 1100 euros. The customs tariff will be 1560 euros. VAT in this case will be 1872 euros.

And VAT together with duty will amount to 3432 euros. To this is added an environmental tax, which in the case of a 6-year-old car is 2% of the customs value - 156 euros.

As a result, the legal entity will pay 3,588 euros for the car during customs clearance.

For example, if you have an 8-year-old car worth 7800 euros, with a working volume of 2500 cubic centimeters, the duty per 1 centimeter will be 2.2 euros.

VAT will be calculated using the mentioned formula: (7800 euros+5500 euros)x20%=2660 euros. Together with the duty it will amount to 8160 euros. An environmental tax will also be added to this, which in this case will be 156 euros.

The State Revenue Committee also reports that if a legal entity imports a car in 2021 and submits a goods declaration rather than a transit declaration by December 31 inclusive, then customs clearance will be carried out according to the old rules.

Recently, messages appeared on one of the forums about a new method of bringing cars to Belarus through Armenia.

Belarus is also part of the EAEU, so in fact you can drive such cars here too. The State Customs Committee confirmed to us verbally that cars with Armenian registration can be driven around Belarus.

It is theoretically possible to register these cars, for example, by paying the difference in customs duties. That is, the same as with Kyrgyzstan. There are also two more methods on the Internet, but how real they are is still unknown.

The first is to wait until 2023, when the car becomes a product of the EAEU, and change accounting.

The second is if the car was imported into the territory of Armenia before October 10, 2014. But no one has really done this yet, so it’s too early to talk about anything. What could theoretically be the benefit? Now the old tariffs for customs clearance of cars are in force in Armenia, they are much lower than ours. And there are no restrictions on the year of release.

But agreements have been made that starting from 2021 Armenia will bring its tariff schedule in line with the technical regulations of the EAEU, that is, this is the last year with low duties in Armenia. And it’s already August, so whether it’s possible to bring the car in time is a big question.

  7. An individual has the right to clear customs for himself personally for a maximum of one car per 12 months.

The first is to wait until 2023, when the car becomes a product of the EAEU, and change accounting. The second is if the car was imported into the territory of Armenia before October 10, 2014. But no one has really done this yet, so it’s too early to talk about anything.

What could theoretically be the benefit?

Now in Armenia there are old tariffs for customs clearance of cars, they are much lower than ours. And there are no restrictions on the year of release. But agreements have been made that starting from 2021 Armenia will bring its tariff schedule in line with the technical regulations of the EAEU, that is, this is the last year with low duties in Armenia.

And it’s already August, so whether it’s possible to bring the car in time is a big question. In any case, prices for cars in some segments are lower than ours. “They also buy cars from us from Belarus, but not enough.” On one of the forums there is a message from an unknown author that in May of this year he brought a Volkswagen from Armenia.

I bought cars in Georgia, since they are even cheaper there. Another resident of Belarus, but a citizen of Russia, wrote to us in a personal message that he drove a Toyota from Japan to Armenia, registered it there in his name, and drives Armenian “license plates” around Belarus.

As it turned out, in order to register a car in Armenia, a Russian or Belarusian needs to register. There are organizations in this country that quickly help in this matter.

To complete the registration of vehicles with left-hand controls, registered for citizens of the Republic of Kazakhstan in the authorized bodies of the Republic of Armenia and imported into the Republic of Kazakhstan before February 1, 2021, the owners represent:

Payment of taxes, duties and fees

Before permanent registration you will have to pay:

  • customs duties and duties;
  • value added tax (VAT);
  • excise tax;

First, you need to calculate the customs value of the goods. The customs value of a product is the price of the product and the amount of expenses incurred during purchase and transportation. The amount of customs duties is determined from the customs value. The fee for customs declaration of goods is 20,000 tenge.

The next payment is excise tax, excise tax rates are fixed and amount to 100 tenge per 1 cubic cm.

The VAT rate is set at 12%. The amount is calculated according to the following scheme: VAT = (Customs value + Duty, fees + Excise tax) x 12%.

Payment of recycling fee

From January 1, 2021, the principle of extended obligations of manufacturers (importers) - EPR - is in effect.
EPR obligations apply to products included in the list.

The list also includes vehicles for which you must pay a recycling fee.

Recycling fee is a payment to the operator of extended obligations of manufacturers (importers), carried out by the manufacturer (importer) for organizing the collection, transportation, processing, neutralization, use and (or) disposal of waste generated after the loss of consumer properties of products (goods), for which (which) extended obligations of manufacturers (importers) and its (their) packaging apply. Automobile manufacturers, official importers and individuals wishing to import cars into Kazakhstan are required to pay a recycling fee.

The size of the recycling fee is calculated based on the coefficient applied to the base rate in relation to various types of vehicles. The base rate is 50 MCI.

For passenger cars it is calculated based on engine size:

  • up to 1,000 cubic meters cm - coefficient 3;
  • from 1,001 to 2,000 cubic meters cm - coefficient 7;
  • from 2,001 cubic meters cm up to 3,000 cc. cm – coefficient 10;
  • over 3,001 cubic meters cm - coefficient 23.

The minimum recycling fee is for cars with electric motors, with the exception of hybrid ones. A coefficient of 3 is applied to them.

Payment of the recycling fee is carried out before the initial registration of the car on the website https://recycle.kz/.

Vehicle requirements

Only vehicles with left-hand drive controls are subject to registration.
If facts of “switching” of controls are revealed, citizens will need to obtain a certificate of safety of the vehicle design or a protocol for checking the safety of the vehicle design, which are issued by accredited testing laboratories.

If there is a certificate or protocol, this vehicle will be registered and approved for operation in the Republic of Kazakhstan.

What is required for permanent vehicle registration?

Registration of vehicles imported into the Republic of Kazakhstan is carried out upon provision of the following list of documents:

  1. identification;
  2. documents confirming:
  • passing customs clearance;
  • payment of duties and fees established by the Tax Code (in accordance with Article 615 of the Tax Code for the issuance of: vehicle registration certificate - 1.25 monthly calculation index (hereinafter - MCI); state registration license plates for a car - 2.8 MCI; for initial state registration of a vehicle in accordance with Article 553 of the Tax Code);
  • recycling fee (fulfillment of extended obligations by manufacturers (importers) during the initial registration of vehicles established by the Environmental Code of the Republic of Kazakhstan);
  1. a document confirming the ownership of the vehicle (purchase and sale agreement, document on the right to inherit property, exchange agreement, donation drawn up in accordance with the requirements of civil law);
  2. certificates of safety of the vehicle design to confirm the vehicle’s compliance with the requirements of the technical regulations of the Customs Union 018/2011 “On the safety of wheeled vehicles” (issued by accredited laboratories in the field of certification).

The above list of documents is handed over to the PSC employees to formulate an application and subsequently send it to the internal affairs authorities to check for theft and search, after which the vehicle is registered.

Consequences of late registration

This category of citizens, in accordance with the requirements of current legislation, is obliged to take measures to prevent the operation of such vehicles (they can be taken out of the country, sold for spare parts, or returned to the previous owner in a civil or judicial proceeding).
No special raids will be carried out, but if the driver of such a vehicle violates the Traffic Rules, then measures will be taken against him, including for operation in violation of vehicle registration requirements, for which liability is provided in the form of a fine of 10 MCI (29,170 tenge) (Article 590 of the Administrative Code) and placing the car in the impound lot.
