CASCO – voluntary insurance of a car against damage or theft. Depending on the form, it can be complete (from theft and damage) or partial (from theft or from creation).
In accordance with the Directive of the Bank of the Russian Federation No. 3380-U, starting from 2014, citizens who insure their car under a CASCO agreement can use the European protocol. This is a paper containing the circumstances of a traffic accident, without the involvement of traffic police officers, which significantly reduces the time it takes to register an accident. If the document is filled out correctly, it allows you to receive insurance payments.
Payment limit under the Europrotocol
Until October 1, 2021, motorists living in the regions could count on a maximum amount of compensation under the Euro Protocol in the amount of 100 thousand rubles. Only residents of the official and cultural capitals and adjacent regions could count on a payment of 400 thousand rubles if certain conditions were met.
Now motorists throughout the country are subject to a single amount limit under the Euro Protocol - 400 thousand rubles. This decision of the authorities was positively received in the regions of the country. What insurance cases are suitable?
The conditions for registration of the European protocol impose some restrictions on drivers. First of all, this is the absence of disagreements between drivers regarding the culprit and the circumstances of the incident.
The paper is issued only if only 2 vehicles were involved in the accident. In the event of an accident involving 3 or more cars, even if there is no disagreement, it is necessary to call the traffic police inspectors.

The second condition is the absence of damage to third-party property that is not the property of the participants in the incident on the road. This could be a pole, fence, trash container, etc.
The European protocol cannot be used in an accident in which the driver was under the influence of alcoholic beverages, narcotic or psychotropic substances. This is a serious offense that must be recorded by representatives of the State Traffic Inspectorate.

Insurance rules require that within 5 days you must submit your European accident report to the organization that issued the insurance policy - this can be done at any company office or using notification letters. Once the form is received, the insurance company must notify you of how to proceed. In most cases, these organizations send letters with instructions on how to receive funds and the timing of their disbursement. According to the law, during the first 15 days you do not have the right to carry out repair work without the written permission of the organization that issued the policy; after this period, you can contact the insurer with claims.
In addition, do not agree to a European accident report if the amount exceeds the specified limit and the other participant in the accident offers to pay the balance from his own pocket, since such promises can very easily be forgotten.
It is necessary to fill out the form with caution, since the slightest mistake can cause non-payment of compensation.
If the insurer, having considered the materials provided to it by the injured party, refuses to compensate the amount of damage under the European protocol that the injured party was counting on, which is significantly lower, it can sue the insurance company by going to court. This possibility is fixed in paragraph 5 of Article 23 of the Civil Procedure Code of the Russian Federation. Such a claim should be filed in the magistrate's court.
Filling out the European protocol
The European protocol form is issued by the insurance company along with the CASCO and MTPL agreement.

The other side of the form is filled out by each party to the accident individually and includes information about the vehicle, the circumstances of the accident, details of the driver and owner of the car, other participants in the accident, and damage. In case of serious damage and the impossibility of independent movement, it is necessary to indicate the address of the parking lot where the car will be parked. The authenticity of the entries made is certified by the signature and date of completion.
How to fill out the Europrotocol form
Competently filling out the form is based on formal and informal rules, the implementation of which will prevent confusion.
So, there are some unspoken rules for successfully filling out the form:
- Use a simple ballpoint pen when filling . This rule is based on the fact that using a pencil or gel pen can lead to smearing of the writing or its complete disappearance from the paper. In this case, understanding the matter will be quite problematic.
- The form must be completed in legible handwriting. If the motorist cannot comply with this requirement, he must write in block letters (even if it takes longer).

Filling out the front side
The Euro Protocol form assumes a two-sided format. This means there are two sides to fill out the information.

- Indicate the date and location of the collision. You cannot enter approximate information: only accurate information. If an accident occurred on a highway, motorists must enter the name of the road facility and the number of the kilometer where the incident occurred on the form.

The main rule for filling out the form is to provide complete information using clear, specific language. It is important to convey information to the insurer in an accessible and understandable form so that the company does not have the opportunity to refuse payments.
How to draw up an accident diagram
The legislation does not provide precise explanations about exactly how to draw up a diagram of a traffic accident. All that is required from participants when drawing up the Europrotocol is to reflect the current situation as clearly and simply as possible using a diagram. To ensure that no additional questions arise after examining the drawing, you should follow the following procedure when drawing up the drawing:
- Draw the direction and outline of the roadway where the collision occurred. It is also necessary to indicate the names of nearby objects and streets. Road signs, marking instructions and other important landmarks also need to be put on the diagram.
- Apply a model of the location of vehicles at the time of the incident to the prepared sketch. At this stage, it is worth using special designations: triangles - for cars (previously designated with the letters “A” and “B”, which were previously indicated in the documents when describing these vehicles), “X” - to indicate the location of the impact.
- Indicate with arrows the direction of movement of the vehicles.

After creating an accident diagram, those involved in the accident need to double-check the information provided and make sure there are no discrepancies. At this stage, filling the front side ends. Filling the back side
The flip side is allowing those involved in the incident to give their independent opinions on the circumstances of the event. Motorists can provide additional information here. Important additional information includes clarification of whether the owner of the car was driving or only the driver specified in the OSAGO. In the field specially designated for notes, the motorist also indicates the information received during the inspection of the car or the presence of a recording from the DVR.
It is important to know that if it is necessary to change data, participants must ensure that the correction is accurate. The new text must be clear and legible. After writing, the adjustments made are certified with the signatures of both motorists.
What payments?
A participant in an accident with a CASCO policy has the right to contact the company for full compensation for the cost of car repairs. The second party has the right to compensation for damage under the MTPL policy. When calculating payments, the following are taken into account:
- terms of the agreement (validity period, payment terms, availability of additional services, franchise);
- vehicle data (percentage of theft of the insured car brand, age of the car, cost of spare parts, presence of an anti-theft system);
- information about the driver (age, driving experience, including accident-free);
- region.
In addition, during the calculation only the parts that need to be replaced and depreciation of the vehicle are taken into account:
- tire wear;
- car mileage;
- service life of parts.
Based on the results of the examination, the insurance company offers the victim 2 options for covering the damage:
- repairs at a station with which there is an agreement or in an official service;
- cash compensation.
When choosing the second method, the participant in the accident has the right to payments in the amount of:
- 50 thousand rubles. in the regions of the Russian Federation;
- 400 thousand rubles. in Moscow and St. Petersburg.
To receive compensation, you must contact the insurance company within 24 hours, or better yet, immediately and provide detailed information about the accident, an application and a package of documents specified in the CASCO agreement. After this, the organization sends the car for examination to assess the damage received as a result of the accident. If the payment limit under the European protocol is exceeded, it is necessary to provide photo and video evidence of the incident from the scene of the accident.
Important! Photos and videos from the scene of the incident (vehicles from all sides and detailed location of damage, roads, braking distances, nearby structures) should be attached to the European protocol, which allow you to confirm the accuracy of the information entered in the form.
Compensation or referral to a service station is issued within 20 days from the date of application to the insurance company. In case of delay, the CASCO agreement provides for payment of a penalty in the amount of 1%.
An insurance company may refuse to pay if:
- the fact of a serious traffic violation has been established;
- the protocol is incorrectly drawn up;
- the terms of the CASCO agreement have not been met;
- people were injured as a result of the accident;
- there are disagreements between the parties.
In what cases can you file an accident without the traffic police?
If participants in an accident decide to draw up a European protocol, then they do not have to call the traffic police.
However, such a document cannot be drawn up in all cases. The following conditions must be met:
- Only two vehicles were involved in the accident.
According to current legislation, a trailer is not an independent vehicle.
- Those involved in the accident suffered only material damage. It follows from this that if at least one of the drivers suffered harm to health or life, then the document will not be drawn up.
- There are no disagreements between the parties. This means that the participants in the accident determined the person at fault, the amount of damage, and the nature of the accident.
- The amount of damage must not exceed the established payment limit under the European protocol. Otherwise, it is impossible to do without involving traffic police officers.
If at least one of the above conditions is not met, then such a document will not be issued. It will be necessary to call the traffic police officers.
Even if one of the participants in the accident is a foreigner, it is still possible to issue a European protocol. It is important that a citizen of another state is the owner of a vehicle registered outside the Russian Federation.

A sample Europrotocol was approved by the Bank of the Russian Federation, in particular by Regulation No. 431-P dated September 19, 2014, Appendix 5. Below is an example of filling out the form, which is possible in accordance with Art. 11 clause 8 of Law No. 40-FZ “On compulsory insurance of civil liability of vehicle owners.”

Note : The consequences of the accident were recorded on a camera and a mobile phone video camera; no adjustments or changes were made.

Procedure in case of an accident
